Mayor Pro -Tem Frank Dowie in the chair. Roll call: Wright, Dowie, Getty, Lichty, Penaluna, Klinger. Absent: Seeber. Invocation by Wright. 85278 - Moved by Getty, seconded by Klinger that the Agenda, as amended for the Regular Session of February 6, 1984 at 7:00 p.m., be accepted and approved. Motion carried. 85279 - Moved by Klinger, seconded by Lichty that the Minutes of the Regular Session held January 23, 1984 at 7:00 p.m., be approved. Motion carried. HEARINGS 85280 - Moved by Penaluna; seconded by Getty that proof of publication of notice of public hearing on vacation of sixteen (16) foot utility easement in Lot No. 155, Granger's Second Addition, as published in the Waterloo Courier on January 20, 1984 be received and placed on file. Motion carried. 85281 - HOLD HEARING --This being the time and place of hearing the Mayor Pro -Tem called for written and oral objections and there were none. Moved by Getty, seconded by Lichty that "an Ordinance vacating sixteen (16) foot utility easement in Lot 155, Granger's Second Addition", be received, placed on file, passed and considered for the first time. -:Ayes: Six. Motion carried. 85285 - Moved by Klinger, seconded,by Wright that communication from City Engineer transmitting Change Order No. 7 from Cardinal Construction Company for the F.Y. 1983 Conway Vicinity Parking Ramp, Contract No. 241 for decrease in contract amount of $3,038.00, together with recommendation of approval, be received, placed on file, approved and Mayor Pro -Tem and Clerk/Auditor authorized to execute same. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1984-45. 85291 - Moved by Klinger, seconded by Penaluna that communication from Transportation Program Manager transmitting four (4) agreements with Brice, Petrides and Associates, Inc., to evaluate the following Interstate Substitution Projects: Donald Street (IX 6662(1)--79-07); San Marnan Drive (IX 6498(1)--79-07); Ansborough Avenue (IX 6615(1)--79-07); 5th and 6th Street (IX 6653(2)--79-07), together with recommendation of approval be received, placed on file, and "Resolution approving said documents", be adopted and Mayor Pro -Tem and Clerk/Auditor authorized to execute same. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1984-46. 85292 - Moved by Getty, seconded by Lichty that communication from City Engineer transmitting recommendation on last day for receipt of oiling petitions as March 30, 1984 for the F. Y. 1985 Oiling Program, Contract No. 267 be received, placed on file, and approved. Motion carried. February 6, 1984 RESOLUTIONS TO BE ADOPTED 85293 - Moved by Wright, seconded by Klinger Page Four that "Resolution authorizing City of Waterloo to take various types of action to assure against handicapped discrimination", be adopted. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1984-47. 85294 - Moved by Klinger, seconded by Penaluna that "Resolution of the City Council of the City of Waterloo, Iowa preserving the integrity of the Road Use Tax Fund", be adopted. Ayes: Six. Absent: Seeber. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1984-48. 85295 - Moved by Getty, seconded by Wright that "Resolution consenting to an agreement to be entered into between Black Hawk County, Iowa, and the Black Hawk County Solid Waste Management Commission for the ownership and operation of an sanitary disposal site, and agreeing to be bound by the terms of the agreement and the 28E Intergovernmental Agreement until certain general obligation bonds which may be issued by Black Hawk County have been repaid out of fees from the sanitary disposal site", be delayed one (1) week. Prior to a vote on this motion, the mover and seconder withdrew the motion. Bob Braun, representing the Black Hawk County Solid Waste Commission, explained that the Agreement would obligate the City of Waterloo to use the landfill through charging a tipping fee rather than an assessment to be used for the retirement of proposed issuance of General Obligation Bonds. 85296 - Moved by Getty, seconded by Wright that "Resolution consenting to an agreement to be entered into between Black Hawk County, Iowa, and the Black Hawk County Solid Waste Management Commission for the ownership and operation of a sanitary disposal site, and agreeing to be bound by the terms of the agreement and the 28E Intergovernmental Agreement until certain general obligation bonds which may be issued by Black Hawk County have been repaid out of fees from the sanitary disposal site", be adopted. Motion carried. 85300 - Moved by Penaluna, seconded by Getty that an "Ordinance amending Ordinance No. 2644, known as the Traffic Code, by repealing Section 322, Monthly Parking, Subsection (d) of Section 329, and Section 343, Parking Rates for cash patrons, all relating to Parking Fees and Fines; and by enacting in lieu thereof new Section322, Fees for monthly ramp and lot parking, Subsection (d) of Section 329 and Section 343, Parking Rates for cash patrons; and by adding Section 310, Daily Lot Fee", be received, placed on file, considered and passed for the third time. Motion carried. 85306 - Moved by Klinger, seconded by Penaluna that "Resolution adopting and levying final schedule of assessments, and providing for the payment thereof for the F.Y. 1984 Oiling Program, Contract No. 249", be adopted.
