Mayor Pro -Tem Roehr in the Chair. On Roll Call: Wilharm, Roehr, Penaluna, Getty, Bowers, Burton, Dowie. Invocation by Getty 83119 - Moved by Burton, seconded by Bowers that the Agenda, as proposed, for the Regular Session of September 20, 1982, at 7:00 p.m., be accepted and approved. Motion carried. 83120 - Moved by Wilharm, seconded by Dowie that the minutes of the Regular Session held September 13, 1982, at 7:00 p.m., be approved. Motion carried. Mayor Pro -Tem Roehr asked for oral presentations and there were none. PETITIONS FROM PUBLIC 83121 - Moved by Burton, seconded by Bowers that request of D. H. Blattner & Son, Inc., of Avon, Minnesota for variance to Ordinance No. 3094, Noise Ordinance for the purposes of construction in the Hess Road and U.S. Highway 218 in conjunction with I-380 construction together with Police Department's recommendation of approval subject to the applicant completing work at 6:00 p.m. for the area north of Ridgeway Avenue be received, placed on file and "Resolution approving the application of D. H. Blattner & Son, Inc. for variance to Ordinance No. 3094, Noise Ordinance from October 10, 1982 to December 15, 1982," be adopted, subject to Police Department's recommendation. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1982-431. 83122 - Moved by Dowie, seconded by Getty that request of Velma Hansen, 849 Belle Street for temporary concrete driveway without regard to sidewalk grade and Larry E. Weber, 1744 Robin Road for temporary asphalt driveway without regard to sidewalk grade together with $3 each for recording waiver and City Engineer's recommendation for approval, be received, placed on file and "Resolution granting permission to Velma Hansen and Larry Weber to construct temporary concrete and asphalt driveways respectively, irrespective of latter official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1982-432 and 1982-433, respectively. UNFINISHED BUSINESS 83123 - Moved by Dowie, seconded by Bowers that communication from Mayor Leo P. Rooff and Finance Committee recommending payment of Attorney's Fees in the amount $4,884.75 in conjunction with promotional exams for Police Officers Larry Dolan, Harry Helgesen, Mike Beener, Robert Shafer, and Randall Schoenfelder, be received, placed on file and "Resolution approving payment of said Attorney Fees", be adopted. Motion carried. 83125 - Moved by Burton, seconded by Dowie that communication from City Engineer transmitting Change Order No. 2 for FY 1982 Paving Program, Contract No. 223 for decrease in contract of $9,692.31 together with recommendation of approval be received, placed on file, approved and Mayor Pro -Tem and Clerk/ Auditor authorized to execute same. Motion carried. 83126 - Moved by Bowers, seconded by Burton that communication from City Engineer transmitting Contracts, Bonds, Certificate of Insurance from Larry Hope, for the FY 1983 Sidewalk Repair Program, Contract No. 245 together with recommendation of approval, be received, placed on file, approved and "Resolution authorizing Mayor Pro -Tem and Clerk/Auditor to execute same", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1982 - 435. 83127 - Moved by Penaluna, seconded by Wilharm that communication from City Engineer transmitting Contracts, Bonds, Certificate of Insurance from Cedar Valley Corporation for Section I, Dale J. Clark Contracting Co., Section II, Cedar Falls Construction Co., for Section III, of the FY 1983 Paving Program, Contract No. 234, together with recommendation of approval be received, placed on file, approved and "Resolution authorizing Mayor Pro -Tem and Clerk/Auditor to execute same", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1982-436, 437, 438, respectively. REPORTS 83128 - Moved by Burton, seconded by Getty that the City of Waterloo Annual Financial Report for Fiscal Year 1982 indicating collections, receipts, expenditures, and debt limitations be received, placed on file and approved. Motion carried. ORDINANCES TO BE ADOPTED 83130 - Moved by Getty, seconded by Bowers that "an ordinance amending Ordinance No. 2479, as amended, Zoning Ordinance, by adding Sub -Section No. 200 to Section 2A-5, Rezoning Certain Property", be received, placed on file, passed and considered for the second time. Ayes: Seven. (Rezone from "A-1" Agricultural District to "C-2" Commercial District southeast of intersection of of Kimball Avenue and Highway 412). Motion carried. 83131 - Moved by Getty, seconded by Penaluna that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that above ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Five. Nayes: Bowers, Burton. Motion not carried. 83132 - Clarification was made that the first reading of ordinance amendment stated below (CR 83091 of 9/13/82) included only that property recommended by the Zoning Commission (Lots 3-32, Southridge Terrace Addition). Moved by Dowie, seconded by Bowers, that "an ordinance amending Ordinance No. 2479, as amended , Zoning Ordinance, by adding Sub -Section No. 201 to Section 2A-5, Rezoning Certain Property", be received, placed on file, passed and considered for the second time. Ayes: Seven. (Rezone from "R-4" Multiple Family Residence District to "R-2" One and Two Family Residence District --along Kaplan Drive between Hammond Avenue & Bethel St.). Motion carried. Rooff recommending appointment of Mike Schreurs, 131 Prospect Blvd., to the Cablevision Commission, with term expiration of December 1, 1984, be received, placed on file and approved.
