The Council of the City of Waterloo, Iowa, met in Regular Session at
City Hall Council Chambers, Waterloo, Iowa at 7:00 p.m. on July 5,
1983. Mayor Rooff in the Chair. Roll Call: Getty, Roehr, Wilharm,
Dowie, Bowers. Absent: Penaluna and Burton.
Invocation: Bowers
84236 - Moved by Dowie, seconded by Getty
that the Agenda, as amended for the Regular Session of July 5, 1983,
7:00 p.m., be accepted and approved.
Motion carried.
84237 - Moved by Roehr, seconded by Bowers
that the Minutes of the Regular Session held June 27, 1983 and June
30, 1983, at 7:00 p.m.and at 4:00 p.m., respectively, be approved.
Motion carried.
HEARINGS
84238 - Moved by Bowers, seconded by Getty
that proof of publication of notice of public hearing on the issuance
of Industrial Development Revenue Bonds for Roskamp Mfg., Inc., in
an amount not to exceed $750,000, as published in the Waterloo
Courier on June 10, 1983, be received and placed on file.
Motion carried.
84239 - Hugh Field, legal counsel for Roskamp Mfg., Inc., reported that an
additional $500,000 is needed for project completion; therefore, the
entire project will not exceed the issuance of $1,250,000 of
Industrial Revenue Bonds.
HOLD HEARING --This being the time and place for public hearing the
Mayor called for written and oral objections and there were none.
Moved by Roehr, seconded by Wilharm
that "Resolution determining to proceed with the issuance of not to
exceed $750,000 Industrial Revenue Bonds, Series 1983 for Roskamp
Mfg., Inc.,", be adopted. Ayes: Five. Absent: Penaluna & Burton.
Resolution adopted and upon approval by Mayor assigned No. 1983-256.
ORAL PRESENTATIONS
84240 - Mrs. Oliver Hoch, 1223 Columbia, asked when the paving on Columbia
Street could expect to be completed.
Mayor kooff reported that the street was included in the Ninth Year
Community Development Block Grant Paving Program.
Councilman Getty presented a petition of area residents on Virginia
Street requesting that the property behind 1106 Virginia (in the 200
block of McKay Street) be cleaned up.
Moved by Getty, seconded by Dowie
that the above petition be received, placed on file, and referred to
the Park Department, Building Department and Health and Sanitation
Department.

ORAL PRESENTATIONS CONTINUED
84241 - Councilman Getty reported a problem of water drainage at the end of
Dale Street and presented the recommendation from the Health and
Sanitation Department.
Moved by Getty, seconded by Bowers
that the above report be received, placed on file, and referred to
the City Engineer for further review and recommendation.
Motion carried.
84242 - Moved by Roehr, seconded by Dowie
that the remarks of Mrs. Oliver Hoch (see CR 84240 above) be
received and placed on file.
Motion carried.
REPORTS
84243 - Moved by Wilharm, seconded by Roehr
that report of Transportation Program Manager transmitting proposed
street reconstruction program be received, placed on file and that
the five year program for street reconstruction, with no assessment
be approved.
Prior to a vote on this motion, the following discussion was heard.
Councilman Bowers, reported that with the five (5) year program,
little work would be completed in comparison to the needed repair
work on City streets.
Councilman Roehr stated that an accelerated program could be
undertaken, should the five (5) year program be inadequate.
Councilman Dowie stated that the "no assessment" approach may be
precedent setting.
The question was called for. Ayes: Getty, Roehr, Wilharm, Dowie.
Nayes: Bowers. Absent: Burton and Penaluna.
The Mayor did not declare the motion denied or passed. He reportd
that he would do so at the Council Meeting of July 11, 1983.
84244 - City Attorney Tyler, reported that the books in question are out of
print and/or of little research value. They would be advertised in
various law publications.
Moved by Bowers, seconded by Getty
that communication from City Attorney requesting authorization to
take informal bids on law library books, be received, placed on file,
and approved.

84245 - Moved by Roehr, seconded by Bowers
that communication from Planning, Programming and Zoning Commission
transmitting the final plat of Home Plaza Addition, together with
necessary documents, and recommendation of approval be received,
placed on file, and "Resolution approving said documents", be
adopted. Ayes: Five. Absent: Burton and Penaluna.

