Mayor Pro -Tem Roehr in the Chair. On Roll Call: Present: Getty, Roehr, Wilharm, Burton, Dowie. Absent: Penaluna and Bowers. Invocation by Wilharm. 82943 - Moved by Burton, seconded by Dowie that agenda, as amended, for the Regular Session of August 16, 1982, at 7:00 p.m., be accepted and approved. Motion carried. 82944 - Moved by Wilharm, seconded by Getty that the minutes of the Regular Session held August 9, 1982 at 7:00 p.m., be approved. Motion carried. ADJOURNED HEARINGS Mayor Pro -Tem Roehr announced that the time had arrived for additional comments on the changing of speed limits on certain streets in the City of Waterloo (see CR #82907 of 8/9/82). No additional comments were heard (see CR #82971 for additional action). Motion carried. 82946 - HOLD HEARING --This being the time and place of hearing, the Mayor Pro -Tem called for written and oral objections and there were none. Moved by Getty, seconded by Dowie that "Resolution determining to proceed with the issuance of not to exceed $400,000 Urban Revitalization Area Revenue Bonds, Series 1982 (Swisher and Cohrt Law Office Project) of the City of Waterloo, Iowa," be adopted. Ayes: Five. Absent: Penaluna & Bowers. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1982-369. 82947 - Moved by Dowie, seconded by Burton that proof of publication of notice of public hearing on request of Vern Halverfson to rezone from "R-3" Multiple Family Residence District to "C -Z" Conditional Zoning property generally located Northwest of Intersection of Shannon Court and Washington Street as published in the Waterloo Courier on August 10, 1982, be received and placed on file. Ayes: Five. Absent: Penaluna & Bowers Motion carried. 82949 - Moved by Burton, seconded by Wilharm that proof of publication of notice of public hearing on sale of Disposal Parcel I-24, 317 E. First Street as published in the Waterloo Courier on August 10, 1982, be received and placed on file. Motion carried. 82950 - HOLD HEARING --This being the time and place of hearing, the Mayor Pro -Tem called for written and oral objections and there were none. Moved by Wilharm, seconded by Dowie thata "Resolution approving the sale of Disposal Parcel I-24 in the Westfield -Virden Urban Renewal Area, Project No. R-7, and authorizing the execution of the necessary contract for sale of land for private redevelopment and deed", be adopted. Ayes: Five. Absent: Penaluna & Bowers. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1982-370. 82951 - Moved by Dowie, seconded by Burton that proof of publication of notice of public hearing on a proposed resolution of necesssity for FY 1983 Paving Program, Contract No. 234,as published in the Waterloo Courier on August 3 and 10, 1982, be received and placed on file. Motion carried. 82952 - HOLD HEARING --This being the time and place of hearing, the Mayor Pro -Tem called for written and oral objections. The Deputy City Clerk reported that petitions had been filed with the Clerk's Office and had been referred to the City Engineer's for review. Mayor Pro -Tem Roehr stated that objections would be heard on a street by street basis. Mayor Pro -Tem Roehr asked for oral objections to each of the streets described below. Moved by Getty, seconded by Dowie that Hartman from Knoll to Cleveland, be included in the FY 1983 Paving Program, Contract No. 234. Motion carried. 82955 - Ed Kleiner, 1116 Lincoln, questioned the work that would be completed with an "Underground Assessment". Moved by Getty, seconded by Burton that Lincoln from Parker to W'loo RR be included in the FY 1983 Paving Program, Contract No. 234. Motion carried. 82956 - Mrs. William Christofferson, 320 Monroe St.:, suggested that a 4" layer of asphalt may be sufficient surfacing. The daughter of the occupant at 330 Monroe asked if the trees on said property would be replaced. Moved by Getty, seconded by Wilharm that Monroe from Arizona to Idaho, be included in the FY 1983 Paving Program, Contract No. 234. Motion carried. 82957 - Moved by Getty, seconded by Burton that Oneida from Mobile to Beech be included in the FY 1983 Paving Program, Contract No. 234. Motion carried. 82958 - A resident of the Lamont -Prince Street area suggested that Lamont Street be included in the Paving Project. Moved by Getty, seconded by Burton that Prince from Lamont to Wyoming be included in the FY 1983 Paving Program, Contract No. 234. Motion carried. Moved by Getty, seconded by Burton that Reed from Arlington to W'loo RR be included in the FY 1983 Paving Program, Contract No. 234. Motion carried. 