Mayor Bowers in the Chair. Roll call: Getty, Lichty, Penaluna, Seeber, Dowie, Wright. Absent: Klinger. Invocation by: Wright. 86152 - Moved by Seeber, seconded by Wright that the Agenda as proposed for the Regular Session of July 23, 1984 at 7:00 p.m., be approved. Motion carried. 86153 - Moved by Wright, seconded by Lichty that the Minutes of the Regular Session held July 16, 1984 at 7:00 p.m., be approved. Motion carried. HEARINGS AND BIDS 86154 - Moved by Penaluna, seconded by Getty that proof of publication of notice of public hearing on plans, specifications, and taking of bids for the F.Y. 1985 Paving Program, Contract No. 266 as published in the Waterloo Courier on July 6, 1984 be received and placed on file. Motion carried. 86155 - Hold Hearing --This being the time and place of public hearing, the Mayor called for oral and written objections and there were none. Moved by Getty, seconded by Dowie that "Resolution adopting plans, specifications, form of contract and estimate of cost," be adopted. Ayes: Six. Absent: Klinger. ed and upon approval by Mayor assigned No. 1984-332. Resolution adopt 86156 - Moved by Getty, seconded by Seeber to receive, file, and instruct City Clerk/Auditor to open and read bids and refer to Engineer for recommendation. (See CR 86160 for award of contract): Bidder Bid Bond Bid Cedar Falls Construction 5 percent $721,194.68 Cedar Falls Cedar Valley Construction 5 percent $740,858.12 July 23, 1984 ORAL PRESENTATIONS Page Two 86157 - Jimmie Porter, 330 Saxon, asked that the City take action to remedy the tall weed situation in the City View area. A petition had earlier been presented to the City from area property owners. He also asked that the trees and limbs resting on wires in the same area be trimmed. Mayor Bowers reported that Iowa Public Service had been contacted in this regard. Moved by Wright, seconded by Lichty that the above matter be received, placed on file and referred to the Park Department for review. Motion carried. 86158 - Councilperson Wright asked that the weed situation in the East Seventh and East Eighth Streets area be addressed. Donna Lesyshen, Assistant City Attorney, stated that the Weed Ordinance (Ordinance No. 3341) provides for the complaining party to submit a written complaint in the Park Department. Jeanette Smelser, 115 Norton Avenue, asked that the City take action to pave portions of Home Park Boulevard, Norton Avenue and West Third Street from U.S. Highway 63 to Ansborough Avenue due to the safety hazard of pedestrians in the area. Bob Stevenson, Transportation Program Manager, reported that the scheduling of this project (known as the Third Street Extension) is for design in 1985 and construction in 1986. Federal money is available for the design if carried out in the time table described above. However, should the City wish to move the construction phase up, the City would be responsible for the design costs with no reimbursement. Estimated cost of design is $60,000.00. Moved by Penaluna, seconded by Dowie that the above remarks be received, placed on file and referred to City Engineer, Sign and Traffic and Transportation Program Manager. Motion carried. 86159 - Mayor Bowers read a letter from Christopher P. Dunn submitting his letter of resignation effective immediately from the position of Acting Affirmative Action Officer for Contract Compliance. Moved by Wright. seconded by Dowie that the above letter be received, placed on file and referred to the Personnel Department. Motion carried. 86160 - Eric Thorson, City Engineer, reported that the low bid of Youngblut Construction in the amount of $694,119.15 was in order and recommended its approval. (See CR 86156). Moved by Dowie, seconded by Getty that "Resolution awarding the FY 1985 Paving Program, Contract No. 266 to Youngblut Construction of Washburn, Iowa", be adopted. Ayes: Six. Absent: Klinger. Miller Roscamp, 227 East San Marnan Drive, for temporary concrete driveway without regard to sidewalk grade, together with recommendation of approval be received, placed on file, and "Resolution approving said request," be adopted. Resolution adopted and upon approval by Mayor assigned No. 1984-335. 86163 - Moved by Seeber, seconded by Wright that communication from City Engineer transmitting request of George Strumpel, 2918 Saratoga Drive, for temporary concrete driveway without regard to sidewalk grade, together with recommendation of approval be received, placed on file, and "Resolution approving said request," be adopted. Ayes: Six. Absent: Klinger. Resolution adopted and upon approval by Mayor assigned No. 1984-336. UNFINISHED BUSINESS 86164 - Moved by Dowie, seconded by Getty that communication from Waterloo Housing Authority Director transmitting recommendation on award of contract for conversion to gas heat and hot water conversion for 225 West Ridgeway Avenue (Ridgeway Towers) to low bid of Young Plumbing and Heating in the amount of $167,000 including Alternate 3 be received, placed on file and "Resolution awarding said contract to Young Plumbing and Heating", be adopted. REPORTS 86165 - Moved by Getty, seconded by Lichty that communication from Planning, Programming and Zoning transmitting report regarding paint smells at Quality Refinishing, 2059 Logan Avenue, be received and placed on file. July 23, 1984 DOCUMENTS Page Four 86166 - Mayor Bowers inquired about the compliance audit dealing with Neighborhood Housing Service's allocation of Community Development Block Grant Funds. Walter Reed, Executive Director of Neighborhood Housing Services, reported that said audit is in progress and should be completed within two (2) weeks. He stated that the week of October 7, 1984 has been declared National Neighborhood Housing Services Week. Upon questioning by Councilperson Dowie, Mr. Reed reported that Neighborhood Housing Services sells a portion of their loans on the secondary mortgage market through Neighborhood Reinvestment. The average loan rate is 8 percent, with only one (1) loan written off for non-payment during the five (5) years the program has been in operation. Moved by Wright, seconded by Getty that communication from Director of Neighborhood Housing Services, Inc. transmitting the'reinvestment data for Neighborhood Housing Services program be received and placed on file. RESOLUTIONS TO BE ADOPTED 86167 - Moved by Getty, seconded by Dowie that communication from City Engineer transmitting agreement for repair and maintenance of municipal extensions of primary roads with the Iowa Department of Transportation together with recommendation for approval be received, placed on file, and "Resolution approving said document," be adopted and Mayor authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 1984-338. 86168 - Moved by Getty, seconded by Dowie that communication from City Engineer transmitting recommendation of acceptance for the FY 1985 Rooff Avenue Connection to U.S. Highway 20, Contract No. 269 from Peterson Contractors, Inc. be received, placed on file, and "Resolution approving said document," be adopted. Resolution adopted and upon approval by Mayor assigned No. 1984-339. 86169 - Moved by Getty, seconded by Dowie that communication from City Engineer transmitting recommendation of acceptance for the Intercity Interceptor, Stage I, FY 1983 Orange Grove Trunk Sewer, Contract No. 247 from Lametti and Sons, Inc. be received, placed on file, and "Resolution approving said document," be adopted. Harvey Jackson, 616 Rhey Street, spoke in support of the request. Moved by Getty, seconded by Dowie that "an Ordinance vacating portion of sixteen (16) feet alley located between Rhey Street and Linden Avenue and south of Independence Avenue," be received, placed on file, passed and considered for the third time. Ayes: Seeber, Dowie, Getty, and Penaluna. Nays: Wright. Absent: Klinger. Abstain: Lichty. Motion carried. 86173 - Moved by Dowie, seconded by Penaluna that "an Ordinance vacating portion of sixteen (16) feet alley located between Rhey street and Linden Avenue and south of Independence Avenue," be adopted.
