April 25, 1983
The Council of the City of Waterloo, Iowa, met in Regular Session at
City Hall Council Chambers, Waterloo, Iowa at 7:00 p.m. on April 25,
1983. Mayor Pro -Tem Roehr in the Chair. Roll Call: Roehr, Dowie,
Burton, Bowers. Absent: Getty, Penaluna and Wilharm.
Invocation: Bowers
83937 - Moved by Dowie, seconded by Burton
that the Agenda, as amended for the Regular Session of April 25, 1983
at 7:00 p.m., be accepted and approved.
Motion carried.
83938 - Moved by Burton, seconded by Bowers
that the Minutes of the Regular Session held April 18, 1983 at 7:00
p.m., be approved.
Motion carried.
HEARINGS & BIDS
83939 - Moved by Bowers, seconded by Dowie
that proof of publication of notice of public hearing and invitation
for bids on the FY 1983 Park Avenue Bridge Repairs and Painting,
Contract No. 240 as published in the Waterloo Courier on April 8,
1983 be received and placed on file.
Motion carried.
83940 - HOLD HEARING --This being the time and place of hearing, the Mayor
Pro -tem called for written and oral objections. There were none.
Moved by Dowie, seconded by Burton
that "Resolution confirming the approval of plans, specifications,
etc.", be adopted. Ayes: Four. Absent: Getty, Penaluna, Wilharm.
Resolution adopted and upon approval by Mayor Pro -Tem assigned No.
1983-132.
83941 - Moved by Bowers, seconded by Dowie
that "Resolution ordering construction", be adopted. Ayes: Four.
Absent: Getty, Penaluna, Wilharm.

83942 - Moved by Bowers, seconded by Burton
that the following bids be received, placed on file, and Clerk
instructed to open bids and refer to the City Engineer for review and
recommendation in one (1) week:

83943 - Moved by Dowie, seconded by Burton
that proof of publication of notice of public hearing on the FY 1983
Maywood Storm Sewer Area 3, Contract No. 244 as published in the
Waterloo Courier on April 6 and 13, 1983 be received and placed on
file.
Motion carried.
83944 - HOLD HEARING --This being the time and place of hearing the Mayor
Pro -Tem asked for written objections.
It was reported that 44% of the area residents signed petitions of
opposition on said project.
Moved by Bowers, seconded by Burton
to receive and place on file all written objections.
Motion carried.
83945 - Ed Murphy, 1024 Creston Avenue, stated that he could not afford the
proposed assessment and opposed the project.
John Derifield, 724 Gilbert Avenue, asked the Council's postponement
of any action.
Melvin Vondracek, 1522 Schultz, stated that his assessment was the
highest in his neighborhood.
Curt Van Deest, City Engineer's Office, reported that each assessment
was computed on square footage of each parcel or $.08/sq. ft.
George Plummer, 801 Gilbert Avenue, spoke against the assessed
valuation of his lot and that he could not sell his land for the
assessed amount. He objected to the storm sewer.
Curt Van Deest, explained that the assessment procedure allowed for
payment over a ten year period at a rate of 12% on the unpaid
balance.
Clarence Ford, 1116 Schultz, asked that the project not be completed
due to its cost, in light of the high unemployment.
Timothy Weber, 1345 Schultz, spoke in support of the project. The
sewer would eliminate some of the ponding.
Dan Bertsch, 1311 Schultz, spoke in support of the project by adding
value to their homes. Without the public improvements, their
investment would not appreciate.
Dorothy Nelson, 500 Bishop, questioned the opposition percentage of
44.. She thought a larger percentage was against the project.

Agnes Robertson, 1030 Roosevelt stated she had a divided opinion and
could live with the Council's decision.
John Carney, 1320 Roosevelt, spoke in support of the project and
indicated that the Block Grant Assistance may not always be
available.
Rick Young spoke against the assessment as the tree farm he now
operates would not benefit from storm sewer improvements.
Alan Reed, 1414 Cottage Grove Avenue, opposed the project. He feared
future assessments for street and/or sidewalk improvements.
Daniel O'Brien, 924 Calhoun Street, spoke in support of the project.
Joe Ellis, 1026 Creston Street, reported that the special assessment
cost could not exceed 25% of the lot's value.
Curt Van Deest explained the procedure used in determining the
improved value.
The resident of 1122 Dearborn Avenue spoke against the project. He
presented a snap shot of the road conditions.
Lloyd Karlott, 1238 Ann Street, spoke against the request.
Moved by Dowie, seconded by Burton
that the above remarks be received and placed on file.
Motion carried.
83946 - Mayor Pro -Tem Jack Roehr read a statement from Mayor Leo P. Doff,
asking that the project be delayed until further study could be done.
Moved by Burton, seconded by Bowers
that communication from Mayor Leo P. Rooff be received, placed on
file, and the meeting adjourned until May 16, 1983.
Motion carried.
ORAL PRESENTATIONS
83947 - Councilman Bowers presented a petition requesting that the City
repair, grade and oil parking lot at Municipal Stadium.
Moved by Bowers, seconded by Dowie
that the above petition be received, placed on file, and referred to
the Park Department.
Motion carried.
PETITIONS FROM PUBLIC
83948 - Moved by Dowie, seconded by Burton
that petition from area residents requesting, paving in the 300, 400,
500, and 600 Blocks of Boston Avenue and the 1000, 1100, 1200 Blocks
of Englewood Avenue, together with recommendation from the City
Engineer be received, placed on file and approved.

that communication from Planning & 'Zoning Commission transmitting a
recommendation on the request of B & H Partnership and
Anderson -Martin for approval of a Sanitary Sewer location crossing
relocated Highway 20 and for City participation in the cost sharing
be received, placed on file, recommendation accepted and
participation in said cost denied.

that request of Rath Union Elderly Housing Project (Park Towers) for
vacation of the alley and street lying within Block 5, Original Plat,
Waterloo East --Sycamore and E. Park Avenue with recommendation to
be transmitted following Commission's meeting of April 26, 1983, be
received, placed on file, and "Resolution setting date of hearing as
May 2, 1983 at 7:00 p.m., in the City Hall Council Chambers on above
described proposal", be adopted and Clerk/Auditor instructed to
publish notice of hearing accordingly. Ayes: Four. Absent: Getty,
Penaluna, Wilharm.

that communication from Planning and Zoning Commission transmitting
the Overall Street Plan bounded by Hammond Avenue, Ridgeway Avenue
and Highway 412, be received, placed on file and approved.

that communication from City Engineer transmitting Change Order No. 3
for FY 1982 E. San Marnan at Sears Street & Penneys Street
Improvements, Contract No. 230 for decrease in contract of $374.85
from Concrete Foundations, together with recommendation of approval
be received, placed on file and approved and Mayor Pro -Tem and
Clerk/Auditor instructed to execute same.

that a "Resolution accepting and approving certain offers to sell
real property to the City and accepting and approving certain deeds
to Venice and Betty Mether, 2330 Independence Avenue, in conjunction
with Blowers Creek Flood Control Project", be adopted. Ayes: Four.

Ordinance by repealing certain sections and adding certain sections",

that "an ordinance amending Ordinance No. 2479, as amended, by adding
