Mayor Rooff in the Chair. On Roll Call: Present: Getty, Penaluna, Roehr, Wilharm, Bowers, Burton, Dowie. Invocation by Councilman Getty. 82784 - Moved by Roehr, seconded by Wilharm that agenda, as proposed, for the Regular Session of July 19, 1982 at 7:00 p.m., be accepted and approved. Motion carried. 82785 - Moved by Burton, seconded by Wilharm that the minutes of the Regular Session held July 12, 1982 at 7:00 p.m. be approved. Motion carried. 82786 - Moved by Burton, seconded by Wilharm that the minutes of the Special Meeting held July 15, 1982 at 11:00 a.m. be approved. Motion carried. PUBLIC HEARINGS 82787 - Moved by Roehr, seconded by Wilharm that proof of publication of notice of public hearing on proposal to vacate, sell, and convey an alley in Ricker & Bratnober's Land Company Addition, as published in the Waterloo Courier on July 9, 1982, be received and placed on file. Motion carried. 82788 - HOLD HEARING --This being the time and place of said hearing, the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Burton that "An Ordinance vacating an alley lying north of Riehl Street and west of Lots 10 and 11 Block 1, in Ricker and Bratnober's Land Company Addition," be received, placed on file, considered & passed for the first time. Ayes: Seven Motion carried. 82789 - Moved by Roehr, seconded by Wilharm that proof of publication of notice of public hearing on proposal to rezone from "U-1" Unclassified District to "C-2" Commercial District property in Section 12-88-13, as published in the Waterloo Courier on July 2, 1982, be received and placed on file. Motion carried. Moved by Wilharm, seconded by Burton that "An Ordinance amending Ordinance No. 2479, as amended, by adding Subsection No. 199 to Section 2A-5, Rezoning Certain Property", be received, placed on file, considered and passed for the first time. Ayes:- Seven. Motion carried. 82791 - Moved by Burton, seconded by Wilharm that proof of publication of notice of public hearing on proposal to rezone from "R-2" One & Two Family Residence District to "C-2" Commercial District a parcel of property at the southeast corner of intersection of Minnesota Street and Williston Avenue. as published in the Waterloo Courier on July 2, 1982, be received and placed on file. Motion carried. HOLD HEARING --This being the time and place of hearing, the Mayor called for written and oral objections. 82792 - Moved by Burton, seconded by Wilharm that petition of remonstrance signed by 9% of the property owners within 250' be received and placed on file. Motion carried. 82793 - Mr. Robert Shaver owner of property spoke on behalf of the rezoning. Mr. Shaver stated that he was planning to put an Antique Shop at this location. Moved by Wilharm, seconded by Burton that "An Ordinance amending Ordinance No. 2479, as amended, by adding Subsection 200 to Section 2A-5, Rezoning Certain Property," be received and placed on file and denied. Motion carried. 82794 - Moved by Roehr, seconded by Penaluna that proof of publication of notice of public hearing on proposal to rezone from "R-2" One & Two Family Residence District to "C-2" Commercial District for a parcel of property located at northeast corner of Linden Avenue & Franklin Street as published in the Waterloo Courier on July 2, 1982, be received and placed on file. Motion carried. July 19, 1982 Page Three PUBLIC HEARING CONTINUED: 82795 -HOLD HEARING --This being the time and place of hearing, the Mayor called for written and oral objections. Moved by Bowers, seconded by Roehr, that petition of remonstrance signed by 39% of the property owners located within 250' be received and placed on file. Motion carried. 82796 - Mr. Larry Bedard, 1938 Franklin, and owner of this property, spoke on behalf of the rezoning. Mr. Bedard stated that he was planning to construct a Hardware Store, Drug Store, etc. Mr. Bedard continued that his new development will increase tax revenue and add new employment. Mr. Bedard then stated that if it would help pass this rezoning through, he would suggest dropping the rezoning request from "C-2" to "C-1" zoning. Moved by Getty, seconded by Dowie that "An ordinance amending Ordinance No. 2479, as amended, by adding Sub- section 201, to Section 2A-5, Rezoning, Certain Property," be received and placed on file and refered back to the Zoning Commission for consideration as a C-1 zoning. Motion carried. 82797 - Moved by Getty, seconded by Bowers That proof of publication of notice of public hearing on proposal to rezone from "R-2" One and Two Family Residence District to "R-4" Multiple Family. A parcel of property located at the southeast corner of East Ridgeway Avenue and Ohio Street, as published in the Waterloo Courier on July 2, 1982, be received and placgd on file. Motion carried. 82798 - HOLD HEARING --This being the time and place of hearing the Mayor called for written and oral objections. Moved by Burton, seconded by Bowers, that petition of remonstrance signed by 70% of the property owners within 250' be received and placed on file. Motion carried. 82799 - Anita M. Andries, 2250-1/2 Logan Avenue, owner of property to be rezoned, spoke on behalf of the rezoning. Mrs. Andries stated that she would like to use her property for her Real Estate Office plus live there. Leo L. Stern, 1756 E. Ridgeway Avenue, spoke against the rezoning. Mr. Stern pointed out various water problems in the area. Moved by Burton, seconded by Roehr, that an ordinance amending Ordinance No. 2479, as amended by adding Subsection 202 to Section 2A-5, Rezoning Certain Property", be received and placed on file and denied. Ayes: Six. Nays: Getty. Motion carried. July 19, 1982 Page Four PETITIONS FROM PUBLIC 82800 - Moved by Getty, seconded by Penaluna To record and file a petition submitted to the City Engineer July 31, 1979 for paving of 400, 500, 600, and 700 Blocks of Hope Avenue and asked that a report be made to the Council at the August 26, 1982 meeting. Motion carried. 