Mayor Pro -Tem Dowie in the Chair. Roll call: Getty, Lichty, Klinger, Seeber, Dame, Wright. Absent: Penaluna. Invocation by Getty. 86587 - Moved by Getty, seconded by Lichty that the Agenda, as amended for the Regular Session of October 15, 1984, at 7:00 p.m., be accepted and approved. Motion carried. 86588 - Moved by Seeber, seconded by Getty that the Minutes of the Regular Session held October 8, 1984 at 7:00 p.m., be approved. Motion carried. ORAL PRESENTATIONS 86589 - Councilperson Getty asked that the City Sycamore, Lafayette and Mulberry Streets Park Avenue (E. Park Avenue is currently open to traffic) to alleviate congestion PETITIONS FROM PUBLIC 86590 - Moved by Getty, seconded by Klinger Engineer investigate opening at their crossings with E. being reconstructed and not in the vicinity. that the communication from the Planning, Programming and Zoning Commission transmitting the request of Vern Jackson to rezone from "M-1" Light Industrial District to "C-2" Commercial District property located between I-380 and Texas Street and between Easton Avenue and Howard Street together with recommendation of denial be received, placed on file and "Resolution setting date of hearing as November 5, 1984 at 7:00 p.m. in the City Hall Council Chambers on above described request", be adopted and Clerk/Auditor instructed to publish notice of same. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1984-472. 86591 - Moved by Getty, seconded by Klinger that communication from Planning, Programming and Zoning Commission transmitting the site plan for a proposed horticultural building and greenhouse at the Hawkeye Institute of Technology generally located north of E. Orange Road and East of Hammond Avenue together with recommendation of approval be received, placed on file, and "Resolution approving said site plan", be adopted. Ayes: Six. Absent: Penaluna. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1984-473. 86592 - Moved by Getty, seconded by Klinger that communication from Planning, Programming, and Zoning Commission transmitting request of Jerry Fannon, 1409 Aspen Drive to reduce an 8' utility easement to 5' at said address for the construction of a garage together with Planning, Programming and Zoning Commission's recommendation of approval be received, placed on file and "Resolution setting date of hearing as October 22, 1984 at 7:00 p.m. in the City Hall Council Chambers on above described request", be adopted and Clerk/Auditor instructed to publish notice of same. October 15, 1984 86593 - Moved by Getty, seconded by Klinger ''11\ Page Two that communication from the City Planner transmitting the application of DaJoe Properties for tax exemption for improvements to the property located at 425 Franklin Street, with said property located in the Franklin Urban Revitalization Plan together with recommendation of approval be received, placed on file, and "Resolution approving said tax exemption for said property for a 100% exemption for three years", be adopted and Clerk/Auditor instructed to notify the City Assessor accordingly for final determination of said exemption. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1984-475. 86594 - Mayor Pro -Tem Dowie announced that the time had arrived to hear comments on the concept plans for W. 4th Street, Hoff Road, and Kimball Avenue. Mark Boesen, Transportation Specialist, gave a brief description of the W. 4th Street and Hoff Road Projects. Jack Fellenzer, Transportation Specialist, gave a brief description of the Kimball Avenue Project. Don Bergan, 255 Sheridan Road and Vice Chairman of the Waterloo Chamber of Commerce, spoke in favor of said projects. Bob Brown, member of the Citizen's Support Group for Transportation, spoke in favor of said projects. Alice Ritland, speaking on behalf of Winninger Realtors, 3356 Kimball Avenue, supported the projects. Bill Rickert stated that the improvements to Hoff Road will not best serve the needs of the area. Moved by Getty, seconded by Klinger that communication from City Planner transmitting the recommendation of the Planning, Programming, and Zoning Commission on the concept plan for W. 4th Street (IX -6587(1)--79-07) from Shaulis Road to Ansborough Avenue together with recommendation of approval be received, placed on file and "Resolution approving said concept plan", be adopted. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1984-476. 86595 - Moved by Getty, seconded by Klinger that communication from City Planner transmitting the recommendation of the Planning, Programming, and Zoning Commission on the concept plan for Hoff Road Project (IX -6591(1)--79-07) together with recommendation of approval be received, placed on file and "Resolution approving said concept plan", be adopted. Motion carried. 86599 - Moved by Klinger, seconded by Seeber that the communication from the Reorganization Committee transmitting recommendation on salary of Personnel Analyst/Affirmative Action Officer in the amount of $22,415 be received, placed on file and approved. Motion carried. 86600 - Moved by Klinger, seconded by Seeber that the Community Development Board Minutes of September 11, 1984 be received and placed on file. Motion carried. UNFINISHED BUSINESS 86601 - Donna Lesyshen, Assistant City Attorney, reported that their research has revealed that the $.50 copywrite fee is not a governmental tax and therefore is not a legal charge. Moved by Getty, seconded by Lichty that the communication from the Assistant City Attorney transmitting recommendation on the $.50 increase to Cable Subscribers for copywrite fees together with recommendation that said fee is not an authorized fee as specified in Ordinance No. 2949, An ordinance regulating Cable TV, be received, placed on file, and action delayed for one (1) week. Motion carried. 86603 - Moved by Klinger, seconded by Getty that communication from City Planner transmitting agreement with the State Historic Preservation Office to aid in conducting an Architectural and Historical Survey over the next two (2) years, together with recommendation of approval be received, placed on file, and "Resolution approving said document", be adopted and Mayor Pro -Tem and Clerk/Auditor authorized to execute same. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1984-479. 86604 - Moved by Klinger, seconded by Getty that communication from City Planner transmitting consultant's contract with Barbara Beving Long to conduct an architectural survey known as the Waterloo Architectural Survey Project, together with recommendation of approval be received, placed on file, and "Resolution approving said contract", be adopted and Clerk/Auditor and Mayor Pro -Tem authorized to execute same. RESOLUTIONS TO BE ADOPTED 86606 - Moved by Getty, seconded by Klinger that "Resolution authorizing the execution of Memorandum of Agreement with Tota -Cure, Inc., for the issuance of Industrial Revenue Bonds Series 1984", be adopted. Resolution adopted and upon approval by Mayor Pro -Ten assigned No. 1984-481. 86607 - Moved by Getty, seconded by Lichty that "Resolution fixing date of hearing as November 5, 1984, at 7:00 p.m. in the City Hall Council Chambers on,proposed Industrial Development Bonds Series 1984, Tota -Cure, Inc., in an amount not to exceed $2,000,000", be adopted and Clerk/Auditor instructed to publish notice of hearing accordingly. Granger, and Fedon Petrides to the Waterloo Redevelopment Authority with term expiration on October 13, 1988, be received, placed on file and approved. Motion carried. 86609 - Moved by Getty, seconded by Klinger that communication from Waterloo Water Works transmitting damage to property located at 1534 Schultz, owned by Henry Grovo and Rienelda F. Grovo, together with recommendation of approval be received, placed on file and "Resolution authorizing certification of said damages to said property", be adopted and Clerk/Auditor instructed to take action accordingly.
