January 24, 1983
The Council of the City of Waterloo, Iowa, met in Regular Session at
City Hall Council Chambers, Waterloo, Iowa at 7:00 p.m. on January
24, 1983. Mayor Pro -Tem Jack Roehr in the Chair: Roll Call: Getty,
Penaluna, Roehr, Wilharm, Dowie, Burton, Bowers.
Invocation by Wilharm.
83579 - Moved by Dowie, seconded by Bowers
that the Agenda, as amended for the Regular Session of January 24,
1983 at 7:00 p.m., be accepted and approved.
Motion carried.
83580 - Moved by Bowers, seconded by Getty
that the Minutes of the Regular Session held January 17, 1983 at 7:00
p.m. be approved.
Motion carried.
Mayor Pro -Tem Roehr introduced Pack 29 from Castle Hill School
HEARINGS
83581 - Moved by Penaluna, seconded by Burton
that proof of publication of notice of hearing to Rezone from "U-1"
Unclassified District to "M-1" Light Industrial District
approximately 10 acres of land located between W. 15th and W. 18th
and between the flood control levy and Black Hawk Street as published
in the Waterloo Courier on January 7, 1983 be received and placed on
file.
Motion carried.
83582 - Don Temeyer, Plan & Program Director, reported that said change would
allow improvements in an area formerly within the flood plain. The
"M-1" use would be compatible with surrounding uses.
HOLD HEARING --This being the time and place of hearing the Mayor
Pro -Tem called for written and oral objections. There were none.

that "An ordinance amending Ordinance No. 2479, as amended, Zoning
Ordinance, by adding Sub -section No. 203 to Section 2A-5", be
received, placed on file, passed and considered for the first time.
Ayes: Seven.
Motion carried.

that rules requiring ordinances to be considered and voted for
passage at two prior meetings, be suspended, and that above ordinance
be recorded as having been considered and passed for the second and
third times and now placed on its final adoption.

that proof of publication of notice of public hearing to amend
Ordinance No. 2479, as amended, Zoning Ordinance, pertaining to Solar
Collector Systems as published in the Waterloo Courier on January 7,
1983 be received and placed on file.

83585 - HOLD HEARING --This being the time and place of hearing Mayor Pro -Tem
called for written and oral objections There were none.

that "an Ordinance amending Ordinance No. 2479, as amended, known as
the Zoning Ordinance by enacting a new Section known as 2A-48 (L)
Solar Collector Systems under Part XII Exceptions and Modifications",
be received, placed on file, passed and considered for the first
time. Ayes: Seven.
Motion carried.
ORAL PRESENTATIONS
83586 - Don Ball, 910 Forest, explained the employment situation at Hawkeye
Steel for whom the City issued Industrial Development Revenue Bonds.
He reported that an additional 31 persons had been given lay-off
notices effective February 15, 1983. He asked if the City could
assist in relieving the situation in light of the IDR issuance.
Don LeFebre, 1205 Byron, reported that the company's commitments to
building improvements, etc., were not being met.

that the above remarks be received, placed on file, and referred to
the City Attorney for determination of the legal responsibility of
Hawkeye Steel to maintaining operations in Waterloo.

that the request of the Waterloo Cablevision for an increase in Cable
TV rates be received, placed on file and referred to the Cable TV
Commission & City Attorney for review and recommendation.

that the construction plans for the Paving, Storm Sewer, and Sanitary
Sewer Facilities serving Heartland Hills Second Addition, together
with recommendation of approval of the City Engineer be received,
placed on file and approved.

that communication from City Engineer transmitting Change Order No. 2
in conjunction with the FY 1983 Conway Vicinity Parking Ramp,
Contract No. 241 for reduction in contract of $3,777.00 together with
recommendation of approval be received, placed on file, approved and
Clerk/Auditor and Mayor Pro -Tem authorized to execute same.

that communication from City Engineer transmitting an Engineering
Services Contract and Environmental Impact Analysis with Brice,
Petrides and Assoc., Inc., for the Sixth Street Corridor Study at a
cost of $160,000 together with recommendation of approval be
received, placed on file, and "Resolution approving said contract
with Brice, Petrides and Assoc.", be adopted and Mayor Pro -Tem and
Clerk/Auditor authorized to execute same. Ayes: Seven.

that Joint Development Agreement between the City of Waterloo and
Conway Plaza Development Co., in conjunction with the development of
the retail area surrounding the expanded West Side Parking Ramp and
the Waterloo Building together with recommendation of approval of the
Plan & Program Commission and Community Development be received,
placed on file and "Resolution approving said Joint Development
Agreement", be adopted and Mayor Pro -Tem and Clerk/Auditor authorized
to execute same, subject to review & report of the City Attorney.

that request of Black Hawk County for City garbage pick-up at the
Black Hawk County Home at 1407 Independence Avenue, be received,

that "Resolution authorizing the Mayor to accept on behalf of the
City of Waterloo effective January 26, 1983, the assumption of
operation and maintenance responsibilities for the flood protection
devices constructed as Stage V -F of the Corps of Engineers Local
Flood Control Project", be adopted. Ayes: Seven.

together with recommendation of approval be received, placed on file
and "Resolution approving said offer of sale and deed and authorizing
payment accordingly", be adopted. Ayes: Seven.

that "Resolution by the City Council to the City of Waterloo, Iowa,
as the Waterloo Housing Authority, adopting submission of preliminary
application No. three (3) to HUD for comprehensive improvement
assistance Program Funds for modernization of Ridgeway Towers,
IA -50-3", be adopted. Ayes: Seven.

that communication from Plan & Program Commission transmitting the
final plat of Heartland Hills Second Addition, together with
Engineer's Certificate of Survey, Deed of Dedication, Petition and
Waiver, Contract, Warranty Deed, Grant of Temporary Easement, and
Report of the City Engineer together with recommendation of approval
be received, placed on file and "Resolution approving the final plat
of Heartland Hills Second Addition", be adopted. Ayes: Seven.

an "Ordinance amending Chapter 19, Housing Code, of the Code of

Tennessee --cost not to exceed $848.00.
Police Sergeant to attend Inservice Training at the Sioux City and
Des Moines Police Departments, January 24-28, 1983 --cost not to
exceed $270.00 plus use of city vehicle.
City Engineer to attend the University of Wisconsin Extension
course on "Effective Pavement Maintenance", February 14-15, 1983,
