Mayor Rooff in Chair. On Roll Call: Wilharm, Roehr, Penaluna, Getty, Bowers, Burton, Dowie. Invocation by Wilharm 83428 - Moved by Roehr, seconded by Dowie that the agenda, as proposed, for the Regular Session of the December 13, 1982, at 7:00 p.m., be accepted and approved. Motion carried. 83429 - Moved, by Burton, seconded by Bowers that the Minutes of the Regular Session held December 6,'1982 at 7:00 p.m. be approved. Motion carried. PUBLIC HEARINGS 83430 - Moved by Dowie, seconded by Burton that proof of publication of notice of public hearing on vacating the Storm Sewer Easement in Tract H in Cedar Crest Addition as published in the Waterloo Courier on November 29, 1982 be received and placed on file. Motion carried. 83431 - HOLD HEARING --This being the time and place for public hearing the Mayor called for oral and written objections and there were none. Moved by Roehr, seconded by Burton that "An ordinance vacating the Storm Sewer Easement in Tract H in Cedar Crest Addition be received, placed on file, passed and considered for the first time. Ayes: Seven. Motion carried. 83432 - Moved by Burton, seconded by Bowers that proof of publication of notice of public hearing on the vacation, sale and conveyance on an alley between W. 10th and W. 11th Streets.& between Jefferson and Commercial Streets for Varsity Cleaners as published in the Waterloo Courier on November 29, 1982 be received and placed on file. Motion carried. 83433 - HOLD HEARING --This being the time and place for public hearing the Mayor called for oral and written objections and there were none. Moved by Bowers, seconded by Penaluna that "An ordinance vacating alley between W. 10th and W. 11th Streets and between Jefferson and Commercial Streets," be received, placed on file, passed and considered for the first time. Ayes: Seven. Motion carried. Motion carried. 83435 - Moved by Burton, seconded by Dowie that "An ordinance vacating the alley between W. 10th and W. 11th Streets and between Jefferson & Commercial Streets", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 3249. 83436 - Moved by Getty, seconded by Roehr that "Resolution authorizing sale and conveyance of an alley described as lying between W. 10th and W. 11th -Streets and between Jefferson & Commercial Streets to Varsity Cleaners Inc.", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-548. ORAL PRESENTATIONS 83437 - F.J. Lynch, 1181 Cornwall Ave., asked that the Council give consideration to the following concerns before a decision is made to close No. 2 Fire Station -(Byron Avenue): 1. that a decision be made by February 1, 1983 2. that all discussions be public 3. that at least one meeting be held in the affected neighborhood Mayor Rooff stated that the Safety Committee of the Council will be meeting soon, with a decision expected before January 11, 1983. The Mayor reported that Mr. Mike Baker, 1300 Byron, would be. notified of impending meetings. Charles Janss, 226 Sunset, suggested that City employees not be given pay raises in light of the declining economy. As a tax payer, he opposed continually increasing property taxes. Mayor Rooff sited that the City would do its part to hold the line on property tax increases. PETITIONS FROM PUBLIC 83438 - Moved by Dowie, seconded by Getty that petition from area residents on the removal of the No -Parking Signs on State Street be received, placed on: file and referred to the Sign & Traffic Department for review and recommendation. Motion carried. j December 13, 1982 UNFINISHED BUSINESS 83439 - Moved by Roehr, seconded by Getty Page Three that communication from City Engineer transmitting recommendation on the award of construction contract for the FY 1983 Orange Grove Trunk Sewer, Intercity Interceptor, Stage I, Contract No. 247.to Lametti and Sons, Inc, Hugo, Minnesota, in the $960,000.00 be received, placed on file and "Resolution awarding of contract to Lametti and Sons, Inc., Hugo, Minnesota", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-549. REPORTS 83440 - Moved by Burton, seconded by Dowie that City Auditor's Statement for November, 1982 be received and placed on file. Motion carried. DOCUMENTS 83441 - Dale Mercer, Community Development Administrator, reported that this amendment would allow the transfer of $50,000 from the "Administration" line item to the "Smoked Meat/Sliced Bacon Equipment, Freezer, Smokehouses, Relocated Beef Fabrication,, Boxed Beef Equipment and Loading Docks". Moved by Roehr, seconded by Wilharm that communication from Community Development Administrator transmitting amendment to grant agreement for the Rath Urban Development Action Grant, Grant No. B -79 -AA -19-0004 together with recommendation of approval, be received, placed on file and "Resolution authorizing the amendment as stated above to the Rath UDAG Agreement", be adopted and the Mayor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-550. 83442 - Moved by Penaluna, seconded by Wilharm that communication from Plan & Program Commission transmitting the Preliminary Plat of Heartland Hills Second Addition together with deed of dedication, the report of the City Engineer, Resolution of approval of the Waterloo City Plan & Program Commission be received, placed on file and "Resolution approving the Preliminary Plat of Heartland Hills Second Addition", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-551. 83443 - Moved by Wilharm, seconded by Getty that communication from City Engineer transmitting recommendation of acceptance and completion report for the FY 1983 Paving Program, Section III, Contract No. 234 be received, placed on file and "Resolution approving the recommendation of acceptance and completion report on project described above", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-552. ,d-, - -- I December 13, 1982 Page Four ORDINANCES TO BE ADOPTED 83444 - Moved by Wilharm, seconded by Bowers that "An ordinance amending Ordinance No. 2644, known as the Traffic Code, by repealing Section 557A. 10 Minute Parking, in its entirety and by enacting in lieu thereof a new Section 557A, 10 Minute Parking", be received, filed, considered and passed for the first time. Ayes: Six. Nayes: Burton. Motion carried. 83445 - Councilman Burton questioned the change of this ordinance and the affects on adjacent businesses. Moved by Wilharm, seconded by Roehr that rules requiring.ordinances to be considered.and voted for passage at two prior meetings, be suspended, and that above ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Seven. Motion carried. 83446 - Moved by Roehr, seconded by Wilharm that "An ordinance amending Ordinance No. 2644, known as the Traffic Code, by repealing Section 557A, 1.0 Minute Parking, in its entirety and by enacting in lieu thereof a new Section 557A, 10 Minute Parking", be adopted. Ayes Seven,. Ordinance adopted and upon approval by Mayor assigned No. 3250. 83447 - Moved by Wilharm, seconded by Getty that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that below ordinance be 'recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Six. Nayes: Roeh r, Motion carried. 83448 Moved by Wilharm, seconded by Getty that "An Ordinance amending Chapter 34, Utilities, by repealing Subsection (f) regarding sewer rental charges of Section 34-54; and enacting in lieu thereof a new Subsection (f) regarding sewer rental charges of Section 34-54", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 3251. 83449 - Moved by Roehr, seconded by Burton that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, ,and that below ordinance be recorded as having been considered and passed for.the second and third times and now placed on its final adoption. Procedure in connection with the FY 1982 Paving Program, Contract No. 223", be adopted and Clerk/Auditor instructed to publish notice of hearing as January 3, 1983 at 7:00 p.m. in the City Hall Council Chambers on above described proposal.
