The Council of the City of Waterloo, Iowa, met in Regular
Session at City Hall Council Chambers, Waterloo, Iowa at 7:00
p.m. on October 4, 1982. Mayor Pro -Tem Roehr in the Chair. On
Roll Call: Wilharm, Roehr,,Penaluna, Getty, Bowers, Burton,
Dowie.
Invocation by Getty.
83178 - Moved by Dowie, seconded by Wilharm
the Agenda, as proposed, for the Regular Session of October 4,
1982, at 7:00 p.m. be accepted and approved.
Motion carried.
83179 - Moved by Burton, seconded by Dowie
the minutes of the Regular Session held September 27, 1982 at
7:00 p.m. be approved.
Motion carried.

83180 - Moved by Wilharm, seconded by Burton
that proof of publication of notice of public hearing on amendments
to Ordinance No. 2479, as amended, Zoning Ordinance, by making
changes in the Off -Street Parking Section of said ordinance as
published in the Waterloo Courier on September 17, 1982, be received
and placed on file.
Motion carried.
83181 - HOLD HEARING --This being the time and place of hearing, the Mayor
Pro -Tem called for written and oral objections and there were none.
Moved by Burton, seconded by Wilharm
that "an ordinance amending Ordinance 2479, known as the Zoning
Ordinance by repealing Subsection B-14, of Section 2A-45
Off -Street Parking Area required under part XIX Parking and
Loading areas, public garages, parking lots and filling
stations; and enacting in lieu thereof a new Subsection B-14,
of Section 2A-45 Off -Street parking area required, under part
XIX parking and loading areas, public garages, parking lots and
filling stations; and enacting new Subsection B-17 of Section
2A-45 Off -Street Parking area required under Part XIX Parking
and Loading areas, public garages, parking lots and filling
stations", be received, filed, considered and passed for the
first time. Ayes: Seven.

that proof of publication of notice of public hearing on
issuance of Industrial Revenue Bonds for Waterloo Industrial
Development Association as published in the Waterloo Courier on
September 17, 1982, be received and placed on file.

83183 - HOLD HEARING --This being the time and place of public hearing
the Mayor Pro -Tem called for oral and written objections and
there were none.
Moved by Wilharm, seconded by Bowers
that "Resolution approving proceeding with the issuance and
sale of not to exceed $750,000 of Industrial Development
Revenue Bonds (Waterloo Industrial Development Association
Project) Series 1982", be adopted. Ayes: Seven.
Resolution adopted and upon approval by Mayor Pro -Tem assigned
No. 1982-453.
ORAL PRESENTATIONS
83184 - Art Polk, 719 W. Donald Street, protested the use of Donald
Street between U.S. Highway 20 and U.S.. Highway 63 for
semi -truck traffic.
Moved by Wilharm, seconded by Bowers
to receive and file the above comments and refer to the Police
Department for review and recommendation.
Motion carried.
Mrs. Lichty protested the removal of the Four -Way Stop at
Ansborough and Ridgemont. This subject matter will discussed
at the Council Meeting of October 11, 1982.
PETITIONS FROM PUBLIC
83185 - Moved by Burton, seconded by Dowie
that communication from City Engineer transmitting request of
Donald E. Myers for construction of temporary concrete driveway
at 503 Belle Street, together with $3 recording fee and
recommendation of approval be received, placed on file and
"Resolution authorizing the construction of a temporary
concrete driveway at 503 Belle Street, irrespective of latter
official grade", be adopted. Ayes: Seven.
Resolution adopted and upon approval by Mayor Pro -Tem assigned
No. 1982-454.
UNFINISHED BUSINESS
83186 - Councilman Bowers reported that the Building and Grounds
Committee was split in its recommendation for construction of a
memorial in honor of slain officers Michael Hoing and Wayne
Rice. Two members recommended that River Road be named in
their honor and that two members recommended the naming of the
Men's Softball Complex in their honor.
Councilman Wilharm reported that he had received several calls
questioning why the memorial was being named for only Hoing &
Rice, when seven (7) officers had been killed in the line of
duty.
Mayor Pro -Tem stated that this administration was naming the
complex for the men killed during their tenure.
Moved by Penaluna, seconded by Dowie
that communication from the Building and Grounds Committee on
the Hoing & Rice memorial be received, placed on file, and
"Resolution approving the naming of the Men's Softball Complex
generally located at the intersection of Longfellow & Walker as
the Hoing & Rice Men's Waterloo Softball Complex", be adopted.
Ayes: Five. Nayes: Wilharm and Bowers.

that communication from Plan and Program Director transmitting
request of the Federal Highway Administration's location
approval for the construction of Hackett Road By -Pass be
received, placed on file and Clerk/Auditor instructed to
publish notice of said location approval.

83188 - John Holmes, City Attorney, reported that this action would
release and discharge the liens created under the mortgage and
security agreement and filings of said bond issue.
Moved by Penaluna, seconded by Burton
that communication from City Attorney transmitting Loan
Termination Agreement; Release, Termination and Discharge; and
UCC Termination Statement for Hawkeye Steel Products Industrial
Development Revenue Bonds, Series 1979 together with
recommendation of approval be received, placed on file and
"Resolution authorizing Mayor Pro -Tem and Clerk/Auditor to
execute said termination with Hawkeye Steel Products," be
adopted. Ayes: Seven.

that communication from City Engineer transmitting Contract
with Fred W. Carlson Company of Decorah, Iowa for crack
repairs to Shaulis Road Pavement together with recommendation
of approval be received, placed on file, approved, and
"Resolution authorizing Mayor Pro -Tem and Clerk/Auditor to
execute same", be adopted. Ayes: Seven.

that construction plans for W. 16th Street Sanitary Sewer
Extension from Black Hawk Street to River Road, together with
Treatment Agreement Form WQ-59,12/78 from the Department of
Environmental Quality and the City Engineer's recommendation
of approval subject to final acceptance of Plans by the
Department of Environmental Quality, be received, placed on
file, recommendation approved and Mayor Pro -Tem and
Clerk/Auditor authorized to execute same. Ayes: Seven.

that "ordinance amending Ordinance No. 2479, as amended, Zoning
Ordinance, by enacting a new sub -section N-4, to section 2A-7
general regulations of Part V, general regulations pretaining
to site development plan amendments for conditional zoning", be
received, placed on file, passed and considered for the second
time. Ayes: Seven.

that communication from Fire Chief, Gerald Olson, recommending
promotions for Lt. Dewayne L. Sevey, to the rank of Captain and
F.E.O. and Robert E. Cutsforth, to the rank of Lieutenant,
effective October 7, 1982, be received, placed on file and
approved.

that communication from Parks Department transmitting
retirement of Mr. Russell Shepard effective September 30, 1982,
and entitlement of payment in the amount of $9,931.32 for 166
hours vacation pay and 120 days unused sick pay, together with
recommendation of approval be received, placed on file and
"Resolution authorizing the payment of $9,931.32 to Russell
Shepard, former employee of the Park Department", be adopted.
