Mayor Rooff in the Chair. Roll Call: Wilharm, Roehr, Penaluna, Getty, Bowers, Burton, Dowie. Invocation by Bowers. 84757 - Moved by Dowie, seconded by Burton that the Agenda, as amended for the Regular Session of October 3, 1983, at 7:00 p.m., be accepted and approved. Motion carried. 84758 - Moved by Wilharm, seconded by Roehr that the Minutes of the Regular Session held September 26, 1983 at 7:00 p.m., be approved. Motion carried. HEARINGS AND BIDS 84759 - Moved by Roehr, seconded by Dowie that proof of publication of notice of public hearing on plans, specifications, etc., and taking of bids for the F.Y. 1984 Lafayette Street Sanitary Sewer Extension, Contract No. 259, as published in the Waterloo Courier on September 23, 1983 be received and placed on file. Motion carried. 84760 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Wilharm, seconded by Burton that "Resolution confirming the approval of plans, specifications, etc", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-489. 84761 - Moved by Burton, seconded by Bowers that "Resolution ordering construction", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-490. 84762 - Moved by Dowie, seconded by Wilharm to receive, file, and instruct Deputy Clerk/Auditor to open and read bids for the F.Y. 1984 Lafayette Street Sanitary Sewer Extension, Contract No. 259 and refer to City Engineer for review and recommendation (see CR84767 for award of contract): Bidder Bid Bond Amount Lehman Trucking & Excavating, Inc. 5% $38,860.90 Motion carried. Resolution adopted and upon approval by Mayor assigned No. 1983-491. 84765 - Moved by Roehr, seconded by Wilharm that "Resolution ordering construction", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-492. 84766 - Moved by Wilharm, seconded by Roehr to receive, file, and instruct Deputy Clerk/Auditor to open and read bids for the F.Y. 1984 Street Drainage Program, Contract No. 260 and refer to City Engineer for review and recommendation (see CR84786 for further action): Bidder Lehman Trucking & Excavating Inc., Co. Peterson Const., Inc. Rampart Corp. Motion carried. Bid Bond Amount 5% $164,509.05 5% $178,116.40 5% .$244,131.56 84767 - The City Engineer recommended that the bid of Lehman Trucking and Excavating Inc., in the amount of $38,860.90 for the F. Y. 1984 Lafayette Street Sanitary Sewer Extention, Contract No. 259 be approved. Moved by Wilharm, seconded by Roehr that the above remarks be received, placed on file, approved and "Resolution approving award of said contract as recommended above", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-493. HEARINGS 84768 - Moved by Dowie, seconded by Bowers that the public hearing on the repeal of portions of Waterloo Advertising and Sign Ordinance (Ord. No. 2447) be delayed until such time as the Ad-hoc Committee reviewing the ordinance makes a recommendation to the Council. Prior to a vote on this matter, Assistant City Attorney Donna Leseyshen reported that the proof of publication of notice of hearing and hearing must proceed. Should the Council wish to adjourn the hearing, they may do so after the action stated above is taken. Moved by Roehr, seconded by Dowie that the motion as stated above be withdrawn. Ayes: Seven. October 3, 1983 HEARINGS CONTINUED 84769 - Moved by Getty, seconded by Dowie Page Three that proof of publication of notice of public hearing on repealing of portions of Waterloo Advertising and Sign Ordinance (Ordinance No. 2447) as published in the Waterloo Courier on September 16, 1983 be received and placed on file. 6 Motion carried. 84770 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Getty, seconded by Roehr to adjourn hearing on the repeal of portions of Waterloo Advertising and Sign Ordinance (Ordinance No. 2447), indefinitely. Motion carried. ORAL PRESENTATIONS 84771 - Wendel Campbell of the Waterloo School Transportation Department reported that October 3-10, 1983 has been designated National School Bus Safety Week and asked the Council's help in its promotion. He also distributed lapel buttons. .Moved by Wilharm, seconded by Bowers .hat the above remarks be received and placed on file. Motion carried. Councilman Bowers inquired about the status of the school signal at the intersection of Idaho and Independence Avenues (see CR84685 of September 19, 1983). 4ayor Rooff reported that an order has been placed for a full traffic signal, with delivery in 30-45 days. The State of Iowa has required a complete signal, rather than only school signal. UNFINISHED BUSINESS . - Moved by Burton, seconded by Wilharm that communication from Mayor Leo P. Rooff transmitting report on Waterloo Fireman Benefit Dance at West High School be received and placed on file. (see CR84731 of September 26, 1983) Motion carried. 