Mayor Rooff in the Chair. Roll call: Wilharm, Penaluna, Getty, Bowers, Burton, and Dowi.e. Absent. Roehr. Invocation by: Bowers 85101 - Moved by Dowie, seconded by Burton that the Agenda, as amended for the Regular Session of December 19, 1983 at 7:00 p.m., be accepted and approved. Motion carried. 85102 - Moved by Burton, seconded by Bowlers that the Minutes of the Regular Session held December 12, 1983 at 7:00 p.m., be approved. Motion carried. HEARINGS AND BIDS 85103 - Moved by Penaluna, seconded by Getty that proof of publication of notice of public hearing for Special Assessment Bond sale for street and sewer improvements for FY 1983 Paving Program, Contract No. 234 and FY 1983 Lowder Road Sanitary Sewer, Contract No. 180 in the amount of $134,000, as published in the Waterloo Courier on December 2, 1983 be received and placed on file. Motion carried. 85104 - Moved by Getty, seconded by Penaluna that bids be received and filed but not opened. Motion carried. 85105 Moved by Wilhann, seconded by Getty to instruct Clerk/Auditor to open sealed bids, and refer all bids for checking: Bidder 105,000 Street Bonds Dane Bosworth Shaw, McDermott $29,000 Sewer Bonds Dane Bosworth Shaw, McDermott Net Interest Cost Net Interest Rate $56,472.92 10.4257% $64,308.25 10.8767% $16,863.98 10.4367% $18,708.33 11.5781% Motion carried. (see CR85109 for further action) HEARING 85106 - Moved by Bowers, seconded by Burton that proof of publication of notice of public hearing renaming a portion of LaPorte Road to Texas Street as published in the Waterloo Courier on December 2, 1983 be received and placed on .file. Motion carried. 85107 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Getty, seconded by Bowers that "an Ordinance renaming a portion of LaPorte Road to Texas Street", be received, filed, considered, and passed for the first time. Ayes: Six. Absent: Roehr. Motion carried. December 19, 1983 ORAL PRESENTATIONS Page Two 85108 - Councilman Wilharm stated that since this is his last Council meeting that he will be in atttendance, he thanked all City employees and Council persons and wished the new council persons the best. 85109 - Moved by Getty, seconded by Dowie that "Resolution directing sale of bonds to Dain Bosworth as read", be adopted. Ayes: Six. Absent: Roehr. (see CR85105 above) Resolution adopted and upon approval by Mayor assigned No. 1983-619. 85110 - Moved by Getty, seconded by Wilharm to instruct Clerk/Auditor to return checks of unsuccessful bidder. Motion carried. PETITIONS FRCM PUBLIC 85111 - Moved by Getty, seconded by Wilharm that communication from Planning, Programing and Zoning Commission transmitting request of Flinn, Saito, Anderson on behalf of Young Women's Christian Association to vacate, sell and convey a portion of Lafayette Street near the intersection of East Park and Lafayette Street for purposes of construction of enclosed entrance and handicap elevator together with recommendation of approval be received, placed on file, and "Resolution setting date of hearing on January 9, 1984, at 7:00 p.m. in the City Hall Council Chambers on above described request", be adopted and City Clerk/Auditor instructed to publish notice accordingly. Resolution adopted and upon approval by Mayor assigned No. 1983-620. 85112 - Moved by Burton, seconded by Bowers that communication frau Planning, Programing and Zoning Commission transmitting request of Peoples Bank and Trust located at 419 West Fourth Street for tax abatement on improvements at said location at rate of 100% exemption for three (3) years on actual value added by improvements, together with recommendation of approval, be received, placed on file, and "Resolution approving said exemption", be adopted and Clerk/Auditor instructed to notify City Assessor accordingly. Ayes: Six. Absent: Roehr. Resolution adopted and upon approval by Mayor assigned No. 1983-621. REPORTS 85113 - Moved by Dowie, seconded by Burton that communication from Police and Fire Pension Board transmitting Police and Fire Pension Board's Actuarial Valuation Report prepared by Towers, Peerin, Forster and Crosby together with recommendation of approval be received, placed on file, and "Resolution approving said report", be adopted and City Clerk/Auditor instructed to transmit said report to the State Commissioner of Insurance. Resolution adopted and upon approval by Mayor assigned No. 1983-622 December 19, 1983 REPORTS CONTINUED 85114 - Moved by Wilharm, seconded by Bowers Page Three that Indemnity Agreement between the City of Waterloo and Hank Sealman dated December 19, 1983 in conjunction with the removal of personal property located 3105 Easton Avenue purchased by the City of Waterloo from Mrs. H. R. Shupe be received, placed on file, approved and "Resolution approving said document", be adopted. Ayes: Six. Absent: Roehr. Resolution adopted and upon approval by Mayor assigned No. 1983-623. 85115 - Moved by Bowers, seconded by Wilharm that communication from Flinn, Saito, Anderson and Gilmor and Doyle, Ltd. transmitting proposed scope of services for energy audit for City Hall be received, placed on file, and deferred for one (1) week. Motion carried. 85116 - Moved by Getty, seconded by Bowers that communication from Planning, Programming and Zoning Commission transmitting agreement with Thorson, Brom, Broshar, and Snyder Architects for documentation development for city/county joint law enforcement center be received, placed on file, and "Resolution approving said document", be adopted and Mayor and City Clerk/Auditor authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 1983-624. 85117 - Moved by Burton, seconded by Bowers that communication from Planning, Programming and Zoning Commission transmitting Preliminary Plat of Timothy Ridge Second Addition, together with contract, petition, certificate of survey, report of City Engineer, and resolution of approval be received, placed on file, and "Resolution approving said documents", be adopted. RESOLUTIONS TO BE ADOPTED 85118 - Moved by Wilharm, seconded by Burton that "Resolution of City of Waterloo endorsing and approving funding for an Industrial Pretreatment Program", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1983-626. 85119 - Moved by Bowers, seconded by Penaluna that "Resolution accepting and approving certain offers to sell real property to the City and accepting and approving certain deeds frau James and Elsie McElmeel in conjunction with the Blowers Creek Flood Control Project", be adopted. December 19, 1983 Page Four RESOLUTIONS TO BE ADOPTED CONTINUED 85120 - Moved by Penaluna, seconded by Wilharm that "Resolution authorizing the issuance and sale of Industrial Development Revenue Bonds, Series 1983 in an amount not to exceed $2,000,000 for Chamberlain Manufacturing Corporation Project", be adopted. Ayes: Six. Absent: Roehr. Resolution adopted and upon approval by Mayor assigned No. 1983-628. ORDINANCES TO BE ADOPTED 85121 - Moved by Burton, seconded by Getty that "An Ordinance amending Ordinance No. 2644, known as the Traffic Code, by repealing Subsection (120) Heath Street of Section 551, parking prohibited at all times on certain streets, and by enacti% in lieu thereof new Subsection (120) Heath Street to Section 551, parking prohibited at all times on certain streets; and byadding Subsection (9c) Donald Street (W) to Section 553, No Parking Here to Corner", be received, filed, considered and passed for the first time. Ayes: Six. Absent: Roehr. Motion carried. 85122 - Moved by Burton, seconded by Dowie that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that below ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Rooff transmitting recommendation on reappointment of Donald Cobb and Tom Fereday, Jr., to the Heating Board with term expiration of December 31, 1985, be received and placed on file.
