Mayor Bowers in the Chair. Roll call: Getty, Lichty, Penaluna, Klinger, Dowie, Wright, Seeber. Invocation by Getty. 85348 - Moved by Penaluna, seconded by Klinger that the Agenda, as proposed for the Regular Session of February 20, 1984 at 7:00 p.m., be accepted and approved. Motion carried. 85349 - Moved by Seeber, seconded by Wright that the Minutes of the Regular Session held February 13, 1984 at 7:00 p.m., be approved. Motion carried. ORAL PRESENTATIONS 85350 - Council person Klinger presented a petition from Sharon Walker, 428 Progress Avenue requesting a solution to the excessive traffic problem on Progress Avenue. Moved by Klinger, seconded by Seeber that the above petition be received, placed on file, and referred to Sign and Traffic, Police Department and Planning, Programming and Zoning Commission for report back on March 5, 1984. Motion carried. .140.0 85351 - Moved by Wright, seconded by Klinger that Community Development Board Minutes of January 10, 1984 be received and placed on file. Motion carried. 85352 - Councilman Penaluna, Chairman of the Reorganization Committee, presented a plan for the combination of the Building Department, Planning/Programming/Zoning Commission, Community Development and City Engineer, under a Planning & Development Director. The plan would not increase employment, but through attrition and selective replacement, reduce employment within the departments. Said plan would increase efficiency and create better communication with the public. `loved by Klinger, seconded by Penaluna that communication from the Reorganization Committee transmitting recommendation of the combination of the Building, Planning/ Programming/Zoning Commission, Community Development and Engineering Departments be received, placed on file and action deferred until March 5, 1984. February 20, 1984 REPORTS CONTINUED 85353 - Moved by Getty, seconded by Dowie Page Two that communication from City Engineer transmitting recommendation on termination of the FY 1984 Street Drainage Program, Contract No. 260, with Lehman Trucking and Excavating, Inc., releasing the executor from said obligation together with recommendation to combine said program with the future street reconstruction program be received, placed on file and approved. Motion carried. 85354 - Moved by Penaluna, seconded by Klinger that communication from City Engineer's Department transmi+-*-ing information relating to the construction of a public boat ramp for access to the Cedar River between Sixth Street and Evansdale together with recommendation to apply to the State of Iowa Conservation Commission for assistance for said project from the Marine Fuel Tax Fund be received, placed on file, approved, and authorization given to proceed with application. Motion carried. 85355 - Moved by Klinger, seconded by Wright that communication from Planning, Programming, and Zoning Commission transmitting list of expenditures that qualify for reimbursement from the Tax Increment Financing District pursuant to Iowa Code Section 403.19 be received, placed on file and action deferred one (1) week. Motion carried. 85356 - Moved by Penaluna, seconded by Klinger that communication from Planning, Programming, and Zoning Commission transmitting recommendation for levy of taxes in the amount of $1.50 per thousand dollars of taxable value for that property located in the Self -Supported Municipal Improvement District (SSMID) and as authorized by Ordinance No. 3279 be received, placed an file, approved, and "Resolution authorizing the County Auditor to levy said tax against those property owners in the SSMID for FY 1985", be adopted. Ayes: Six. Abstention: Lichty. Resolution adopted and upon approval by Mayor assigned No. 1984-62. RESOLUTIONS TO BE ADOPTED 85357 - Moved by Klinger, seconded by Lichty that "Resolution directing the publication of a notice of intention to issue not to exceed $1,000,000 aggregate principal amount of Industrial Development Revenue Bonds (Pepsi-Cola Bottling Company, Inc., of Waterloo, Iowa, Project) of the City of Waterloo, Iowa, and calling a public hearing on the proposal to issue said bonds and authorizing execution of a memorandum of agreement and setting date of hearing as March 12, 1984 at 7:00 p.m. in the City Hall Council Chambers", be adopted and Clerk/Auditor instructed to publish notice accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-63. Resolution adopted and upon approval by Mayor assigned No. 1984-64. 