82960- Moved by Burton, seconded by Getty that Linbud from Alabar to Sager be included in the FY 1983 Paving Program, Contract No. 234. Motion carried. 82961 - The City Engineer reported that the petitions of opposition on Howrey St. represented 27% of the abutting property owners. Moved by Burton, seconded by Getty that Howrey from University to Janney be included in the FY 1983 Paving Program, Contract No. 234. Motion carried. 82962 - Moved by Burton, seconded by Dowie that all written and oral objections be received, placed on file, and that the hearing be adjourned. Motion carried. 82963 - Moved by Dowie, seconded by Burton that all objections to FY 1983 Paving Program, Contract No. 234, be overruled. Motion carried. 82964 - Moved by Getty, seconded by Dowie that "Resolution adopting Resolution of Necessity, as proposed for the FY 1983 Paving Program, Contract No. 234," be adopted. Ayes: Five. Absent: Bowers & Penaluna. Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1982-372. 82965 - Moved by Dowie, seconded by Burton that "Resolution directing Engineers to prepare detailed plans and specifications and directing Attorney to prepare form of contract and notice to bidders on the Fy 1983 Paving Program, Contract No. 234", be adopted. August 16, 1982 HEARINGS CONTINUED 82966 - Moved by Wilharm, seconded by Dowie Page Five that City Engineer's detailed plans, specifications, form of contract, form of proposal, preliminary estimate of cost, etc., and notice to bidders for the FY 1983 Paving Program, Contract No. 234, be received, placed on file and "Resolution ordering bids, approving plans, specifications and form of contract and notice to bidders, fixing amount of bid security and ordering Clerk to publish notice and fixing a date of receiving same, and for a public hearing,on plans, specifications, form of contract and estimate of costs", be adopted and date set as September 7, 1982 at 7:00 p.m. in the City Hall Council Chambers. Ayes: Five. Absent: Penaluna & Bowers. Resolution adopted and upon approval by Mayor Pro -Tem, assigned No. 1982-374. UNFINISHED BUSINESS 82967 - Moved by Wilharm, seconded by Dowie that communication from City Engineer transmitting plans, specifications etc., for the FY 1983 Conway Vicinity Parking Ramp, Contract No. 241, be received, placed on file, and "Resolution setting date of hearing on the FY 1983 Conway Vicinity Parking Ramp, Contract No. 241, as September 7, 1982, at 7:00 p.m. in the City Hall Council Chambers", be adopted and Deputy City Clerk be instructed to publish notice of hearing accordingly. REPORTS 82968 - Moved by Burton, seconded by Dowie that the minutes of the Community Board Meeting of July 13, 1982, be received and placed on file. Motion carried. 82969 - Moved by Burton, seconded by Dowie that the Building Department Annual Report for Fiscal Year 1982 be received and placed on file. Motion carried. DOCUMENTS 82970 - Moved by Dowie, seconded by Getty that communication from Plan and Program Director transmitting Supplemental Agreement No. 3 for the East Side Parking Ramp Project with Brice, Petrides and Associates, together with recommendation of approval be received, placed on file and "Resolution authorizing the Mayor Pro -Tem to execute said contract", be adopted. August 16, 1982 ORDINANCES TO BE ADOPTED Page Six 82971 - Mayor Pro -Tem Roehr stated that comments on the proposed speed limit change would now be heard. Councilman Burton objected to the increase in speed limit on W. 3rd Street from Washington and Sergeant. Moved by Burton, seconded by Wilharm that the speed limit on W. 3rd Street from Washington to Sergeant be 25 mph. Motion carried. 82972 - Councilman Burton objected to the increase in speed limit on Ansborough Avenue from Highway 412 to Ridgeway due to the adjacent residential uses. Moved by Burton, seconded by Getty that the speed limit on Ansborough Avenue from Highway 412 to Ridgeway be 30 mph. Motion carried. 82973 - Discussion was heard on the removal of the stop sign at Kimball & W. 3rd Street. Moved by Burton, seconded by Getty that the stop sign at Kimball Avenue and W. 3rd Street not be removed. Motion carried. 82974 - Moved by Dowie, seconded by Burton that the speed limit on W. 4th Street from Wellington Street to the southerly corporate limits be 30 mph. Motion carried. 82975 - Councilman Dowie reported that he had received objections to increasing speed limits on Orange Road. Moved by Dowie, seconded by Burton that the speed limit on Orange Road from the westerly corporate limits to Kimball Avenue be 25 mph.
