The Council of the City of Waterloo, Iowa, met in Regular Session at
City Hall Council Chambers, Waterloo, Iowa at 7:00 p.m. on August 27,
1984. Mayor Bowers in the Chair. Roll call: Getty, Lichty,
Penaluna, Klinger, Seeber, Dowie and Wright.
Invocation by: Wright.
86322 - Moved by Dame, seconded by Getty
that the Agenda, as proposed or amended for the Regular Session of
August 27, 1984, at 7:00 p.m., be accepted and approved.

86323 - Moved by Klinger, seconded by Lichty
that the Minutes of the Regular Session held August 20, 1984 at
7:00 p.m., be approved.

86324 - Moved by Seeber, seconded by Wright
that proof of publication of notice of public hearing for application
to the U.S. Department of Housing and Urban Development for 11 units
of Section 8, Existing Housing and Assistance Payments Program, as
published in the Waterloo Courier on August 7, 1984 be received and
placed on file.

that "an Ordinance vacating a portion of West Fourth Street located
between Waterloo Building and West Side Parking Ramp", be received,
placed on file, passed and considered for the first time. Ayes:

that rules requiring ordinances to be considered and voted for
passage at two prior meetings, be suspended, and that below ordinance
be recorded as having been considered and passed for the second and
third times and now placed on its final adoption. Ayes: Seven.

86330 - Moved by Penaluna, seconded by Klinger
that "an Ordinance vacating a portion of West Fourth Street located
between Waterloo Building and West Side Parking Ramp", be adopted.

86331 - Moved by Klinger, seconded by Getty
that "Resolution authorizing sale and conveyance of a portion of
West 4th Street located between Waterloo Building and West Side
Parking Ramp to Conway Plaza Development Company", be adopted and
City Attorney instructed to prepare a deed accordingly. Ayes:
Seven.

ORAL PRESENTATIONS
86332 - Virginia Cleaver, 1940 Ansborough Avenue, opposed the Phase II
portion of the widening of Ansborough Avenue for the following
reasons: noise, lowering of property values and hazard to 563
children attending Devonshire School. She did not oppose the four
(4) lane project from U.S. Highway 63 to University Avenue.
Larry Ehrig, 2122 Ansborough Avenue, suggested that the Council
consider one (1) of the other alternates to the Hackett By -Pass
preferably one not requiring the widening of Ansborough Avenue. He
read from the Environmental Impact Statement (EIS) for the Hackett
By -Pass which stated that the State Archeologist has stated that
little or no impact would be realized in the greenbelt if the road
followed this corridor alignment.
Charles Higgins, 3422 Ellington, stated that the reason Ansborough
Avenue needed to be widened was due to the closing of San Marnan
Drive west of West Fourth Street.
Lee Wilhelms, 249 Meadowbrook Lane, spoke in opposition to the
widening. He suggested the use of Norton Avenue and West Third
Street.
Ken Leahy, 2010 Ansborough Avenue, opposed the widening of Ansborough
Avenue. He stated that property owners will be donating their front
yards to the project and then will be paying higher property taxes.

ORAL PRESENTATIONS CONTINUED
Dan Niemeyer, 2232 Ansborough Avenue, opposed the widening. He
reported on population projects for the year 2000 as they relate to
the future transportation plan for the City: With the City's
population not expected to increase significantly, he questioned the
need for such a project.
Nathan Zeiger, 3105 Ansborough Avenue, stated that when his home was
built in 1959, he did not expect the area to develop creating the
need for a four -lane facility.

that the above remarks be received and placed on file.

86333 - C.L. Hoffman, 2816 Idaho Street, asked that a twenty-four (24) hour
traffic count be taken on Idaho Street. He thanked City officials
for reducing the speed limit on Idaho Street.

that the above remarks be received and placed on file.

PETITIONS FROM PUBLIC
86334 - Moved by Getty, seconded by Lichty
that communication from Planning, Programming and Zoning Commission
transmitting site plan for addition to Christ Lutheran Church, 234
South Hackett Road, together with recommendation of approval be
received, placed on file, and "Resolution setting date of hearing as
September 10, 1984 at 7:00 p.m. in the City Hall Council Chambers on
above desribed proposal", be adopted and Clerk/Auditor instructed to
publish notice of hearing accordingly.
Prior to a vote on this Resolution, Planning and Development Director
Don Temeyer reported that the staff had given administrative approval
to the site plan based on the insignificance of the amendment and
that the public hearing could be waived.
The above motion was then withdrawn.

that communication from Planning, Programming and Zoning Commission
transmitting request of Christ Lutheran Church for site plan review
of addition at 234 South Hackett Road, together with recommendation
of approval, be received, placed on file, and "Resolution approving
said site plan", be adopted. Ayes: Seven.

that Report of City Engineer on proposed changes to the traffic
ordinance pertaining to Hess Road be received, placed on file, and
referred to the City Attorney for submission of an ordinance
accordingly.

that communication from Deputy Auditor transmitting FY 1984 Street
Finance Report, Road Use Tax Fund, be received, placed on file, and
"Resolution approving said document", be adopted and Clerk/Auditor
instructed to forward said report to the Iowa Department of

proposed agreements (484-F-097) with Iowa Department of

engineering costs for Hackett Road Bypass, Phase I Construction,
together with recommendation of approval be received, placed on file,
and "Resolution approving said agreements", be adopted. Ayes:

Engineer to submit report to the Iowa Department of Transportation.

Shappert Engineering Company together with recommendation of approval
be received, placed on file, approved, and Mayor and Clerk/Auditor
authorized to execute same.

that "Resolution authorizing cancellation of real estate taxes for
property purchased in connection with East Side Parking Ramp, City

accordingly. Ayes: Seven.

Code, by adding Subsections (43c) and (43d) Hess Road to Section 541,
increasing speed limits in certain areas; and by adding Subsection
(44b) Hess Road to Section 543, thru streets", be received, filed,
considered and passed for the first time. Ayes: Seven.