85359 - Moved by Getty, seconded by Seeber that "Resolution authorizing the execution of Memorandum of Agreement with Miller Medical Service, Inc., for the issuance of Industrial Revenue Bonds Series 1984", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-65. 85360 - Moved by Getty, seconded by Seeber that "Resolution fixing date for hearing on proposed Industrial Development Bonds Series 1984, for Miller Medical Service, Inc., in an amount not to exceed $800,000.00 as March 12, 1984 at 7:00 p.m. in the City Hall Council Chambers", be adopted and Clerk/Auditor instructed to publish notice of hearing accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-66. ORDINANCES TO BE ADOPTED 85361 - that "an Ordinance vacating sixteen (16) foot utility easement in Lot 155, Granger's Second Addition", be received, placed on file, passed and considered for the third time. Ayes: Seven. Motion carried. 85362 - Moved by Getty, seconded by Dowie that "an Ordinance vacating sixteen (16) foot utility easement in Lot 155, Granger's Second Addition", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 3326. 85363 - Moved by Getty, seconded by Dowie that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that below ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Six. Nayes: Lichty. (See CR 85364 below) Motion carried. 85364 - Moved by Getty, seconded by Seeber that "an Ordinance amending Ordinance No. 2479, as amended, Zoning Ordinance by adding Sub -section No. 209 to Section 2A-7, Rezoning Certain Property", be adopted. Ayes: Six. Nayes: Lichty. ("A-1"Agricultural District to "M-1" Light Industrial District --property bounded by Texas Street, E. Shaulis Road, relocated Highway 218 and I 380/520 Interchange). Ordinance adopted and upon approval by Mayor assigned No. 3327. (See CR 85366 below) Motion carried. 85366 - Moved by Klinger, seconded by Seeber that "an Ordinance amending Ordinance No. 2479, as amended, Zoning Ordinance by adding Sub--ection No. 210 to Section 2A-7, "Rezoning Certain Property", be adopted. Ayes: Seven. ("R-2" One and Two Family Residence District to "C-2" Commercial District --located east of Hammond Avenue and south of A.E. Mayner Court) Ordinance adopted and upon approval by Mayor assigned No. 3328. 85367 - Moved by Seeber, seconded by Dowie that an 'Ordinance amending the Code of the Ordinances of the City of Waterloo, Iowa, by repealing Sub--ections (a) (4) and (a) (5) of Section 34-42, connection charges, of Article III, Sewers, of Chapter 34, Utilities, and enacting in lieu thereof new Sub -sections (a) (4), (a) (5) and (a) (6) to Section 34-42, connection charges, of Article III, Sewers, of Chapter 34, Utilities", be received, filed, considered and passed for the first time. Ayes: Seven. Motion carried. NEW BUSINESS 85368 - Moved by Seeber, seconded by Wright that communication from Police Chief transmitting list of officers authorized to receive $150.00 each for clothing allowance for second half of FY 1984 be received, placed on file, approved, and "Resolution instructing said payments", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1984-67. 85369 - Moved by Getty, seconded by Lichty that communication from Superintendent of Water Pollution Control Plant transmitting recommendation on appointment of Howard Schmitz to position of Operator Trainee be received, placed on file, and approved. Motion carried. 85370 - Moved by Getty, seconded by Lichty that the following requests for permission to attend functions with expenses not to exceed amounts shown, be received, placed on file and approved: Attend Functions Police Officers to attend Colorado Springs Police Department Crime Analysis Unit, Colorado Springs, Colorado, March 5-8, 1984, plus use of City vehicle cost not to exceed $750.00. Division Chief to attend Spring Conference of Iowa Association of Professional Fire Chiefs, Ames, Iowa, February 22-23, 1984, plus use of City ve icle cost not to exceed $100.00. Six (6) Fire Department Personnel to attend Building Construction for Fire Suppression Forces Noncombyls}ible and Fire -Resistive Course Increasing Personal Effectiveness and Structural Fire Scene Evaluation Courses, Ames, Iowa, March 3-4, 1984, plus use of City vehicle cost not to exceed $350.00. White, 526 Independence Avenue, be approved and that Massage Technician Permit Application of Sondra Height, 1118 Williston be denied, based on the Police Chief's recommendation of denial due to non-compliance with required hours of training. Motion carried. 85374 - Moved by Getty, seconded by Klinger that the Waterloo Police Department be commended for their work and effort during President Ronald Reagan's visit to Waterloo on February 20, 1984.