82801 - Councilman Bowers reported that he would like to see the three-way stop removed from the corner of Monroe and Idaho Street and replace with stop signals at a cost of $2,370.42 as reported by the City Electrician. Moved by Bowers, seconded by Wilharm to receive and place on file the above reports of the City Electrician and proceed with the work, and instruct the City Attorney to revise the City Traffic Ordinance to reflect the change. Motion carried. 82802 - Moved by Dowie, seconded by Bowers to receive and place on file a report of the Iowa Department of Transportation in regards to placing a New Jersey shape rigid barrier on U.S. Highway 20 near Newton Street and adopt "Resolution setting date of hearing as of August 20, 1982 at 7 P.M. at City Hall Council Chambers", be adopted and City Clerk instructed to publish notice of hearing accordingly. Ayes: Seven Resolution adopted and upon approval by Mayor, assigned No. 1982-314A 82803 - Moved by Wilharm, seconded by Bowers that request of Lynn B. Crowe, 1700 Hawthorne Avenue, 1814 W. 11th Street, Howard E. Ott, 218 Zelmar Drive, and Marjorie D. Turner, 800 Lorraine Avenue to construct temporary concrete driveways without regard to sidewalk grade, together with $3 for recording waiver together with City Engineer's recommendation of approval, be received, placed on file and "Resolution granting permission to Lynn B.Crowe, 1700 Hawthorne Avenue, 1814 W. 11th Street, Howard E. Ott, 218 Zelmar Drive,& Marjorie D. Turner, 800 Lorraine Avenue, to construct temporary concrete driveways irrespective of latter official grade", be adopted. Ayes: Seven Resolution adopted and upon approval by Mayor, assigned Nos. 1982-315, 1982-316, 1982-317, 1982-318. Motion carried. 82805 - Moved by Burton, seconded by Penaluna that communication from City Enineer transmitting request of Locke Funeral Home, Inc., 1519 W. 4th Street to asphalt the alley adjoining said property together with recommendation of approval subject to certain conditions be received placed on file and approved. Ayes: Seven. Motion carried. 82806 - Moved by Bowers, seconded Dowie "Resolution setting a date of hearing to issue $1,000,000 IDR Refunding Bonds (American Buildings Company Project) Series 1982 as August 9, 1982" be adopted. Ayes: Seven. Resolution adopted and upon apporoval by Mayor, assigned No. 1982-319. 82807 - Moved by Wilharm, seconded by Burton that communication from Sign & Traffic transmitting recommendation of speed reduction on Hammond Avenue from San Marnan Drive to the 4600 Block of Hammond Avenue from 35 mph to 25 mph, be received, placed on file and referred to the City Attorney for submission of an ordinance accordingly. Motion carried. 82808 - Moved by Roehr, seconded by Getty that communication from Community Development Administrator requesting approval to resubmit Urban Development Action Grant for Conway Plaza by increasing loan to developer (Conway Plaza Inc.) in an amount of $475,000 be received, placed on file and approved. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 1982-320. 82809 - Moved by Burton, seconded by Wilharm that minutes of Community Developement Board meeting of June 15, 1982 be received and placed on file. Motion carried. 82810 - Moved by Bowers, seconded by Burton that commuinication from City Engineer transmitting recommendation of acceptance on street improvements in conjunction with E. Donald Street access road, together with 2 year maintenance bond for storm sewer and paving, be received, placed on file and approved. Motion carried. July 19, 1982 UNFINISHED BUSINESS 82811 - Moved by Roehr, seconded by Getty Page Six that communication from Fire Chief reporting retirement of Frederick W. Timmerman effective July 8, 1982 and entitlement of $14,217.07 vacation pay and sick leave, together with recommendation of approval, be received, placed on file and "Resolution approving payment of $14,217.07 vacation pay and sick leave to Frederick W. Timmerman, of the Fire Department", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-321. 82812 Moved by Roehr, seconded by Getty that communication from Fire Chief reporting retirement of Eugene L Bernstein effective July 8, 1982 and entitlement of $14,173.12 vacation pay and sick leave, together with recommendation of approval, be received, placed on file, and "Resolution approving payment of $14,173.24 vacation pay and sick leave to Eugene L. Bernstein of the Fire Department", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-322. 82813 - Moved by Burton, seconded by Bowers that communication from Electrical Inspector transmitting recommendation on locations of various street lights be received, placed on file, and "Resolution authorizing installation of 175 watt White Mercury Vapor lights at the following locations: One at dead-end of cul-de-sac on Colby Road One at intersection of Colby Road and Colby Road which is at the south lot line of 1026 Colby Road One at Southwest corner of W. Shaulis Road and Hammond Avenue One at northeast corner of High 21 and W. Shaulis Road One at southeast corner of High 21 and W. Shaulis Road," be adopted and Clerk/Auditor instructed to notify Iowa Public Service. Ayes: Seven Resolution adopted and upon approval by Mayor assigned No. 1982-323. 82814 - Moved by Bowers, seconded by Getty that communication from City Engineer transmitting plans, specifications, etc., for the F. Y. 1983 Pinehurst Drainage Improvements, Schedule II, Contract No. 242, be received, placed on file and "Resolution setting date of hearing on the F.Y. 1983 Pinehurst Drainage Improvements. Schedule II, Contract No. 242, as August 2, 1982 at 7:00 p.m. in the City Hall Council Chambers" be adopted and Clerk be instructed to publish notice of hearing accoringly. Motion carried. 82823 - Statement was made that a possible Memorial to the Police that have lost their lives in the line of duty for the City of Waterloo. The City should change the name of the baseball field to reflect the memory. Moved by Bowers, seconded by Wilharm that the above recommendation be received and placed on file.
