Mayor Bowers in the Chair. Roll call: Seeber, Dowie, Wright, Getty, Lichty, Penaluna, and Klinger. Invocation by: Getty. 85617 - Moved by Dowie, seconded by Wright that the Agenda, as proposed for the Regular Session of April 23, 1984, at 7:00 p.m., be accepted and approved. Motion carried. 85618 - Moved by Seeber, seconded by Klinger that the Minutes of the Regular Session held April 16, 1984 at 7:00 p.m., be approved. Motion carried. HEARINGS AND BIDS 85619 - Moved by Penaluna, seconded by Klinger that proof of publication of notice of public hearing for Special Assessment Bond Sale for Street Improvements for F.Y. 1984 Paving Program, Contract No. 250 in the amount of $115,000.00, as published in the Waterloo Courier on April 6 and 13, 1984, be received and placed on file. Motion carried. 85620 - Moved by Getty, seconded by Klinger that bids be received and filed but not opened. Motion carried. 85621 - The Mayor called for open bids and there were none. Moved by Getty, seconded by Dowie that open bidding be closed. Motion carried. 85622 - Moved by Klinger, seconded by Seeber to instruct Clerk/Auditor to open sealed bids, and refer all bids for checking: Bidder Net Interest Cost Net Interest Rate Dain Bosworth, Inc. $69,50-9-.T3— 10.9104% Motion carried. April 23, 1984 Page Two HEARINGS AND BIDS CONTINUED 85623 - The City Clerk/Auditor reported that the bid of Dain Bosworth Company was in order and recommended approval. Moved by Klinger, seconded by Wright that "Resolution directing sale of bonds to Dain Bosworth", be adopted and Clerk/Auditor instructed to notify the unsuccessful bidders. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-149. HEARINGS 85624 - Larry P. Burger, City Clerk/Auditor, reported that he recommended that Mr. Southworth's Pawnbrokers License not be revoked as originally recommended. Several of the original concerns had been addressed, namely, that the parking requirements could be met and that the Police Department has adequate means by which to monitor Mr. Southworth's business in the ordinances of the City. Moved by Dowie, seconded by Lichty that the Pawnbroker's License of Mr. Steven M. Southworth of 1202 Sycamore be stayed. Ayes: Seven. Motion carried. 85625 - Moved by Klinger, seconded by Getty that proof of publication of notice of public hearing to rededicate West 16th Street as published in the Waterloo Courier on April 16, 1984, be received and placed on file. Motion carried. HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. 85626 - Moved by Getty, seconded by Klinger that "Resolution approving rededication", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-150. ORAL PRESENTATIONS 85627 - Jeanette Smelser, 115 Norton Avenue, reported that the city sewer had backed up into her basement on Easter Day (April 22, 1984). She asked why residents had not been notified of what City Department should be called in such emergencies. Bruce Bottorff, Superintendent of Water Pollution Control Plant, reported that there had been a power failure due to the high winds and rain. Improvements to the Orange Grove Lift Station are being completed to address this problem. Ms. Smelser stated that the culvert near the intersection of West Third and Norton needs to be larger. It was moved by Dowie, seconded by Wright that the above remarks be received, placed on file, the culvert situation referred to the City Engineer and area residents informed of where to call in case of an emergency. April 23, 1984 Page Three PETITIONS FRCM PUBLIC 85628 - Moved by Lichty, seconded by Getty that request of First Federal Savings Bank to change direction of one-way traffic in alley between E. 4th Street and E. 5th Street from Mulberry Street to Franklin Street together with recommendation of City Engineer be received, placed on file, approved and City Attorney instructed to prepare an ordinance accordingly. Motion carried. UNFINISHED BUSINESS 85629 - Councilperson Lichty stated that problems still exist on Commercial due to the narrowness of the street. Moved by Klinger, seconded by Lichty that coummication from Sign and Traffic Department transmitting recommendation on one-way traffic situation on Commercial Street (see CR85582 of April 23, 1984), be received and placed on file. Motion carried. REPORTS 85630 - Moved by Dowie, seconded by Wright that report of City Engineer transmitting following streets and alleys which have been petitioned for inclusion in the F.Y. 1985 Oiling Program, Contract No. 267: Holstein Place from Charolais Drive to Angus Drive Knoll Avenue from Janney Avenue to University Avenue Muncy Avenue from Martin Road to Meadowbrook Lane be received, placed on file, and City Engineer instructed to proceed accordingly. Motion carried. 