Mayor Rooff in the Chair: Roll Call: Getty, Penaluna, Roehr, Wilharm, Dowie, Burton, and Bowers. Invocation by Bowers. 83651 - Moved by Roehr, seconded by Dowie that the Agenda, as proposed, for the Regular Session of February 14, 1983 at 7:00 p.m., be accepted and approved. Motion carried. 83652 - Moved by Burton, seconded by Bowers that the Minutes of the Regular Session held February 7, 1983 at 7:00 p.m. be approved. Motion carried. HEARINGS AND BIDS 83653 - Moved by Dowie, seconded by Burton that proof of publication of notice of bond sale for street improvements for the FY 1982 Paving Program, Contract No. 223 in the amount of $87,000 as published in the Waterloo Courier on January 14 and 21, 1983 be received and placed on file. Motion carried. 83654 - Moved by Wilharm, seconded by Roehr to receive and place on file all unopened sealed bids for said bond sale. Motion carried. 83655 - Open bids were then called for, and there were none. Moved by Wilharm, seconded by Roehr that bidding be closed. Motion carried. 83656 - Moved by Wilharm, seconded by Dowie that the following sealed bids be received, placed on file, but NOT OPENED and sealed bidding closed: Name of Bidder 1. E. F. F. Hutton, of Des Moines", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-42. 83659 - Moved by Wilharm, seconded by Burton that the Clerk/Auditor be instructed to return all unsuccessful bids. Motion carried. ORAL PRESENTATIONS 83660 - Councilman Wilharm, Chairman of the Public Safety Committee, reported the committee's recommendation to close the City Jail, as outlined in Police Chief Huck's letter to the Council and committee. Several questions were raised as to alternatives that had been studied and costs. Chief Huck reported that due to state standards for jails, the City Jail falls short of meeting the required minimums. Moved by Wilharm, seconded by Roehr that the above remarks be received, placed on file and action delayed for one (1) week. Motion carried. REPORTS 83661 - Moved by Roehr, seconded by Getty that the request of the Waterloo Water Works for vacation of portion of W. Donald Street described as lying 183 ft. to the east of the extended westerly right-of-way line of vacated Wagner Road together with Plan & Program Commission's recommendation of approval be received, placed on file and "Resolution setting date of hearing as March 7, 1983 at 7:00 p.m. in the City Hall Council Chambers on above described proposal", be adopted and Clerk/Auditor instructed to publish notice of hearing accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-43. 83662 - The ordinance requires that when the City Engineer denies a curb cut request, the appeal process involves referral to the Plan & Program Commission prior to final council determination. Moved by Burton, seconded by Dowie that request of Bukatz and Associates Realty for curb cut on Sears Street, together with City Engineer's recommendation of denial be received, placed on file and referred to the Plan & Program Commission for review and recommendation. February 14, 1983 DOCUMENTS 83663 - Moved by Roehr, seconded by Burton Page Three that communication from City Engineer transmitting Change Order No. 1 from Lametti & Sons, Inc., for decrease in Contract No. 247, for the FY 1983 Orange Grove Trunk Sewer, Intercity Interceptor, Stage I in the amount of $5,000 together with recommendation of approval be received, placed on file and Mayor and Clerk/Auditor instructed to execute same. Motion carried. 83664 - Moved by Roehr, seconded by Burton that communication from Plan & Program Commission transmitting a Warranty Deed from Joe Minard Construction, Inc., for the north 10' of Lots 44-46, inclusive, of Heartland Hills Addition for future street purposes together with recommendation of approval be received, placed on file and "Resolution approving the Warranty Deed as described above", be adopted and Clerk/Auditor instructed to record same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-44. 83665 - Mike Ryan, Brice, Petrides and Assoc., presented a synopsis of the Crossroads Flood Control Study. Moved by Roehr, seconded by Getty that the Crossroads Flood Control Drainage Study as prepared by Brice, Petrides and Associates together with presentation of said study be received and placed on file. Motion carried. 83666 - Moved by Wilharm, seconded by Penaluna that communication from City Engineer transmitting addendum with the Iowa Department of Transportation to Construction Agreement No. #83-A-077 for Project No. IX -520-6(11)--3P-07 for Freeway 520 together with recommendation of approval be received, placed on file and "Resolution approving said addendum", be adopted and Mayor and Clerk/Auditor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1983-45. 83667 - Moved by Dowie, seconded by Roehr that communication from City Engineer transmitting agreement with the Iowa Department of Transportation for use of Hammond Avenue and Shaulis Road between Highway 21 and Highway 412 for construction of Over -pass at Freeway 520, be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Clerk/Auditor authorized to execute same.
