Mayor Rooff in the Chair. Roll Call: Getty, Penaluna, Roehr, Dowie, Burton, Bowers. Absent: Wilharm. Invocation by: Getty 84104 - Moved by Roehr, seconded by Burton that the Agenda, as amended for the Regular Session of June 6, 1983, at 7:00 p.m., be accepted and approved. Motion carried. 84105 -,Moved by Burton, seconded by Dowie that the Minutes of the Regular Session held May 23, 1983 at 7:00 p.m., be approved. Motion carried. Mayor Rooff introduced Troop 2 from Zion Lutheran Church and welcomed them to the Council Meeting. ADJOURNED HEARING 84106 - The FY 1983 Maywood Storm Sewer Area 3, Contract No. 244 was brought to the floor for discussion. The Mayor reported on the neighborhood meeting held on June 2, 1983 to discuss said project. Due to the large lots in the area, assessments were substantial. As an alternative, the Mayor suggested that the storm sewer project be eliminated and culvert and ditch work be substituted, with hard -surfacing of the streets to follow. Moved by Bowers, seconded by Burton that all oral and written objections be received and placed on file. Motion carried. 84107 - Moved by Bowers, seconded by Dowie that "Resolution sustaining the objections to the FY 1983 Maywood Storm Sewer Area 3, Contract No. 244", be adopted. Ayes: Six. Absent: Wilharm. Resolution adopted and upon approval by Mayor assigned No. 1983-191. 84108 - Moved by Roehr, seconded by Bowers that "Resolution amending the Resolution of Necessity for the FY 1983 Maywood Storm Sewer Area 3, Contract No. 244, and thus eliminating the project", be adopted. June 6, 1983 HEARINGS Page Two 84109 - The use of Community Development Block Grant Funds in conjunction with the Federal Emergency Jobs Bills was brought to the floor for discussion. 84110 - Mayor Leo P. Rooff recommended that the $25,000 programmed for use by the People's Community Clinic for establishment of an in-house pharmacy be transferred to the line item entitled "Demolition -Downtown". Ron Kemp, Director of the Peoples's Community Health Clinic, supported the use of these funds for the pharmacy. Jim Walker, Chairman of the Waterloo Redevelopment Authority, reported that the owner of the building scheduled for demolition (the former Brown Owl Building and the buildings adjacent to Newton Jewelry, on E. 4th Street) had agreed to put a lien against the property until such time as the building is sold, with the money to be returned to the City. Phil Coontz, owner of the Evansdale Pharmacy opposed the use of tax payer dollars for the proposed pharmacy. Moved by Getty, seconded by Dowie that $25,000 be eliminated from the line -item "Peoples Community Health Clinic Funds for Equipment & Inventory to establish an In -House Pharmacy" and transferred to the line -item "Demolition -Downtown" be received, placed on file, and approved, and "Resolution approving the preparation and submission of a statement of Community Development objectives and projected use of funds to the Department of Housing and Urban Development for Federal Assistance under the Community Development Block Grant Jobs Bill Program", be adopted. Motion carried. 84111 - HOLD HEARING --This being the time and place of public hearing the Mayor called for written and oral objections and there were none. 84112 - Moved by Bowers, seconded by Getty that the above matter be referred to the City Attorney for submission of an ordinance accordingly. Motion carried. Moved by Dowie, seconded by Roehr that proof of publication of notice of public hearing on the Special Permit request of Columbus High School for Dugout and Building as published in the Waterloo Courier on May 20, 1983, be received and placed on file. Moved by Bowers, seconded by Dowie that "Resolution approving said special permit request of Waterloo Community Schools to construct Press Box at Sloane Wallace Stadium", be adopted. Ayes: Six. Resolution adopted and upon approval by Mayor assigned No. 1983-195. 84116 - Moved by Bowers, seconded by Burton that proof of publication of notice of public hearing to vacate, sell and convey an alley generally bounded by Ogden and Bishop Avenues and between Fulton and Wyandotte Street as published in the Waterloo Courier on May 20, 1983, be received and placed on file. Motion carried. 84117 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Penaluna that "an Ordinance authorizing the vacation and sale of an alley generally bounded by Ogden and Bishop Avenues and between Fulton and Wyandotte Street", be received, placed on file, passed and considered for the first time. Ayes: Six. Absent: Wilharm. Motion carried. 84118 - Moved by Roehr, seconded by Burton that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that below ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ordinance adopted and upon approval by Mayor assigned No. 3281. 