The Council of the City of Waterloo, Iowa, met in Regular Session at
City Hall Council Chambers, Waterloo, Iowa at 7:00 p.m. on April
9, 1984. Mayor Bowers in the Chair. Roll call: Seeber, Dowie,
Wright, Getty, Lichty, Penaluna and Klinger.
Invocation by Wright
Mayor Bowers welcomed Confirmation Class from First Presbyterian
Church.
85554 - Moved by Getty, seconded by Dowie
that the Agenda, as amended for the Regular Session of April 9, 1984,
at 7:00 p.m., be accepted and approved.
Motion carried.
85555 - Moved by Klinger, seconded by Seeber
that the Minutes of the Regular Session held April 2, 1984 at
7:00 p.m., be approved.
Motion carried.
HEARINGS
85556 - Moved by Dowie, seconded by Getty
that proof of publication of notice of public hearing on Amendments
to Ordinance No. 2479, City Zoning Ordinance, relating to off-street
parking requirements as published in the Waterloo Courier on March
23, 1984, be received and placed on file.
Motion carried.
85557 - Don Temeyer, Planning„ Programming, and Zoning Commission Director,
reported that the amendment would require off-street parking
facilities to be in the same zoning classification or less
restrictive than the principle use.
HOLD HEARING --This being the time and place for public hearing the
Mayor called for written and oral objections and there were none.

that "An Ordinance amending Ordinance 2479, known as the Zoning
Ordinance by Repealing: Part XIX, Parking and Loading Areas, Public
Garages, Parking Lots and Filling Stations, Section 2A-45, Off -Street
Parking Area Required, Subsection B, General Requirements and
enacting in lieu thereof: Part XIX, Parking and Loading Areas,
Public Garages, Parking Lots and Filling Stations, Section 2A-45,
Off -Street Parking Area Required, Subsection B, General
Requirements", be received, placed on file, passed and considered
for the first time. Ayes: Seven.

ORAL PRESENTATIONS
85558 - Matt Hobson, former employee of the City Health & Sanitation
Department, expressed his concern for closing the Milk Sanitation
Lab. As a former health inspector, he stated that he often used the
services of the Milk Lab for testing of water samples, etc. He
questioned what this type of testing would cost the City at an
alternate site.
Mayor Bowers reported that he would be happy to discuss the matter in
detail by calling his office for an appointment.
Moved by Seeber, seconded by Wright
that the above remarks be received and placed on file.

REPORTS
85559 - Bev Lind, Director of the Waterloo Public Library, encouraged members
to attend any of the scheduled events during National Library Week.
Moved by Wright, seconded by Lichty
that communication from Waterloo Public Library transmitting
notification of National Library Week as April 8-14, 1984 be received
and placed on file.
Motion carried.
85560 - Councilperson Wright suggested that she meet with the Sign and
Traffic Department and area residents to further discuss the matter.
Moved by Wright, seconded by Penaluna
that communication from Sign & Traffic Department transmitting
recommendation on Stop Sign at Beech and Oneida Streets be received,
placed on file, and action delayed one (1) week.

that City Auditor's Report for March, 1984, be received and placed on
file.

85562 - Moved by Wright, seconded by Penaluna
that communication from Community Development Administrator
transmitting Supplemental Contract No. 4 with Brice, Petrides &
Associates for East Side Parking Ramp Facility, Contract No. 251,
together with recommendation of approval be received, placed on file
and "Resolution approving said agreement", be adopted and Mayor and
Clerk/Auditor authorized to execute same. Ayes: Seven.

85563 - Moved by Dowie, seconded by Seeber
that "Resolution approving and accepting a Quit Claim Deed from Cyrus
H. Casebeer, single, for road right-of-way purposes for a part of
Lots 13, 14, and 15 of Hummel Addition to the City of Waterloo,
Iowa", be adopted. Ayes: Seven.
Resolution adopted and upon approval by Mayor assigned No. 1984-127.
85564 - Hugh Field, attorney, asked that the Council act hastily on this
resolution, due to impending state and federal legislation changes,
as well as to indicate the City's intent to issue bonds prior to
making an offer for the potential site of the track.
Moved by Penaluna, seconded by Wright
that 'Resolution authorizing execution of Memorandum of Agreement
with National Cattle Congress for issuance of Industrial Development
Revenue Bonds --not to exceed $10,000,000.00", be adopted. Ayes:
Six. Nays: Lichty.

that "an Ordinance vacating a portion of Alexandra Circle", be
received, filed, considered and passed for the second time. Ayes:
Six. Nays: Lichty.

85566 - Jerry Martin, attorney for Floyd Brinker and John Rollins, reported
that he had met with the Planning Office and Fred Debe, developer of
the property to the south. His clients still desire to purchase the
portion of Ridgeway Avenue adjacent to their property.
Fred Debe reported that his client's position had remained unchanged
(see minutes of April 2, 1984, CR85531).
Craig Brinker, son of one (1) of the adjacent property owners asked
that they be allowed to purchase the property adjacent to their
property.
Moved by Getty, seconded by Seeber
that "an Ordinance vacating portion of Ridgeway Avenue generally
located between LaPorte Road and relocated Highway 218", be received,
filed, passed and considered for the second time. Ayes: Seeber,
Dowie, Getty and Penaluna. Nays: Wright, Lichty and Klinger.
Motion carried.
