Mayor Rooff in the Chair. Roll Call: Getty, Roehr, Wilharm, Dowie, Burton, Bowers. Absent: Penaluna. Invocation by Getty. 83970 - Moved by Roehr, seconded by Dowie that the Agenda, as amended for the Regular Session of May 9, 1983, at 7:00 p.m., be accepted and approved. Motion carried. 83971 - Moved by Bowers, seconded by Burton that the Minutes of the Regular Session held April 25 and May 2, 1983, at 7:00 p.m., be approved. Motion carried. ADJOURNED HEARING 83972 - The Mayor announced that this was the time and place for the adjourned hearing on the vacation of a portion of the alley in Block 5, Original Plat East Waterloo for the Rath Union Elderly Housing Project (E. Park and Sycamore). (see CR 83969 of May 2, 1983) HOLD HEARING --This being the time and place of adjourned hearing, the Mayor called for written and oral objections. There were none. Moved by Wilharm, seconded by Dowie that "an Ordinance vacating an alley in Block 5, Original Plat East Waterloo --Rath Union Elderly Housing Project East Park and Sycamore", be received, placed on file, considered and passed for the first time. Motion carried. 83973 - Moved by Burton, seconded by Dowie that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that below ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. May 9, 1983 Page Two HEARINGS 83975 - Moved by Roehr, seconded by Bowers that proof of publication of notice of public hearing on the vacation and sale of a portion of Ivy Street as published in the Waterloo Courier on May 2, 1983, be received and placed on file. Motion carried. 83976 - HOLD HEARING --This being the time and place of hearing, the Mayor called for written and oral objections. There were none. Moved by Bowers, seconded by Burton that "an Ordinance vacating portion of Ivy Street generally located between the westerly right-of-way line of Riverside Drive and the Cedar River", be received, placed on file, passed and considered for the first time. Ayes: Six. Absent: Penaluna. Resolution adopted and upon approval by Mayor assigned No. 1983-138. 83980 - Moved by Roehr, seconded by Bowers that proof of publication of notice of public hearing on the request of Allen Memorial Hospital for the storage expansion of liquid oxygen as published in the Waterloo Courier on May 2, 1983 be received and placed on file. Motion carried. 83981 - HOLD HEARING --This being the time and place of hearing, the Mayor called for oral and written objections. There were none. Moved by Wilharm, seconded by Bowers that "Resolution approving the special permit request of Allen Memorial Hospital for the storage expansion of liquid oxygen", be adopted. Ayes: Six. May 9, 1983 ORAL PRESENTATIONS Page Three 83982 - Sharon Juon, Chairman of the "My Waterloo Days", encouraged the Council's participation in this event scheduled for June 4-12, 1983. She also distributed "My Waterloo Days" buttons. 83983 - John Bedard, Jr., 1924 Mulberry, presented a petition of area residents requesting a school crossing light at the intersection of Linden and Lafayette Streets. Moved by Bowers, seconded by Burton that the above petition be received, placed on file, and referred to Sign and Traffic for review and recommendation. Motion carried. 83984 - John Bedard, Jr., 1924 Mulberry Street presented a petition of area residents requesting a 2 hour parking limit on Sycamore Street between Vinton and Dunham Place from 6:00 a.m. to 4:00 p.m. Monday through Friday and a reduction in speed limit to 25 mph. Moved by Bowers, seconded by Burton that the above petition be received, placed on file, and referred to Sign & Traffic for review and recommendation. Motion carried. A resident residing on Courtland Avenue stated that the restrooms at Lafayette Park were locked on Sunday, May 8, 1983. The situation will be reviewed. 83985 - Moved by Bowers, seconded by Dowie that action on the FY 1983 Maywood Storm Sewer Area 3, Contract No. 244 be delayed until June 6, 1983. Motion carried. Councilman Getty asked that the Council be updated on the Lowder Road Sanitary Sewer Project, Phase II, Contract No. 180. PETITIONS FROM PUBLIC 83986 - Moved by Bowers, seconded by Getty that communication from Planning and Zoning Commission transmitting request of Harold Hann for property tax abatement for improvements to residential property located at 309 Sumner together with recommendation of approval be received, placed on file and "Resolution approving said tax abatement", be adopted and Clerk/Auditor instructed to notify the County Treasurer accordingly.