84246 - Moved by Dowie, seconded by Roehr
that communication from Transportation Program Manager transmitting
Traffic Signal and Street Lighting installation agreement (Agreement
No. 83-17-176) with Iowa Department of Transportation for combined
Interstate 380/Relocated U.S. 20 (520)/U.S. 218 Interchange, together
with recommendation of approval be received, placed on file and
"Resolution approving said agreement", be adopted and Mayor and
Deputy Clerk/Auditor authorized to execute same. Ayes: Five.
Absent: Burton & Penaluna.
Resolution adopted and upon approval by Mayor assigned No. 1983-258.
RESOLUTIONS TO BE ADOPTED
84247 - Mayor Rooff reported that this action would remove the restrictive
covenant stating that should the City not construct an indoor
sports facility on the property, the property would revert to its
former owners, Vern and Donna Nelson.
Moved by Getty, seconded by Wilharm
that "Resolution rescinding Resolution No. 1981-619 relating to the
acceptance of property from Vern and Donna Nelson for an indoor
sports facility, generally located between W. 6th and W. 10th Street,
the Cedar River and Commercial Street", be adopted. Ayes: Five.
Absent: Burton and Penaluna.
Resolution adopted and upon approval by Mayor assigned No. 1983-259.
84248 - Moved by Getty, seconded by Wilharm
that "Resolution accepting certain land from Vern and Donna Nelson
for property generally located between W. 6th Street and W. 10th
Street in the area bordered by the Cedar River and Commercial Street
for use as an indoor sports facility", be adopted. Ayes: Five.
Absent: Burton and Penaluna.
Resolution adopted and upon approval by Mayor assigned No. 1983-260.
84249 - Moved by Roehr, seconded by Dowie
that "Resolution authorizing the Execution of a Memorandum of
Agreement by and between the City of Waterloo, Iowa and Roskamp Mfg.,
Inc., regarding the Issuance of not to exceed $1,250,000 Industrial
Revenue Bonds", be adopted. Ayes: Five. Absent: Burton and
Penaluna.

the City Hall Council Chambers", be adopted and Deputy Clerk/Auditor
instructed to publish notice of hearing accordingly. Ayes: Five.

that "Resolution fixing salaries for administrative personnel for

ORDINANCES TO BE ADOPTED
84252 - Moved by Bowers, seconded by Getty
that an "Ordinance amending Ordinance No. 2644, known as the Traffic
Ordinance, by repealing Subsections (40) and (40a), Hammond Ave., and
Subsection (93) Third Street, of Section 541, increasing speed limits
in certain areas; and enacting in lieu thereof a new subsection
(40) Hammond Avenue and a new Subsection (93) Third Street, to
Section 541, increasing speed limits in certain areas; and by adding
Subsection (32c) Brookeridge Drive to Section 551, parking
prohibited at all times on certain streets" be received, filed,
considered and passed for the first time. Ayes: Five. Absent: Burton
and Penaluna.

that an "Ordinance amending the Code of Ordinances of the City of
Waterloo, Iowa, by repealing Section 7-55 (noisy, annoying dogs
or cats) of Chapter 7, Animals and Fowl; and by enacting in lieu
thereof a new Section 7-55 (noisy, annoying animals) to Chapter
7, Animals and Fowl", be received, filed, considered and passed
for the second time. Ayes: Five. Absent: Burton and Penaluna.

that an "Ordinance amending the Code of Ordinances of the City of
Waterloo, Iowa, by adding Subsection 7-5, Trapping, to Chapter 7,
Animals and Fowl", be received, filed, considered and passed for

BOARD OF HEALTH
The Council of the City of Waterloo, Iowa, met as the Board of Health
following the Regular Session of the City Council. Mayor Rooff in
the Chair. Roll call: Getty, Roehr, Wilharm, Dowie, Bowers.
Absent: Penaluna and Burton.
84262 - Bill Hoffman, Director of Health and Sanitation reported that his
department was working closely with Iowa Department of Transportation
on the Lowder Road Storm Sewer Project. He also reported that
mosquito control in the Sherwood Park Area would continue after flood
waters subside.

that the Council adjourn the Board of Health

84263 - City Attorney Tyler reported that the purpose of the Executive
Session was to discuss impending litigation.

that the Council adjourn the Executive Session.

84265 - Moved by Dowie, seconded by Bowers
that the City Attorney be instructed to begin proceedings for a
lawsuit to insure that the tax levy associated with the
Self -Supported Municipal Improvement District (SSMID) is instituted
by Black Hawk County, with the Waterloo Redevelopment
Authority asked to enjoin the suit. Ayes: Five. Absent: Burton and
Penaluna.