84120 - Moved by Bowers, seconded by Penaluna that "Resolution authorizing the sale and conveyance of an alley, generally bounded by Ogden, Bishop, Fulton and Wyandotte to Donald and Kathy Stone, David and Cheryl Thompson, Robert and Sheryl Hinz, Roger and Susan Wildeboer, John and Patricia Handy, John and Debra Mixdorf, Paul and Kristine Larson, and Lewabi, Inc.", be adopted and City Attorney instructed to prepare deed accordingly. Motion carried. 84122 - HOLD HEARING --This being the time and place of hearing, the Mayor called for written and oral objections. Jerry Eckerman, 2855 Deere Road, opposed the renaming due to the° expense involved in notifying his customers of the change. Moved by Burton, seconded by Dowie that "an Ordinance changing street name from Deere Road to Cedar Heights Drive", be received, placed on file and denied. Motion carried. 84123 - Moved by Dowie, seconded by Getty that proof of publication of notice of public hearing on the sale of a portion of vacated Bourland Street as published in the Waterloo Courier on May 20, 1983, be received and placed on file. Motion carried. 84124 - HOLD HEARING --This being the time and place of public hearing the Mayor called for written and oral objections and there were none. Moved by Burton, seconded by Roehr that "Resolution authorizing the sale and conveyance of a portion of vacated Bourland Street to Dennis Gene and Ruth Ann Clements", be adopted. Ayes: Six. Motion carried. 84126 - Herb Frisch, 1022 Black Hawk Road, reported a dust problem on Black Hawk Road and asked the City's assistance on a permanent solution. Moved by Burton, seconded by Roehr that the above remarks be received, placed on file, and referred to the Street and Sanitation Departments and City Attorney for action. Motion carried. 84127 - Upon request of Paul Jamieson, 815 W. 1st, Councilman Burton requested a reduction in speed limits in the 800 and 900 Block of W. 1st from 30 m.p.h. to 25 m.p.h. Moved by Burton, seconded by Dowie that the above remarks be received, placed on file and referred to the Police Department and Sign and Traffic Department. Motion carried. PETITIONS FROM PUBLIC 84128 - Moved by Getty, seconded by none that communication from Northwestern Bell requesting installation of drive -up public telephone on Commercial Street between W. 7th and W. 6th be received, placed on file and approved. Motion died for lack of a second. 84129 - Moved by Burton, seconded by Roehr that communication from Northwestern Bell requesting installation of drive -up public telephone on Jefferson Street between W. 3rd and W. Park Avenue be received, placed on file and denied. Motion carried. 84130 - Bill Hoffman, Director of Health/Sanitation, reported past situations with the dogs at 749 Riehl Street. City Attorney, W. David Tyler, reported that the City requires that complaint forms be signed by at least three (3) property owners advising the City of the situation. Moved by Getty, seconded by Dowie that petition from area residents in the 800 Block of Riehl on barking and howling dogs, be received, placed on file, and signers informed in writing of the complaint procedure. Resolution adopted and upon approval by Mayor assigned No. 1983-198. 84132 - Moved by Roehr, seconded by Getty that communication from Planning and Zoning Commission transmitting request of Peoples Bank to purchase the parking lot located at northeast corner of Commercial and West 6th Street, containing approximately 24,600 sq. ft., together with appraisal in the amount of $187,000 be received, placed on file and "Resolution setting date of hearing as June 20, 1983 at 7:00 p.m. in the City Hall Council Chambers on above described request", be adopted and Clerk/Auditor instructed to publish notice with requirements that the minimum bid be $140,000 and each must contain a development proposal. REPORTS 84133 - Moved by Penaluna, seconded by Bowers that report from Plan and Proaram Director transmitting increase in the General Obligation Bond Sale to reflect the addition to City Hall in the amount of $480,000 be received, placed on file, and approved. Motion carried. 84134 - Moved by Bowers, seconded by Burton that report from Sign and Traffic on petition received from residents on Sycamore Street adjacent to Lafayette Park requesting 2 hour parking and speed limit change be received, placed on file, approved, and City Attorney instructed to submit ordinance accordingly. DOCUMENTS 84135 - Moved by Dowie, seconded by Getty that communication from Community Development Administrator transmitting architectural agreement with Flinn Saito Andersen Architects for services for an addition to and renovation of City Hall, together with recommendation of approval be received, placed on file and "Resolution approving said agreement", be adopted and Mayor authorized to execute same.
