Mayor Rooff in the Chair. Roll call: Getty, Penaluna, Wilharm, Roehr, Dowie, Burton, Bowers. Invocation by Wilharm. 85072 - Moved by Roehr, seconded by Dowie that the Agenda, as amended for the Regular Session of December 12, 1983 at 7:00 p.m., be accepted and approved. Motion carried. 85073 - Moved by Burton, seconded by Bowers that the Minutes of the Regular Session held December 5, 1983 at 7:00 p.m., be approved. Motion carried. HEARINGS 85074 - Moved by Roehr, seconded by Burton that proof of publication of notice of public hearing for Elliott "R-3, R -P" Planned Residence District located northeasterly of US Highway 218 and South of E. Shaulis Road, as published in the Waterloo Courier on November 25, 1983, be received and placed on file. Motion carried. 85075 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Burton, seconded by Dowie that "Resolution approving said site plan amendment", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-609. 85076 - Moved by Bowers, seconded by Penaluna that proof of publication of notice of public hearing on rededication of "Relocated" Memorial Court and naming of said property as "Cedar Street" as published in the Waterloo Courier on November 25, 1983 be received and placed on file. Motion carried. 85077 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Dowie, seconded by Burton that "Resolution approving said rededication", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-610. December 12, 1983 Page -Two HEARINGS CONTINUED 85078 - Moved by Wilharm, seconded by Roehr that "An Ordinance naming a portion of "relocated" Memorial Court generally bounded by West Fifth Street, the West Side Parking Ramp, West Fourth Street, and the Cedar River as "Cedar Street" be received, placed on file, passed, and considered for the first time. Ayes: Seven. Motion carried. 85079 - Moved by Roehr, seconded by Wilharm that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that below ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Seven, Motion carried. 85080 - Moved by Burton, seconded by Bowers that "An Ordinance naming a portion of "relocated" Memorial Court generally bounded by West Fifth Street, the West Side Parking Ramp, West Fourth Street, and the Cedar River as "Cedar Street"," be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 3317. 85081 - Moved by Wilharm, seconded by Dowie that proof of publication of notice of public hearing on special permit request of Waterloo Waterslide, Inc., for construction of recreational waterslide facility generally located at southwest corner of intersection of North Evans Road and Osage Road as published in the Waterloo Courier on November 25, 1983, be received and placed on file. Motion carried. 85082 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Roehr, seconded by Bowers that "Resolution approving said special permit request," be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-611. ORAL PRESENTATIONS Mayor - Leo P. Rooff introduced and welcomed Carl Anderson who had also tried out for a part in the Walt Disney movie "Country", currently being filmed northeast of Waterloo UNFINISHED BUSINESS 85083 - Moved by Burton, seconded by Wilharm that communication from Sign and Traffic Department transmitting reccmumendation on installation of "No Parking Here to Corner" sign near the intersection of West Donald and Heath Streets referred to under CR85063 of December 5, 1983, be received, placed on file, approved, and referred to the City Attorney's Office for submission of an Ordinance accordingly. Motion carried. 85085 - Moved by Roehr, seconded by Dowie that Community Development Board Minutes of November 7, 1983 be received and placed on file. Motion carried. 85086 - Councilman Bowers outlined the written report and stated that several committee members did not feel the need for reopening Fire Station No. 2. Moved by Bowers, seconded by Dowie that communication from Fire Review Committee transmitting recommendations on fire protection for the City of Waterloo be received and placed on file. Motion carried. 85087 - Mayor Rooff thanked the Committee for their assistance. Holly Borland reported that the Committee's recommendation was based on "pooling" of expert advise and information. Moved by Bowers, seconded by Dowie that Fire Station No. 2 located at the intersection of Byron and Randolph be appraised, offer said property for sale to the public for residential use, with sale of funds to be placed in a trust until such time as the interstate system is completed and a determination has been made for future fire station needs. Ayes: Five. Nayes: Wilharm and Roehr Motion carried. 85088 - Moved by Roehr, seconded by Dowie that communication from Planning, Programming, and Zoning Commission transmitting request of Mary Mangum to rezone frau "R-2" One and Two Family Residence District to "C -Z" Conditional Zoning property known as Lot 6, Blk. 12, Logan Dale Heights, for purposes of correction of legal notice together with recommendation of approval be received, placed on file, and "Resolution setting date of hearing as January 3, 1984, at 7:00 p.m. in the City Hall Council Chambers on above. described request," be adopted and City Clerk/Auditor instructed to publish notice of hearing accordingly. Ayes: Seven: Resolution adopted and upon approval by Mayor assigned No. 1983-612. 85089'- Moved,by Dowie, seconded by Burton that "Resolution authorizing the issuance of $460,000 in aggregate principal amount of the City of Waterloo, Iowa, Industrial Development, Revenue Bonds (Omega Cabinets, Ltd. Project) Series 1983," be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-613. December 12, 1983 Page Four 85090 - Moved by Bowers, seconded by Burton that communication from City Engineer transmitting recommendation of acceptance on FY1984 Paving Program, Contract No. 250 from Cedar - Valley Corporation be received, placed on file, approved and "Resolution approving said document," be adopted. Resolution adopted and upon approval by Mayor assigned No. 1983-614. 85091' - Moved by Wilharm, seconded by Roehr that communication from City Engineer transmitting Change Order No. 1 frau Rohlin Construction Company, Inc., for an increase in contract of $172.50 in conjunction with the FY1984 Maywood Area Paving Program, Contract No. 256, together with recommendation of approval be received, placed on file, approved and Mayor and Clerk/Auditor authorized to execute same. ' 85092 - Moved by Wiharm, seconded by Roehr that communication from City Engineer transmitting Change Order No. 6 from Cardinal Construction Company for an increase in contract of $1,808.00 in conjunction with the FY1983 Conway Vicinity Parking Ramp, Contract No. 241, together with recommendation of approval be received, placed on file, approved and Mayor and City Clerk/Auditor authorized to execute same. Motion carried. 85093 - Moved by Penaluna, seconded by Roehr that Clerk/Auditor be instructed to publish notice in the Waterloo Courier regarding the Iowa Department of Water, Air, and Waste Management National Pollutant Discharge Elimination System notice/fact sheet regarding discharge of the Cedar River in Section 31, T89N, R12W be received, placed on file and approved.
