Mayor Rooff in the Chair. Roll Call: Getty, Penaluna, Roehr, Wilharm, Burton and Dowie. Absent: Bowers. Invocation by Wilharm 84025 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended for the Regular Session of May 16, 1983, at 7:00 p.m., be accepted and approved. Motion carried. 84026 - Moved by Burton, seconded by Dowie that the Minutes of the Regular Session held May 9, 1983 at 7:00 p.m., be approved. Motion carried. ADJOURNED HEARING 84027 - Moved by Wilharm, seconded by Burton that the Council adjourn further action on the FY 1983 Maywood Storm Sewer Area 3, Contract No. 244 until June 6, 1983 at 7:00 p.m., at the City Hall Council Chambers. Motion carried. HEARINGS 84028 - Moved by Dowie, seconded by Penaluna that proof of publication of notice of public hearing on the Sale of Disposal Parcel I -35p in the Westfield -Virden Urban Renewal Area to Local 46 Cedar River Housing Corporation --East Park and Sycamore as published in the Waterloo Courier on May 10, 1983, be received and placed on file. Motion carried. 84029 - HOLD HEARING --This being the time and place of hearing the Mayor called for written and oral objections. There were none. Moved by Wilharm, seconded by Roehr that "Resolution approving the Sale of Disposal Parcel I -35p in the Westfield -Virden Urban Renewal Area to Local 46 Cedar River Housing Corporation --East Park and Sycamore", be adopted. Ayes: Six. Absent: Bowers. Resolution adopted and upon approval by Mayor assigned No. 1983-159. May 16, 1983 ORAL PRESENTATIONS Page Two 84030 - Paul Radue, 3332 Ellington, voiced his concern for the lack of support from the Council for the activities of Waterloo Cable Commission. Mayor Leo Rooff reported that the Council supports their work; however, some of the information that the Commission is requesting of the Cablevision Company may not be obtainable. Future plans include a meeting with Allan McDonald to resolve any differences. Moved by Roehr, seconded by Dowie that the above remarks be received and placed on file. Motion carried. 84031 - Sheila Vanderwerf, 3748 Cedar Terrace Drive, asked that the Council waive delinquent sewer and garbage fees in the amount of $56.50 for property at 113 Joder Avenue. She had received a delinquent Real Estate Tax Statement and Tax Sale Notice from the County Treasurer for said services accumulated by a gentleman whom she had not rented to; therefore, she asked that said amount be cancelled. Moved by Getty, seconded by Wilharm to instruct the Clerk/Auditor to cancel the delinquent sewer and garbage for the property at 113 Joder Avenue (Lot 7, Block 34, Hagerman Place Addition) in the amount of $56.50. Motion carried. 84032 - Moved by Roehr, seconded by Wilharm that the petition signed by area residents requesting paving in the 1000 block of Englewood be received, placed on file and referred to the City Engineer and Community Development Board for review. Motion carried. PETITIONS FROM PUBLIC 84033 - Moved by Dowie, seconded by Burton that request of Northeast Iowa Region Sports Car Club of America for variance to Noise Ordinance in conjunction with events scheduled for June 12, 1983, together with recommendation of approval of the Police Department and requests to use a PA system and use of the following route: Commercial to Water Street and Sixth Street to Sycamore; be received, placed on file and "Resolution approving said application for variance to Noise Ordinance; Ordinance No. 3094", be adopted and granting use of PA system and route as designated above. Ayes: Six. Absent: Bowers. Resolution adopted and upon approval by Mayor assigned No. 1983-160. 84034 - Moved by Roehr, seconded by Getty that request of property owners to vacate, sell, and convey an alley generally located between Ogden and Bishop Avenue and between Fulton and Wyandotte, together with recommendation of approval of Planning and Zoning Commission, be received, placed on file, and "Resolution setting date of hearing as June 6, 1983 at 7:00 p.m., in the City Hall Council Chambers on above described proposal", be adopted and Clerk/Auditor instructed to publish notice of hearing accordingly. Resolution adopted and upon approval by Mayor assigned No. 1983-162. 84036 - Moved by Getty, seconded by Roehr that Special Permit request of Waterloo Community School for construction of press box at Sloan Wallace Stadium, together with recommendation of approval of Planning and Zoning Commission be received, placed on file, and "Resolution setting date of hearing as June 6, 1983, at 7:00 p.m., in the City Hall Council Chambers on above described proposal", be adopted and Clerk/Auditor instructed to publish notice of hearing accordingly. Resolution adopted and upon approval by Mayor assigned No. 1983-163. 84037 - Moved by Getty, seconded by Roehr that communication from Planning & Zoning Commission transmitting request of Dennis Gene & Ruth Ann Clements to purchase portion of vacated Bourland Street abutting property at 2100 W. 9th Street, together with recommendation of approval be received, placed on file, and "Resolution setting date of hearing as June 6, 1983 at 7:00 p.m., in the City Hall Council Chambers on above described proposal", be adopted and Clerk/Auditor instructed to publish notice of hearing accordingly. REPORTS 84038 - Moved by Roehr, seconded by Getty that communication from Park Department on request of area residents for oiling of Byrnes Park area and Stadium Parking Lot be received, placed on file, approved, & oiling delayed until money is available. Motion carried. 84039 - Moved by Roehr, seconded by Penaluna that Minutes from the Community Development Board Meeting of April 12, 1983, be received and placed on file. Motion carried. May 16, 1983 Page Four DOCUMENTS 84040 - Moved by Wilharm, seconded by Dowie that communication from Transportation Program Manager transmitting proposed contract with Brice, Petrides, & Assoc., Inc., for professional services on the Sixth Street Bridge and Approaches, together with recommendation of approval be received, placed on file, and "Resolution approving said contract", be adopted and Mayor and Clerk/Auditor authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 1983-165. 84041 - Moved by Getty, seconded by Roehr that communication from Engineering Department transmitting the recommendation of Acceptance and Completion Report for FY 1982 East San Marnan at Sears Street & Penneys Street Improvements, Contract No. 230., be received, placed on file, and "Resolution approving said recommendations of Acceptance and Completion Reports for above contract from Concrete Foundations", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1983-166. 84042 - Moved by Roehr, seconded by Burton that communication from Engineering Department transmitting the recommendation of Acceptance and Completion Report for FY 1983 Paving Program, Section I, Contract No. 234., be received.- placed eceived;placed on file, and "Resolution approving said recommendation of Acceptance and Completion Report for above contract from Cedar Valley Corp.", be adopted. RESOLUTIONS TO BE ADOPTED 84044 - Moved by Wilharm, seconded by Roehr that "Resolution authorizing the Clerk/Auditor to proceed with the sale of General Obligation Bonds for FY 1984 in the amount of $4.85 million and hiring Bonding Attorney of Ahlers, Cooney, Dorweiler, Haynie and Smith", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1983-168. 84045 - Moved by Roehr, seconded by Getty that communication from Planning & Zoning Department and Street Department recommending that the monthly garbage fee be increased from $4.10/month to $4.50/month to reflect increases in labor costs, pickup exemptions, and equipment replacements be received, placed on file, and "Resolution setting date of hearing as May 23, 1983 at 7:00 p.m. in the City Hall Council Chambers on above described request", be adopted and Clerk/Auditor instructed to publish notice accordingly.
