The Council of the City of Waterloo, Iowa, met in Regular Session at
City Hall Council Chambers, Waterloo, Iowa at 7:00 p.m. on March 7,
1983. Mayor Rooff in the Chair. Roll call: Getty, Penaluna, Roehr,
Wilharm, Dowie, Burton, and Bowers.
83715 - Moved by Roehr, seconded by Dowie
that the Agenda, as proposed for the Regular Session of March 7, 1983
at 7:00 p.m., be accepted and approved.
Motion carried.
83716 - Moved by Dowie, seconded by Burton
that the Minutes of the Regular Session held February 28, 1983 at
7:00 p.m. be approved.
Motion carried.
HEARINGS
83717 - Moved by Roehr, seconded by Burton
that proof of publication of notice of public hearing on amendments
to Ordinance No. 2479, as amended, Zoning Ordinance pertaining to
required parking spaces as published in the Waterloo Courier on
February 22, 1983 be received and placed on file.
Motion carried.
83718 - HOLD HEARING --This being the time and place of hearing, the Mayor
called for written and oral objections and there were none.

that "an Ordinance amending Ordinance 2479, as amended, known as the
Zoning Ordinance by repealing subsection D-2, of Section 2A-45
Off -Street Parking area required under Part XIX Parking and Loading
areas, public garages, parking lots and filling stations; and
enacting in lieu thereof a new subsection D-2, of Section 2A-45
Off -Street parking area required, under Part XIX parking and loading
areas, public garages, parking lots and filling stations: pertaining
to professional offices over 50,000 square feet of gross floor area,"
be received, placed on file, and passed for the first time. Ayes:
Seven.

that proof of publication of notice of public hearing on the vacation
of a portion of W. Donald Street as published in the Waterloo Courier
on February 22, 1983 be received and placed on file.

83720 - HOLD HEARING --This being the time and place of public hearing, the
Mayor called for written and oral objections and there were none.

that "An Ordinance vacating a portion of W. Donald Street generally
described as lying 183 ft east of the extended westerly Right -of -Way
line of vacated Wagner Road", be received, placed on file, passed and
considered for the first time. Ayes: Seven.

that rules requiring ordinances to be considered and voted for
passage to two prior meetings, be suspended, and that below ordinance
be recorded as having been considered and passed for the second and
third times and now placed on its final adoption. Ayes: Seven.

83722 - Moved by Wilharm, seconded by Burton
that "An Ordinance vacating a portion of West Donald Street,
generally described as lying 183 ft. east of the extended westerly
right-of-way line vacated Wagner Road", be adopted. Ayes: Seven.
Ordinance adopted and upon approval by Mayor assigned No. 3262.
PETITIONS FROM PUBLIC
83723 - Moved by Dowie, seconded by Burton
that communication from Plan and Program Director transmitting
request of Bertch Cabinet Mfg., for industrial tax exemption for
office and plant area located at 4730 Brookpark Road, together with
recommendation of approval as said application complies with City
Ordinance No. 3136 be received, placed on file, and "Resolution
approving said application", be adopted and Clerk/Auditor instructed
to forward said application to the City Assessor for final
determination. Ayes: Seven.

83724 - Moved by Wilharm, seconded by Bowers
that communication from Plan and Program Director transmitting
request of Lyle B. Shriver (Reed -Cadillac) for vacation, sale, and
conveyance of alley generally located adjacent to 803 W. 5th Street,
together with objection of adjacent property owner and reommendation
of approval of the Plan and Program Commission, subject to the
objecting neighbor waiving his right to purchase portion adjacent to
his property or purchasing that portion adjacent to his property be
received, placed on file and "Resolution setting date of hearing as
March 28, 1983 at 7:00 p.m. in the City Hall Council Chambers on
above described request", be adopted and Clerk/Auditor instructed to
publish notice of hearing accordingly. Ayes: Seven.
Resolution adopted and upon approval by Mayor assigned No. 1983-64.
83725 - Jim Walker, Chairman of the Waterloo Redevelopment Authority,
presented petitions signed by approximately 95% of property owners
within a ten (10) block area of the proposed site of the ramp in
support of the self assessment. He explained the method in which the
$2.5 million ramp would be paid.
Moved by Bowers, seconded by Burton
that petition of downtown property owners requesting a program of
self assessment for the purposes of construction of a parking
facility to be generally located along East Park Avenue extending
from the Sycamore 501 Building across Lafayette Street and extending
200 feet into the block occupied by Black Hawk Abstract Co., be
received, placed on file, and said petitions referred to the City
Engineer for review and that he be instructed to prepare final plans
and specifications, and proceed with the assessment process.

83726 - Moved by Roehr, seconded by Bowers
that communication from Mayor Leo P. Rooff recommending the adoption
of a resolution requiring the hiring of permanent residents of the
City of Waterloo relating to construct contracts and/or consultant
contracts dealing with projects that are federally funded be
received, placed on file, and referred to the City Attorney for
review of said proposed resolution on March 14, 1983.

that the City Auditor's Statement for February, 1983 be received and
placed on file.
Motion carried.
83728 - Councilman Roehr suggested that the City take measures to alleviate
the dust problem in the parking areas of Byrnes Park.
Moved by Roehr, seconded by Bowers
that the report of Street Superintendent in regard to the dust
problem in the Byrnes Park area referred to under CR 83682 of
February 21, 1983 be received, placed on file, and approved.

that an "ordinance amending Ordinance No. 2479, known as the Zoning

exceptions and modifications of Part XXII, exceptions and
modifications pertaining to special permits for Waste Disposal
Sites", be adopted. Ayes: Seven.

that communication from Assistant City Attorney transmitting
recommendation on adoption of the Uniform Building Code, 1982
Edition, as published in 1982 by the International Conference of
Building Officials be received, placed on file, and "Resolution
setting date of hearing as March 28, 1983 at 7:00 p.m. in the City
Hall Council Chambers on above described proposal", be adopted and
Clerk/Auditor instructed to publish notice of hearing accordingly.

that the report of City Attorney and list of bonds filed with
Clerk through March 7, 1983, be received, placed on file and
report and bonds approved.

83737 - Larry Wandro, representative of Teamster's Local 844,
requested that the three (3) grievances filed by Clerks in the
Police Department be discussed in Executive Session.
John Holmes, City Attorney, stated that his review of the
grievances did not fall within the confines of a closed
session, as they were not concerned with performance of an
individual.
Mr. Wandro reviewed each of the grievances and referred to
various sections of the union Contract relating to each of the
grievances. He suggested that changes in'work hour should be
dealt with during contract negotiations. Roger Mogle,
Personnel Director, reported that no new jobs had been created
in the Police Department reorganization.
Moved by Roehr, seconded by Penaluna
that the grievances filed by the Clerks in the Police
Department be denied as the Council does not have expertise in the
area. Ayes: Seven.
