HomeMy WebLinkAbout03/15/82March 15, 1982 The Council of the City of Waterloo, Iowa, met in Special Session at City Hall Council Chambers, Waterloo, Iowa at 7:00 P.M., on March 15, 1982. Mayor Rooff in the Chair. On Roll Call: Present: Getty, Penaluna, Roehr, Wilharm, Bowers, Burton, Dowie. Mayor Rooff requested that action on the lease with McElroy Auditorium be delayed until April 5, 1982, pending further review with the Conway/McElroy Board of Directors. A section will be included in the lease to allow the City to withdraw from the lease at any time, given adequate notice to the leasor. Harold Getty, Chairman of the Public Works Committee, reported on his and Mr. Jim Burton's observation of sewer cleaning equipment in Milwaukee. He described the Vac -All as being a multi-purpose machine capable of performing well under stressful conditions. The recommended purchase is $15,000 over the other bid. The Finance Committee will act on its purchase. Since the lease for the East Side Library has been negotiated with the Hawkeye Valley Area Agency on Aging, they have requested use of additional space in the basement without a change in the lease arrangement. It was moved by Getty, seconded by Wilharm to allow Hawkeye Valley Area Agency on Aging to utilize a portion of the basement of the East Side Library at no additional cost. Ayes: Two. Nayes: Burton. Motion carried. The report of the Reorganization Committee was brought to the floor for discussion. Due to the subject matter, City Attorney Hultman suggested that the Council meet in Executive Session. It was moved by Penaluna, seconded by Getty to meet in Executive Session. Ayes: Seven. Motion carried. Newsman Ron DeChristopher, Waterloo Courier, questioned the legality of the Executive Session. EXECUTIVE SESSION It was moved by Bowers, seconded by Dowie to close Executive Session. Motion carried. Attorney Hultman suggested that the Council not meet in Executive Session at this time as the subject matter bordered on a fine line of the interpretation of the Open Meetings Law. It was moved by Penaluna, seconded by Dowie to adjourn. Motion carried. Larry P. Invocation by Councilman Wilharm. 82037 - Moved by Roehr, seconded by Dowie the Agenda, as amended, for the Regular Session of March 15, 1982, at 7:00 P.M., be accepted and approved. Motion carried. 82038 - Moved by Dowie, seconded by Bowers that the minutes of the Regular Session held March 8, 1982 at 7:00 P.M. be approved. Motion carried. ORAL PRESENTATIONS 82039 - Councilman Getty presented a petition of area residents dissatisfied with the condition of the streets within the Lincoln-Ackermant area (Lincoln-Ackermant Area Storm and Sanitary Sewer Program, Stage III, contract No. 227). Mayor Rooff stated that various meetings had been held between the contractor, consulting engineer and the City Engineer regarding the project. Jim Lindsey, Assistant Community Development Administrator, stated that a letter had been sent to all affected residents in December, 1981, apprising them of the situation. After disconnection of the combined storm and sanitary sewer lines, an unexpected thawing occurred. Temporary measures were taken to alleviate the situation. Moved by Dowie, seconded by Wilharm to receive and file the above petition and remarks and refer to the City Engineer for review and recommendation. Motion carried. 82040 - A status listing of demolitions filed with the City Attorney's office was distributed. Moved by Bowers, seconded by Burton, that the City Attorney's office prepare and deliver to the City Council on a monthly basis the status of demolitions that have been turned over to said office for appropriate action by the Building Official. Motion carried. REPORTS 82041 - Moved by Roehr, seconded by Wilharm that the Waterloo Water Works Audit Report and Operating Report for 1981 be received and placed on file. Motion carried. 82042 - Moved by Burton, seconded by Bowie that the Audit report for Community Development Block Grant Fund for the period of June 15, 1975 through September 30, 1981, Urban Development Action Grant Fund for the period of June 15, 1978 through September 30, 1981, and Rath Urban Development Action Grant Fund for the period of September 27, 1979 through September 30, 1981 be received and placed on file. Motion carried. DOCUMENTS 82043 - Moved by Dowie, seconded by Getty that easement agreements granted by Jim Youngblut and Max Guernsey for utility purposes along Hammond Avenue in conjunction with Freeway 520 be received, placed on file and City Clerk instructed to record same. Motion carried. 82044 - Mayor Rooff stated that the Conway/McElroy Board of Directors expressed interest in working with the city. A clause dealing with the City's ability to terminate the lease (with proper notification) will be discussed. Moved by Roehr, seconded by Bowers to table for three (3) weeks action on the five (5) year lease for McElroy Auditorium. Motion carried. March 15, 1982 Page 2 RESOLUTIONS TO BE ADOPTED 82045 - Moved by Burton, seconded by Dowie that communication from Community Development Administrator and Planning and Programming Director transmitting offer of YMCA to sell certain property in conjunction with the Hackett Road By -Pass Project, for $166,000.00 together with recommendation of approval be received, placed on file, and "Resolution accepting and approving certain offers to sell real property to the City of Waterloo and accepting and approving certain deeds", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-87. 82046 - Moved by Bowie, seconded by Wilharm that communication from Community Development Administrator be received, placed on file and "resolution ordering bids, approving plans, specifications and form of contract and notice to bidders, fixing amount of bid security and ordering Clerk to publish notice and fixing a date for receiving same for the Peek Street Sanitary Sewer Extension, Contract No. 229 and for a public hearing on plans, specification, form of contract and estimate of costs as April 5, 1982 at 7:00 P.M. in City Hall Council Chambers", be adopted and Clerk instructed to publish notice accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-88. ORDINANCES TO BE ADOPTED 82047 - Moved by Penaluna, seconded by none that "an ordinance regulating burglar and holdup alarm, business, systems, and users", be received, placed on file and passed for the first time. Motion died for lack of a second. Moved by Burton, seconded by Bowers that "an ordinance regulating burglar and holdup alarm, business, systems, and users", be delayed for one (1) week, pending further review. Motion carred. NEW BUSINESS 82048 - Don Temeyer, Plan and Program Director, reported that the appraisals for the property described in Council Record 82049 averaged $2.10/sq.ft. Using this as a basis, the total appraisal would be $51,925.00. Since the sale will include an additional 25 ft., the property becomes more valuable. He stated that the value would be approximately $55,000.00. Moved by Bowers, seconded by Dowie to establish the minimum bid for the sale of property to Black Hawk County for construction of a correctional facility generally bounded by Lafayette, East 6th Street, Mulberry, and the railroad tracks be established at $55,000.00. Motion carried. 82049 - Moved by Burton, seconded by Bowers that communication from Mayor Leo P. Rooff transmitting request of Black Hawk County to purchase certain property within an area bounded by Lafayette St., E. 6th St., Mulberry St. and the railroad tracks for use as site for Dept. of Correctional Services be received, placed on file, and "Resolution setting date of hearing as April 5, 1982, at 7:00 p.m. in the City Hall Council Chambers on proposal to sell above described property to Black Hawk County", be adopted, with a minimum bid of $55,000.00. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-89. MISCELLANEOUS 82050 - Moved by Roehr, seconded by Getty that the following requests for permission to attend functions, with expenses allowed not to exceed amounts shown, be received, placed on file and approved: Mayor and Community Development and Flood Control Administrator and one Councilman to appear before the House and Senate Committee on Appropriations, Washington, D.C., March 24-25, 1982 -- $2,061.00 March 15, 1982 82050 - Continued Page 3 Five sweeper operators to attend maintenance school, Elliott Equipment Co., Davenport, Iowa, March 25, 1982 -- no cost, plus use of City vehicle.
