Mayor Pro -Tem Roehr in the Chair. On Roll Call: Wilharm, Roehr, Getty, Bowers, Burton, Dowie. Absent: Penaluna. Invocation by Wilharm. 83141 - Moved by Dowie, seconded by Bowers the Agenda, as amended, for the Regular Session of September 27, 1982, at 7:00 p.m. be accepted and approved. Motion carried. 83142 - Moved by Bowers, seconded by Getty the Minutes of the Regular Session held September 20, 1982 at 7:00 p.m. be approved. Motion carried. HEARINGS 83143 - Moved by Bowers, seconded by Burton that proof of publication of notice of public hearing of site plan review for Black Hawk County Church of Christ generally located north of Cedar Terrace Drive and east of relocated US Highway 218 as published in the Waterloo Courier on September 13, 1982, be received and placed on file. Motion carried. 83144 - HOLD -HEARING --This being the time and place of hearing, the Mayor Pro -Tem asked for oral and written objections and there were none. Moved by Bowers, seconded by Dowie that "Resolution approving the site plan for Black Hawk County Church of Christ generally located north of Cedar Terrace Drive and east of relocated US Highway 218", be adopted. Ayes: Six. Absent: Penaluna. Resolution adopted upon approval by Mayor Pro -Tem assigned No. 1982-439. 83145 - Moved by Burton, seconded by Getty r that proof of notice of public hearing on proposed amendments to Ordinance No. 2479, relating to review of minor and major site plans as published in the Waterloo Courier on Septemer 13, 1982, be received and placed on file. Motion carried. 83146 - HOLD HEARING --This being the time and place the Mayor Pro -Tem called for oral and written objections and there were none. Moved by Getty, seconded by Wilharm that "Ordinance amending Ordinance No. 2479, as amended, Zoning Ordinance, be enacting a new sub -section N-4, to section 2A-7 general i regulations of Part V, general regulations pretaining to site development plan amendments for conditional zoning", be received, placed on file, passed and considered for the first time. Ayes: Wilharm, Roehr, Getty, Bowers, Dowie. Nays: Burton. Absent: Penaluna September 27, 1982 ORAL PRESENTATIONS Page Two 83147 - Mrs. J. Kloberdanz, 840 W. Donald, spoke against taking the 4 -Way Stop Sign out at Donald Street & Burton Avenue. Mrs. Kloberdanz stated it was too dangerous with just a 2 -Way Stop Sign. Moved by Bowers, seconded by Wilharm to receive, place on file comments and hold discussion with the Mayor's Traffic Committee with a report back in two weeks. Motion carried. 83148 - Moved by Bowers, seconded by Dowie to put the Wayne Rice and Michael Hoing Memorial on the October 4, % 1982 agenda. Motion carried. 83149 - Mr. Dave Parkes, 810 Lorraine Ave., presented a petition and spoke against removing the 4 -Way Stop on Ansborough Avenue and Ridgemont. Mr. Parkes continued that the 2 -Way Stop was dangerous with the school and church in the area. Moved by Bowers, seconded by Wilharm to receive, place on file the above comments and refer to the Mayor's Traffic Committee for review. Motion carried. PETITIONS FROM PUBLIC 83150 - Moved by Dowie, seconded by Burton that request of Leo P. Feldman for construction of a turn -around at the end of Pleasant,,,rive and curb cut on the northeasterly end of Pleasant Drive, togetter with City Engineer's recommendation of approval be received, placed on file and approved. Motion carried. 83151 - Moved by Burton, seconded by Getty request of U.S. Marine Reserves for a variance to Noise Ordinance in the vicinity of 1689 Burton Avenue be received, placed on file and adopt "Resolution authorizing a noise variance on October 2, 1982 at approximately 10:00 a.m.", be approved. Ayes: Six. Absent: Penaluna. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1982-440. 83152 - Moved by Bowers, seconded by Dowie that communication from Zoning Commission transmitting request of Larry Bedard to rezone from "R-2" One & Two Family Residence District to "C-1" Commercial district property generally located northeast of the intersection of Linden Avenue and Franklin Street, together with Zoning Commission recommendation of denial, be received, placed on file and "Resolution setting date of hearing as November 1, 1982 at 7:00 p.m. in the City Hall Council Chambers for consideration of above described proposal", be adopted. Ayes: Five. Nays: Burton. Absent: Penaluna. Resolution adopted and upon approval by Mayor Pro -Tem asigned No. 1982-441. REPORTS 83154 - Moved by Dowie, seconded by Getty that communication from Sign and Traffic reporting on petition from residents in the 1200 Block of Westland Avenue together with recommendation to change No Parking Signs from the east side of said street to the west side, be received, placed on file and approve. Ayes: Five. Nayes: Burton. Absent: Penaluna. Motion carried. Discussion followed about reevaluating the system of changing No Parking from one side of the street to the other. 83155 - Moved by Wilharm, seconded by Bowers that communication from Street Superintendent transmitting costs for oiling portions of Campbell Avenue, Home Park Blvd., Kingsley, Orange Grove, and Vernon, be received, placed on file and denied. Motion carried. Dowie stated that the city cannot pick and choose on what streets to oil. It was suggested that these streets be placed in the 1983 Paving Program. DOCUMENTS 83156 - Moved by Burton, seconded by Bowers that communication from City Engineer transmitting Contracts, Bonds, Certificate of Insurance from Cardinal Construction Co., for the FY 1983 Conway Vicinity Parking Ramp, Contract No. 241, together with recommendation of approval, be received, placed on file, approved and "Resolution authorizing Mayor Pro -Tem and Clerk/Auditor to execute same", be adopted. Ayes: Six. Absent: Penaluna. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1982-442. 83157 - Moved by Getty, seconded by Bowers that communication from Community Development Administrator transmitting Change Order No. 2 for David Street Sanitary Sewer Program, Contract No. 236 for an increase in contract of $23.80 together with recommendation of approval be received, placed on file, approved and Mayor Pro -Tem and Clerk/Auditor authorized to execute same. Motion carried. 83158 - Moved by Bowers, seconded by Getty that communication from City Engineer transmitting engineering contract for Section III of the FY 1983 Paving Program, Contract No. 234 from Robinson Engineering Co., together with recommendation of approval be received, placed on file and "Resolution approving engineering contract with Robinson Engineering Co., for Section III the FY 1983 Paving Program, Contract No. 234", be adopted and Mayor Pro -Tem and Clerk/Auditor be authorized to execute same.
