Mayor Pro -Tem Roehr in the Chair. On Roll Call: Present: Getty, Penaluna, Roehr, Wilharm, Bowers, Burton, Dowie. Invocation by Councilman Wilharm. 82631 - Moved by Dowie, seconded by Burton that the Agenda, as amended, for the Regular Session of June 21, 1982 at 7 P.M. be accepted and approved. Motion carried. 82632 - Moved by Burton, seconded by Bowers that the minutes of the Regular Session held June 14, 1982 at 7 P.M. be approved. Motion carried. HEARINGS 82633 - Moved by Burton, seconded by Getty that proof of publication of notice of public hearing on sale of Disposal Parcel No. A-15, 817 Logan Avenue to Della M. Randolph as published in the Waterloo Courier on June 11, 1982 be received and placed on file. Motion carried. 82634 - HOLD HEARING --This being the time and place of hearing, the Mayor Pro -Tem called for written and oral objections and there were none. Moved by Wilharm, seconded by Bowers that "Resolution approving the sale of Disposal Parcel No. A-15 in the Westfield -Virden Urban Renewal Area, Project No. Iowa -R-7, and authorizing execution of the necessary contract for sale of land for private redevelopment and deed", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro -Tem, assigned No. 1982-254. 82635 - Moved by Dowie, seconded by Wilharm that the hearing on the revocation of the Peddler's License of Brian C. Friedman be delayed for one (1) week to allow proper notification of said peddler. Motion carried. ORAL PRESENTATIONS 82636 - Moved by Bowers, seconded by Wilharm that the contract with Wayne Claassen Engineering and Surveying, Inc. for F.Y. 1983 Fowler Street Sanitary Sewer Improvements, Phase II, Contract No. 238, referred to under C.R. 82600 of June 14, 1982, be placed on the agenda of June 28, 1982. Motion carried. 82637 - Councilman Bowers asked that a building demolition report be supplied to the Council, particularly, the status of the Lafayette and Washington Buildings. Moved by Burton, seconded by Dowie that the request of J.C. Feed Mills to resurface and blacktop Mitchell Avenue and Sheffield Avenue (east of U.S. Highway 218), be received, placed on file and referred to the Street and Engineering Departments. Motion carried. June 21, 1982 Page Two 82638 - Several residents complained of the encounters they have had with Waterloo Cablevision with bill payment and service. Those appearing and airing these concerns were Pat Gilbertson, 442 Reber Avenue, and Lucille Ennenga, 506 West Wellington. Councilman Burton suggested that he and the Cable TV Commission would be interested in investigating the above situation. Moved by Getty, seconded by Wilharm that the above remarks be received, placed on file, and referred to Councilman Burton for discussion with the Cable TV Commission. Motion carried. PETITIONS FROM PUBLIC 82639 - Moved by Bowers, seconded by Dowie that communication from'City Engineer transmitting petition of area residents requesting paving of the 600 Block of Fowler Street, between Rhey and Vinton Streets, together with recommendation for referral to the Community Development Board for inclusion in future paving program be received, placed on file and approved. Motion carried. 82640 - Moved by Burton, seconded by Getty that communication from City Engineer transmitting petition of area residents requesting paving of the 1100 Block of Dundee Avenue, between Janney and University Avenues, together with recommendation for referral to the Community Development Board for inclusion in future paving program, be received, placed on file and approved. Motion carried. 82641 - Moved by Getty, seconded by Bowers that communication from City Engineer transmitting petition of area residents requesting paving of Edison Street, between Burton Avenue and Avon Street and Thomas Avenue, together with recommendation for referral to the Community Development Board for inclusion in future paving programs, be received, placed on file and approved. Motion carried. 82642 - Moved by Wilharm, seconded by Getty that request of David J. Schaefer, 150 Sidehill Drive and Earl T. Bean, 120 Vegas Court to construct temporary concrete driveways without regard to sidewalk grade, together with $3 each for recording waiver and City Engineer's recommendation of approval, be received, placed on file, approved and "Resolution granting permission to David J. Schaefer, 150 Sidehill Drive and Earl T. Bean, 120 Vegas Court to construct temporary concrete driveways irrespective of latter official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro -Tem, and assigned No. 1982-257. 82644 - Moved by Getty, seconded by Dowie that "Resolution of Necessity, as amended, for the F.Y. 1983 Oiling Program, Contract No. 235", be adopted (deletion of alley between Fletcher Avenue, Columbia Circle, Elston Avenue and Kingbard Avenue). Ayes: Seven. Resolution adopted and upon approval by Mayor Pro -Tem, assigned No. 1982-258. 82645 - Moved by Burton, seconded by Bowers that plats, schedule of assessments, etc. for the F.Y. 1983 Oiling Program II, Contract No. 243, prepared by the City Engineers, be received, placed on file and "Resolution adopting proposed plat and schedule, estimate of cost, etc. for F.Y. 1983 Oiling Program I1, Contract No. 243", be adopted. Resolution adopted and upon approval by Mayor Pro -Tem, assigned No. 1982-259. 82646 - Moved by Bowers, seconded by Getty that "(proposed) Resolution of Necessity for the F.Y. 1983 Oiling Program II, Contract No. 243", be adopted and Clerk/Auditor instructed to publish notice of hearing as July 12, 1982 at 7 P.M. in the City Hall Council Chambers. REPORTS 82647 - Moved by Penaluna, seconded by Bowers that minutes of Community Development Board meeting held on May 11, 1982, be received and placed on file. Motion carried. DOCUMENTS 82648 - Moved by Getty, seconded by Bowers that communication from City Engineer transmitting contract, bond and certificate of insurance from Seals Construction for F.Y. 1982 Sidewalk Repair Program, Sections I and II, Contract No. 233, together with recommendation of approval, be received, placed on file, approved and "Resolution approving the contract and bond for Seals Construction for the above described contract", be adopted and Mayor and City Clerk/Auditor authorized to execute same. Hershberger, doing business as Hershberger Development, regarding the issuance of Qualified Urban Renewal Area Revenue Bonds", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro -Tem, assigned No. 1982-264. 82652 - Moved by Penaluna, seconded by Bowers that "Resolution fixing a date for hearing on proposed Qualified Urban Renewal Area Revenue Bonds, Series 1982, (Hershberger Development Project) as July 12, 1982 at 7 P.M. in the City Hall Council Chambers", be adopted and Clerk/Auditor instructed to publish notice of hearing accordingly. Kennedy located northwesterly of the Chicago Northwestern Railroad and between Campbell and Hollywood Avenues", be adopted and City Attorney instructed to prepare deed accordingly. Ayes: Seven. MISCELLANEOUS 82668 - Councilman Getty raised several questions regarding the issuance of a Beer and Liquor License Permit (Class C) for Urban Enterprises, Inc., dba Charlie Brown's, 120 Sumner, relating to compliance with City Building regulations. Mr. Roosevelt Roby, applicant for said establishment, stated that the necessary inspections had been completed. Curt Parsons, Building Official, reported that several permits including heating, and electrical had not been issued.