84773 - Moved by Wilharm, seconded by Getty that communication from Fire Chief transmitting list of persons to the position of civilian dispatcher (see CR84749 of September 26, 1983) be received and placed on file. Motion carried. October 3, 1983 REPORTS Page Four 84774 - Councilman Roehr concurred in the Mayor's recommendation to set the Mayor's annual salary at $33,500, but suggested that the Councilmen's salary be reduced to $3,350 from the Mayor's recommended figure of $3,510.00 per year, for the reason that the cost of living has slowed down. Councilman Getty stated his opposition to lowering the Councilmen's annual salary. Moved by Roehr, seconded by Wilharm to instruct the City Attorney to submit an ordinance establishing the Mayor's annual salary at $33,500.00 and the Councilmen's annual salary at $3,350.00. Ayes: Wilharm and Roehr. Nayes: Five. Motion not carried. 84775 - Moved by Getty, seconded by Burton to instruct the City Attorney to submit an ordinance establishing the Mayor's annual salary at $33,500.00 and the Councilmen's annual salary at $3,510.00. Ayes: Five. Nayes: Roehr and Dowie. Motion carried. 84776 - Moved by Roehr, seconded by Wilharm that the F.Y. 1983 Annual Report of the Waterloo Public Library be received and placed on file. Motion carried. DOCUMENTS 84777 - Don Temeyer, Planning, Programming and Zoning Director, reported that possible tenants have been solicited to occupy the renovated facility. Moved by Burton, seconded by Bowers that communication from Planning, Programming and Zoning Director transmitting the application for the Iowa Community Cultural Grants Program for $75,000.00 to defray the expense of renovating the former East Side Carnegie Library with the remaining $151,000 being funded through the issuance of the General Obligation Bonds be received, placed on file and "Resolution authorizing submittal of said grant", be adopted. Ayes: :;even. Resolution adopted and upon approval by Mayor assigned No. 1983-494. 84778 - Moved by Roehr, seconded by Burton that communication from Transportation Program Manager transmitting four agreements foo Consultant Engineering Services with Brice, Petrides, and Ass6 gates, Inc., including Planning, Design and Preparation of play-: , specifications, estimates and construction engineering for vatiious road projects, together with recommendation of approval be received, placed on file, and "Resolution approving said documents", be adopted and Mayor and Deputy Clerk/Auditor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-495. '1 -AN October 3, 1983 RESOLUTIONS TO BE ADOPTED 84779 - Moved by Wilharm, seconded by Dowie Page Five that "Resolution setting date of hearing as October 24, 1983 at 7:00 p.m. in the City Hall Council Chambers on the issuance of not to exceed $10,000,000 Industrial Development Revenue Bonds for Waterloo Civic Center Hotel Company", be adopted and Deputy Clerk/Auditor instructed to publish notice of hearing accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-496. NEW BUSINESS 84780 - Moved by Penaluna, seconded by Burton tht "Resolution ordering bids, approving plans, specifications and form of contract and notice to bidders, fixing amount of bid security, and order Deputy/Clerk Auditor to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, of hearing and receiving bids for the F.Y. 1984 East Park Avenue Parking Facility, Contract No. 251", be adopted and instruct Deputy Clerk/Auditor to publish notice of hearing as October 24, 1983 at 7:00 p.m. in the City Hall Council Chambers on above described request. Ayes: Seven. Resolution adopted -and upon approval by Mayor assigned No. 1983-497. 84781 - Moved by Bowers, seconded by Getty that communication from the Civil Service Commission transmitting the Certification List for positions of Clerk Receptionist and Personnel Analyst, be received, placed on file and approved. Motion carried. 84782 - Moved by Roehr, seconded by Wilharm that communication from the Street Department Superintendent transmitting the retirement of LaVern Bahlman together with recommendation of payment for accumulated sick leave and vacation pay be received, placed on file and "Resolution authorizing the payment to LaVern Bahlman in the amount of $8,850.4011, be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-498. 84783 - Moved by Wilharm, seconded by Bowers that the following requests for permission to attend functions with expenses not to exceed amounts shown, be received, placed on file and approved: Milk Lab Director to attend National Dairy Equipment Show, October 24 and 25, 1983, Chicago, Illinois, cost not to exceed $175.00 plus use of City vehicle. Division Chief of Fire Department to attend Fire Service Leadership/Communication, November 28 thru December 16, 1983, Emmitsburg, Maryland, cost not to exceed $209.00. Assistant City Attorney to attend Program on Governmental Liability, Iowa City, Iowa, October 14, 1983, cost not to exceed $118.20. Motion carried. Motion carried. 84786 - The City Engineer recommended that the award of the F.Y. 1984 Street Drainage Program, Contract No. 260 be delayed one (1) week to clarify irregularities in bid bonds. Moved by Roehr, seconded by Dowie that the above remarks be received, placed on file, approved and action delayed one (1) week.
