Mayor Rooff in the Chair. On Roll Call: Present: Getty, Penaluna, Roehr, Wilharm, Bowers, Burton. Absent: Dowie. Invocation by Councilman Wilharm. 82825 - Moved by Roehr, seconded by Wilharm the Agenda, as proposed, for the Regular Session of July 26, 1982 at 7:00 p.m., be accepted and approved. Motion carried 82826 - Moved by Burton, seconded by Bowers that the minutes of the Regular Session held July 19, 1982, at 7:00 p.m, be approved. Motion carried. PUBLIC HEARINGS 82827 - Moved by Roehr, seconded by Burton that proof of publication of notice of public hearing on Amendments to Ordinance No. 2479, as amended, by Zoning Ordinance --Changes in the "U-1" Unclassified Districts as,published in the Waterloo Courier July 15, 1982, be received and placed on file. Motion carried. 82828 - HOLD HEARING --This being the time and place of said hearing, the Mayor called for written and oral objections and there were none. Moved by Burton, seconded by Getty that "An Ordinance No. 2479, as amended, Zoning Ordinance --Changes in the "U-1" Unclassified Districts, be received, placed on file considered & passed for the first time. Ayes: Six. Absent: Dowie. Motion carried ORAL PRESENTATIONS 82829 - John Richards, 518 Candlewick, stated that he was stopped from building a breezeway between his house and garage by the Building Department. He is here at the Council meeting asking that the Council allow him to build said breezeway. Mayor Rooff explained that -his next action would be to the Board of Adjustment. Moved by Wilharm, seconded by Roehr to receive and file the above comments and refer Mr. Richards to the Board of Adjustment for further action. PETITIONS FROM PUBLIC 82830 - Moved by Bowers, seconded by Burton request from John R. Rooff, III and John Rooff, Jr., to purchase Disposal Parcel No. I-24, 317 E. First Street, in the Westfield - Virden Urban Renewal Area, Project Iowa R-7 be received and placed on file and "Resolution setting a date of hearing as of August 9, 1982 at 7:00 p.m. in the City Hall Council Chambers on sale of the above described property" be adopted and City Clerk/Auditor instructed to publish notice of hearing accordingly. Ayes: Six Absent: Dowie Resolution adopted and upon approval by Mayor, assigned No. 1982-326. 82832 - Moved by Getty, seconded by Wilharm that request of Reorganized Church of Jesus Christ of Latter Day Saints, 1509 Rainbow Drive, to construct temporary asphalt driveway without regard to sidewalk grade, together with $3 for recording waiver, together with City Engineer's recommendation for approval be received, placed on file and "Resolution granting permission to Reorganized Church of Jesus Christ of Latter Day Saints, 1509 Rainbow Drive, to construct temporary asphalt driveway irrespective of side- walk grade", be adopted." Frost, 329 Derbyshire Road, to construct temporary concrete driveway without regard to sidewalk grade, together with $3 for recording waiver, together with City Engineer's recommendation of approval, be received, placed on file & "Resolution granting permission to Irwin J. REPORTS 82834 - Moved by Penaluna, seconded by Bowers to receive and file the communication from the Reorganization and Evaluation Committee and appoint John Holmes as the City Attorney for the City of Waterloo at an annual salary of $21,466. Motion carried 82835 - Moved by Bowers, seconded by Getty that communication from the Mayor's Committee studying speed limits within the City of Waterloo be received and placed on file and "Resolution setting date of hearing as of August 6, 1982, at 7:00 p.m. at City Hall Council Chambers", be adopted and City Clerk instructed to publish notice of hearing accordingly. July 26, 1982 RESOLUTIONS TO BE ADOPTED 82844 - Moved by Penaluna, seconded by Getty Page Four that resolution authorizing the execution of a Memorandum of Agreement between the City of Waterloo and Swisher and Cohrt Building Partnership, in regard to the issuance of Urban Revitalization Area Revenue Bonds of approval be received, placed on file and "Resolution approving the Memorandum of agreement between the City of Waterloo and Swisher and Cohrt Building Partnership" be adopted. Ayes: Six Absent: Dowie Resolution adopted and upon approval by Mayor, assigned No. 1982 -335. 82845 - Moved by Penaluna, seconded by Getty that "Resolution Fixing a date of hearing on proposed Urban Revitalization Area Revenue Bonds, not to exceed $400,000 series 1982 (Swisher and Cohrt Law Office Project) as of August 16, 1982 7:00 p.m. City Hall Council Chambers, Waterloo, Iowa" be adopted. City Clerk/Auditor be instructed to publish notice accordingly Ayes: Six Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 1982-336. 82846 - The Mayor stated that he would like to suggest that the new Recreation Complex that will be voted on in the near future be named the Hoing & Rice Memorial Recreational Complex. Mayor Rooff continued that he would further suggest that a memorial placque be placed outside City Hall in memory of the other persons that have lost their lives in the line of duty for the City of Waterloo. ORDINANCES TO BE ADOPTED 82847 - Moved by Wilharm, seconded by Bowers that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that an ordinance amending Ordinance No. 2479, as amended, by adding Sub -section No. 199-2A-5, Rezoning Certain Property be recorded as having been considered and passed for the second and third times and now placed on its final adoption.
