Mayor Bowers in the Chair. Roll call: Getty, Lichty, Penaluna, Klinger, Seeber, Dowie, Wright Invocation by Getty. 86244 - Moved by Wright, seconded by Dowie that the Agenda, as proposed for the Regular Session of August 13, 1984, at 7:00 p.m., be accepted and approved. Motion carried. 86245 - Moved by Dowie, seconded by Lichty that the Minutes of the Regular Session held August 6, 1984, 7:00 p.m., be approved. Motion carried. HEARINGS AND BIDS 86246 - Moved by Wright, seconded by Dowie that proof of publication of notice of public hearing on plans, specifications, etc. and the taking of bids for the F.Y. 1985 Maywood Storm Sewer Improvements, Area 3 Outlet, Contract No. 276 as published in the Waterloo Courier on July 27, 1984 be received and placed on file. Motion carried. 86247 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Wright, seconded by Penaluna that "Resolution confirming the approval of plans, specifications, etc., for the FY 1985 Maywood Storm Sewer Improvements, Area 3 Outlet, Contract No. 276", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-365. 86248 - Moved by Getty, seconded by Wright that 'Resolution ordering construction for the F.Y. 1985 Maywood Storm Sewer Improvements, Area 3 Outlet, Contract No. 276", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-366. 86249 - Moved by Wright, seconded by Getty to receive, file, and instruct Clerk to open and read bids, and refer to Engineer for review and recommendation (see CR86279): Bidder Nucon Construction Inc. Motion carried. 86251 - HOLD HEARING --This being the time and place of hearing the Mayor called for oral and written objections and there were none. Moved by Klinger, seconded by Wright that the recommendation of approval of the Planning, Programming and Zoning Commission be received and placed on file. Motion carried. 86252 - Moved by Seeber, seconded by Dowie that "Ordinance vacating a portion of Norwood Avenue lying between Riverside Drive and the Cedar River", be received, filed, considered and passed for the first time. Ayes: Seven. Motion carried. 86253 - Moved by Klinger, seconded by Getty that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that below ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Seven. Motion carried. 86254 - Moved by Getty, seconded by Wright that "Ordinance vacating a portion of Norwood Avenue lying between Riverside Drive and the Cedar River", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 3360. 86255 - Moved by Seeber, seconded by Klinger that "Resolution authorizing sale and conveyance of a portion of Norwood Avenue lying between Riverside Drive and the Cedar River Drive", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-367. ORAL PRESENTATIONS 86256 - Bob Larson, 506 W. 6th Street, asked that the City enforce the 1 hour parking restriction on W. 6th Street. Enforcement through the Police Department has been unsuccessful. He also asked for uniform enforcement of private person's use of the "parking area". Moved by Getty, seconded by Lichty that the above remarks be received, placed on file, and referred to the Police Department. Motion carried. Al"1 August 13, 1984 ORAL PRESENTATIONS CONTINUED "IN Page Three 86257 - Doris Nothnagel, 2115 Skyline Drive, objected to the lifting of the truck embargo on W. 4th Street, south of Highway 412. She also asked whether the embargo on the bridge (Prescott's Creek) had also been lifted. Mayor Bowers stated that the Council had approved the lifting of the embargo. (Resolution No. 1984-360) on August 6, 1984. Councilperson Wright, reported that the Building & Grounds Committee had approved the parking lot design behind City Hall for city employee parking and that the plan would become effective Tuesday, August 14, 1984. PETITIONS FROM PUBLIC 86257 - Moved by Getty, seconded by Klinger (Cont) that petition from area residents requesting City purchase of land running parallel south of Relocated 20 between Highway 63 and West Fourth Street to develop a lake -park be received, placed on file, and that the possible purchase of said property be investigated. Motion carried. 86258 - Moved by Seeber, seconded by Klinger communication from City Engineer transmitting request of Edith M. Lindberg, 1642 Liberty Avenue, to construct temporary concrete driveway irrespective of latter official grade, be received, placed on file, and "Resolution authorizing said request", be adopted. Ayes: Seevn. Resolution adopted and upon approval by Mayor assigned No. 1984-368. 86259 - Clerk/Auditor Larry P. Burger reported that the applicant would not be running the business from the 2545 Burton Avenue location, but would be dispatching from Answer Iowa, Inc. Also, the applicant has submitted a certificate of insurance in excess of the ordinance requirements. Moved by Seeber, seconded by Klinger that application from Mini Cab Company to operate a taxi service in the City of Waterloo be received, placed on file, approved, and Clerk/Auditor instructed to issue a license accordingly. Motion carried. 86260 - Moved by Klinger, seconded by Dowie that the City Auditor's Statement for July, 1984 be received and placed on file. Motion carried. 86261 - Moved by Klinger, seconded by Dawie that the minutes of the Community Development Board of July 10, 1984 be received and placed on file. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-369. 86263 - Moved by Getty, seconded by Klinger that communication from City Engineer transmitting Engineering Contract with Wayne Claassen Engineering and Surveying, Inc., for the F.Y. 1985 Fowler Street Sanitary Sewer Improvements, Phase II, Contract No. 238 together with recommendation of approval be received, placed on file, and "Resolution approving said documents", and Mayor and Clerk/Auditor authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 1984-370. 86264 - Moved by Getty, seconded by Klinger that communication from Transportation Program Manager transmitting agreements with Iowa Department of Transportation for reimbursement of construction costs and construction engineering costs for Hoff Road, Project No.(IX-6591(1)--79-07) together with recommendation of approval be received, placed on file and "Resolution approving said documents", be adopted and Mayor and Clerk/Auditor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-371. 86265 - Moved by Getty, seconded by Klinger that communication from City Engineer transmitting Contracts, Bonds and certificate of Insurance from Cedar Valley Corp., for the E. Park Avenue Area Improvements Project, Contract No. 263, together with recommendation of approval be received, placed on file, and "Resolution approving said documents", be adopted and Mayor and Clerk/Auditor authorized to execute same. RESOLUTIONS TO BE ADOPTED 86266 - Jon Fister reported that a date of hearing will be set at a later date and that said issuance would not be an obligation to the tax payers in the City of Waterloo. Moved by Getty, seconded by Seeber that "Resolution authorizing execution of memorandum of agreement with Arbor Development Company of Iowa regarding issuance of Urban Revitalization Area Revenue Bonds ($6.5 million)", be adopted. Ordinance adopted and upon approval by Mayor assigned No. 3358. 86269 - Moved by Getty, seconded by Lichty that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that below ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Motion carried. 86270 - Moved by Seeber, seconded by Klinger that "Ordinance amending the Code of Ordinances of the City of Waterloo, Iowa, by repealing Section 27-14, Window Peeping, of Chapter 27, Offenses --Miscellaneous; and by enacting in lieu thereof a new Section 27-14, Window Peeping, to Chapter 27", be adopted. Ayes: Seven. Moved by Dowie, seconded by Wright that "Resolution awarding contract for FY1985 Maywood Storm Sewer Improvements, Area 3 Outlet, Contract No. 276, to Peterson Contractors, Inc. in the amount of $253,246.19", be adopted. EXECUTIVE SESSION 86280 - City Attorney Dave Tyler reported that the Executive Session was authorized per Section 28A.5(c) of the State Code of Iowa. Motion carried. 86282 - Moved by Dowie, seconded by Klinger to direct the City Attorney to offer $2,590.78 to Millie's Maid -Rite, 617 Lafayette and $3,915.00 to Lafayette Tap, 615 Lafayette for moving costs and related expenses in conjunction with the demolition of the Lafayette Building.
