Mayor Rooff in the Chair. On Roll Call: Penaluna, Getty, Burton, Dowie. Absent: Wilharm, Roehr, Bowers. Invocation by Getty. 83403 - Moved by Dowie, seconded by Burton, that the Agenda, as amended, for the Regular Session of December 6, 1982, at 7:00 p.m., be accepted and approved. Motion carried. 83404 - Moved by Burton, seconded by Getty that the Minutes of the Regular Session held November 22, 1982 at 7:00 p.m. be approved. Motion carried. Mayor Rooff welcomed Troop 7 of McKinstry Middle School and Webalow Den of Pack 17 from Kingsley Elementary. PUBLIC HEARINGS 83405 - Moved by Penaluna, seconded by Getty that proof of publication of notice of public hearing on the FY 1983 Construction of the Intercity Intercepter, Stage I, Contract No. 247 as published in the Waterloo Courier on November 19, 1982 be received and placed on file. Motion carried. 83406 - HOLD HEARING --This being the time and place of hearing the Mayor called for oral and written objections. There were none. Moved by Getty, seconded by Burton that "Resolution confirming the approval of plans, specifications, etc", be adopted. Ayes: Penaluna, Getty, Burton, Dowie. Absent: Wilharm, Roehr, Bowers. Resolution adopted and upon approval by Mayor assigned No. 1982-536. 83407 - Moved by Burton, seconded by Dowie that "Resolution ordering construction", be adopted. Ayes: Penaluna, Getty, Burton, Dowie. Absent: Wilharm, Roehr, Bowers. Resolution adopted and upon approval by Mayor assigned No. 1982-538. 83411 - Moved by Dowie, seconded by Penaluna that proof of publication of notice of public hearing on Deere Corrider Project as published in the Waterloo Courier on November 29, 1982, be received and placed on file. Motion carried. 83412 - HOLD HEARING --This being the time and place of hearing the Mayor called for written and oral objections. There were none. Moved by Penaluna, seconded by Getty that "Resolution recommending to the Department of Transportation to award contract for construction of Deere Corridor Project", be adopted. Ayes: Penaluna, Getty, Burton, Dowie. Absent: Wilharm, Roehr, Bowers. Resolution adopted and upon approval by Mayor assigned No. 1982-539. The Mayor called for oral presentations and there were none. PETITIONS FROM PUBLIC 83413 - Moved by Getty, seconded by Penaluna that petition for construction of a boat ramp for access to the Cedar River between the Chicago and Northwestern Railroad Bridge and just upstream of Evansdale, be received, placed on file and referred to the City Engineer, Fire Department, Community Development, and Park Department for further review and recommendation. Motion carried. 83414 - Moved by Dowie, seconded by Burton that communication from Plan & Program Commission transmitting request of Clarence Schukei to waive the Declaration of Covenants on parcel of property generally located southwest of the Southerly extended right of way line of Schukei Road and including Tract A of Richland Park together with recommendation of approval be received, placed on file and "Resolution setting date of hearing as December 28, 1982 at 7:00 p.m. in the City Hall Council Chambers on above described request", be adopted and Clerk/Auditor instructed to publish notice of hearing accordingly. RESOLUTIONS TO BE ADOPTED 83416 - Moved by Penaluna, seconded by Dowie that "Resolution fixing date of hearing on the proposed issuance of Clinic Revenue Bonds, Series 1982 in an amount not to exceed $1,000,000 for Dental Specialty Clinic Project as December 28, 1982 at 7:00 p.m. in the City Hall Council Chambers", be adopted and Clerk/Auditor instructed to publish notice accordingly. Resolution adopted and upon approval by Mayor assigned No. 1982-542. 83417 - Moved by Dowie, seconded by Getty that "Resolution by the City Council of the City of Waterloo, Iowa, as the Waterloo Housing Authority, approving revision No. one (1) to its final application for comprehensive improvements assistance program (CIAP) funds for Project No. IA -50-3", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1982-543. 83418 - Moved by Burton, seconded by Penaluna that communication from City Engineer transmitting schedule of abandonment for the FY 1983 Oiling Program, Contract No. 235, together with recommendation of approval be received, placed on file and "Resolution abandoning certain streets and alleys from the FY 1983 Oiling Program, Contract No. 235", be adopted and Clerk/Auditor instructed to certify said abandonment to the County Treasurer. December 6, 1982 Page Four ORDINANCES TO BE ADOPTED 83419 - Moved by Penaluna, seconded by Dowie that "an ordinance amending Chapter 34, Utilities, by repealing subsection (f) regarding sewer rental charges of Section 34-54; and enacting in lieu thereof a new subsection (f) regarding sewer rental charges of Section 34-54", be received, filed, considered, and passed for the first time. Motion carried. 83420 - Moved by Burton, seconded by Getty that" an ordinance amending Ordinance No. 2644, known as the Traffic Code by adding Subsection (145b) Kelly Court to Section 551, parking prohibited at all times on certain streets", be received, filed, considered and passed for the first time. NEW BUSINESS 83422 - Moved by Burton, seconded by Dowie that communication from Electrical Inspector recommending that the 175 Watt White Mercury Vapor Light located at the southeast corner of Cochran Sports Supply building be installed, be received, placed on file and "Resolution authorizing the installation of 175 Watt White Mercury Vapor Light at the southeast corner of Cochran Sports Supply", be adopted and Clerk/Auditor be instructed to notify IPS.