85631 - Moved by Seeber, seconded by Klinger that communication from Transportation Program Manager transmitting Hackett Road By -Pass Bikeway Preliminary Design and Feasibility Report together with recommendation that the City accept responsibility of operation and maintenance of proposed bikeway and banned all motorized vehicles, be received, placed on file and "Resolution approving Hackett Road By -Pass Bikeway Preliminary Design and Feasibility Report", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-151. 85632 - Moved by Klinger, seconded by Lichty that Comumity Development Board Minutes of Mare 6, 1984 be received and placed on file. DOCI]MENTS 85634 - Moved by Seeber, seconded by Klinger that Change Order No. 11 from Shapert Engineering to the City for the Sixth Street Bridge and Approaches, Contract No. 215 be received, placed on file, approved and Mayor and Clerk/Auditor authorized to execute same. Motion carried. 85635 - Moved by Getty, seconded by Penaluna that Final Plat of Minard's Plat 1, together with Engineer's Certificate of Survey Deed of Dedication, report of City Engineer, Planning, Programming and Zoning's Commission recommendation of approval be received, placed on file, and "Resolution approving said documents", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-153. 85636 - 14oved by Penaluna, seconded by Klinger that colmxmication from Transportation Program Manager transmitting 3 Intergovernmental Agreements (28E Agreements) with the City of Cedar Falls for design and location of street improvements on Black Hawk Road, Rainbow Drive, Huntington Road, as a part of Interstate Substitution Program, together with recommendation of approval bt> received, placed on file and "Resolution approving said agreements", be adopted and Mayor and Clerk/Auditor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-154. 85637 - Moved by Wright, seoonded by Dowie that communication unication from Transportation Program Manager transmitting utility agreement with Waterloo Water Works for East Park Avenue Interstate Substitution Project, together with recommendation of approval be received, placed on file, and "Resolution approving said agreement", be adopted and Mayor and Clerk/Auditor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-155. 85638 - Moved by Getty, seconded by Klinger that agreement with Joe Minard Construction, Inc., for abandonment of water main in Minard's Plat No. 1, together with City Attorney's recommendation of approval be received, placed on file, and "Resolution approving said agreement", be adopted and Mayor and Clerk/Auditor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-156. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-157. 85640 - Moved by Dowie, seconded by Penaluna that "Resolution abolishing positions of Milk Sanitarian and Lab Technician, Milk Lab", be adopted. ORDINANCES TO BE ADOPTED 85641 - Moved by Klinger, seconded by Penaluna Ordinance amending Ordinance 2479, known as the Zoning Ordinance by Repealing: Part XIX, Parking and Loading Areas, Public Garages, Perking Lots and Filling Stations, Section 2A-45, Off -Street Parking Required, Subsection B, General Requirements and enacting in lieu thereof: Part XIX, Parking and Loading Areas Public C,arages, Parking Lots and Filling Stations, Section 2A-45, Off -Street Parking Area Required, Subsection B, General Requirements", be received, placed on file, and passed for the third time. Motion carried. 85644 - Moved by Getty, seconded by Seeber that "Ordinance amending Chapter 34, Utilities, by Repealing Subsection (6) regarding Sewer Rental Charges of Section 34-43; and enactin in lieu thereof a New Subsection (6) regarding Sewer Rental Charges of Section 34-43", be adopted. Ayes: Six. Nays: Lichty. Ordinance adopted and upon approval by Mayor assigned No. 3336. 85645 - Moved by Wright, seconded by Klinger that "Ordinance amending Ordinance No. 2644, known as the Traffic Code, by repealing Subsection (7a) Beech Street of Section 543, thru Streets; and enacting in lieu thereof a new Subsection (7a) Beech Street to Section 543, thru Streets", be received, placed on file, passed and considered for the first time.
