Mayor Rooff in the Chair. Roll Call: Getty, Penaluna, Wilharm, Bowers, Burton, Dowie, Roehr. Invocation: Getty 84203 - Moved by Roehr, seconded by Bowers that the Agenda, as amended for the Regular Session of June 27, 1983 at 7:00 p.m., be accepted and approved. Motion carried. 84204 - Moved by Burton, seconded by Dowie that the Minutes of the Regular Session held June 20, 1983 at 7:00 p.m., be approved. Motion carried. ADJOURNED HEARING 84205 - HOLD HEARING --This being the time and place for public hearing on the FY 1984 Oiling Program, Contract No. 249 (Ashland Avenue), the Mayor called for written and oral objections. The Clerk/Auditor reported that several additional petitions of opposition had been received, with a total of 71% of the property owners opposing the request. Moved by Burton, seconded by Bowers that the above petitions be received and placed on file. Motion carried. 84206 - Moved by Getty, seconded by Dowie that Ashland Avenue be deleted from said oiling program be received, placed on file, and "Resolution of Necessity, as amended", be adopted. Moved by Dowie, seconded by Getty that "Resolution instituting proceedings with the issuance of $3,680,000 General Obligation Bonds", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-243B. 84209 - Moved by Bowers, seconded by Getty that proof of publication of notice of meeting on issuance of $150,000 General Obligation Bonds, for General Corporate Purpose as published in the Waterloo Courier on June 10, 1983, be received and placed on file. Motion carried. 84210 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Roehr, seconded by Dowie that "Resolution instituting proceedings with the issuance of $150,000 General Obligation Bonds", be adopted. Ayes: Seven. PETITIONS FROM PUBLIC 84211 - Moved by Bowers, seconded by Getty that communication from City Engineer transmitting the request of E. M. Duesenberg, Inc., (grading contractor) for a variance to the City Noise Ordinance (Ord. No. 3099) in conjunction with the Relocated Highway 20 Project, South Waterloo together with recommendation of approval be received, placed on file, and "Resolution approving the above described request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-245. 84212 - Moved by Roehr, seconded by Wilharm that communication from Planning, Programing, and Zoning Commission transmitting the request of Home Savings and Loan Association for site plan amendment for construction of professional office building at intersection of Ansborough Avenue and Highway 412, together with recommendation of approval be received, placed on file, and "Resolution setting date of hearing as July 11, 1983 at 7:00 p.m. in the City Hall Council Chambers on above described request", be adopted and Clerk/Auditor instructed to publish notice of hearing accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-246. 84213 - Don Temeyer, Plan, Program, and Zoning Director, reported that the request to have a permanent beer garden would require additional parking and could only be waived by the Board of Adjustment. Moved by Getty, seconded by Roehr that communication from John Bordeaux, The Round Up, Inc., to establish a beer garden adjacent to their building at 1927 Jefferson Street from July 4, 1983 through the summer months, be received, placed on file, and referred to the Board of Adjustment for further action. Ayes: Seven. Motion carried. 84214 - Moved by Dowie, seconded by Penaluna that communication from Sign & Traffic Department recommending parking restriction on the south side of Brookeridge Drive from Pheasant Lane to Kimball Avenue be received, placed on file, approved, and referred to the City Attorney for submission of an ordinance accordingly. Motion carried. June 27, 1983 Page Four PETITIONS FROM PUBLIC CONTINUED 84215 - Moved by Bowers, seconded by Wilharm that communication from Sign and Traffic Department recommending increase in speed limit from 25 MPH to 35 MPH on Hammond Avenue from Highway 412 to Shaulis Road (in conjunction with relocated Highway 20 project; see Ord. No. 3232 of August, 1982) be received, placed on file, approved and referred to the City Attorney for submission of an ordinance accordingly. Prior to a vote on this motion, the following amendment was offered for consideration: Moved by Roehr, seconded by Penaluna that the speed limit on W. 3rd Street from Washington to U.S. Highway 63 be increased from 25 MPH to 30 MPH. The vote on this amendment was as follows: Ayes: Five. Nayes: Burton, Wilharm. Motion carried. 84216 - A vote was taken on the above mentioned motion as amended: Ayes: Seven. Motion carried. 84217 - DOCUMENTS Moved by Wilharm, seconded by Roehr that communication from Transportation Program Manager transmitting request of Iowa Department of Transportation authorizing state purchase of right-of-way in conjunction with relocated U.S. Highway 218 between Mitchell and Wisconsin Street together with recommendation of approval be received, placed on file and "Resolution approving said agreement", be adopted, and Mayor and Clerk/Auditor authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 1983-247. 84218 - Moved by Roehr, seconded by 'Bowers that communication from Plan, Program, and Zoning Commission transmitting request of adjacent property owners to vacate, sell and convey an alley generally located between Commercial Street and Jefferson Street and Southeasterly of W. 18th Street with the City's retention of an easement together with recommendation of approval be received, placed on file and "Resolution setting date of hearing as July 18, 1983 at 7:00 p.m. in the City Hall Council Chambers on above described request be adopted and Clerk/Auditor instructed to publish notice of hearing accordingly. Motion carried. 84220 - Moved by Bowers, seconded by Dowie that communication from Engineering Department transmitting Agreement with City of Evansdale for disposal of unsuitable excavated material from Blowers Creek Segment of Flood Protection Project, together with recommendation of approval be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Clerk/Auditor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-249. 84221 - City Attorney Tyler recommended that the delinquent amounts be processed through small claims court. Moved by Dowie, seconded by Penaluna that communication from Building Official transmitting Delinquent Housing Inspection Fees in the amount of $1,853.00 for certification to the County Treasurer per Chapter 19 of the Housing Code of Ordinances of the City of Waterloo, Section 19-17, Fees, Subsection (d) be received, placed on file, and referred to the City Attorney's Office for preparation for small claims court. Motion carried. 84222 - Moved by Roehr, seconded by Wilharm that communication from City Engineer transmitting Contracts, Bonds, and Certificates of Insurance for the Sixth Street Bridge and Approaches, Project No. IX -6653(1)--79-07, Contract No. 215 from Shappert Engineering Co., of Belvidere, Ill., together with recommendation of approval be received placed on file, and "Resolution approving said contracts and bonds", be adopted and Mayor and Clerk/Auditor authorized to execute same. A private property owner on his private property in order to control small rodents, such as gophers, moles and other similar animals. Moved by Dowie, seconded by Bowers that an "Ordinance amending the Code of Ordinances of the City of Waterloo, Iowa, by adding Subsection 7-5, Trapping, to Chapter 7, Animals and Fowl as amended", be received, filed, considered and passed for the first time. Ayes: Seven. Motion carried. 84227 - Moved by Burton, seconded by Bowers that an "Ordinance amending the Code of Ordinances of the City of Waterloo, Iowa, by repealing Section 7-55 (noisy, annoying dogs or cats) of Chapter 7, Animals and Fowl; and by enacting in lieu thereof a new Section 7-55 (noisy, annoying animals) to Chapter 7, Animals and Fowl," be received, filed, considered and passed for the first time.
