HomeMy WebLinkAbout02/01/82February 1, 1982 The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council Chambers, Waterloo, Iowa at 7:00 P.M., on February 1, 1982. Mayor Leo P. Rooff in the Chair. On Roll Call: Present: Getty, Penaluna, Roehr, Wilharm, Bowers, Burton, Dowie. Invocation by Councilman Bowers. 81874 - Moved by Roehr, seconded by Bowers that the Agenda, as amended, for the Regular Session of February 1, 1982, at 7:00 P.M., be accepted and approved. Motion carried. 81875 - Moved by Burton, seconded by Dowie that the minutes of the Regular Session held January 25, 1982 at 7:00 P.M. be approved. Motion carried. Mayor Rooff welcomed Scout Pack 72 to the meeting and invited them to attend any or all future Council Meetings. ADJOURNED HEARING 81876 - The Mayor announced that this was the time and place of the adjourned hearing for a rate increase for Waterloo Cablevision (see C.R.#81749 of 1/11/82). The Clerk reported no additional written objections on file. The Mayor then called for oral objections. Maxine Scott spoke against the increase. She opposed it due to much of the money in wages, etc., during initial construction going to out-of-town workers. She felt that those on a fixed income or laid off could not absorb an increase. Charles Walter, 725 Stephan, opposed the increase and stated if the Council approved the increase, they were not speaking as a voice of the people. Allen McDonald, President of Cablevision, Inc., stated that they would soon be adding three (3) additional channels. Since the initial rates were set, the national inflation rate has been nearly 50%; they were requesting an increase of only 13%. The Mayor stated that the rate increase should also be spread among those persons who have showtime and home box office. Moved by Dowie, seconded by Penaluna to approve the following rate increase for Waterloo Cablevision, Inc.: Basic Service Expanded Service Addition Outlets Present Rates $7.50 2.50 1.50 Increased Rates $8.50 3.50 2.00 Ayes: Dowie, Bowers, Getty, Penaluna, Roehr, Wilharm. Nays: Burton. Motion carried. 81877 - The Mayor then vetoed the action taken under C.R.#81876 for the reasons that the action was inequitable. Not all customers, i.e. those with home box office and showtime, are subject to the proposed increase. 81878 - Moved by Getty, seconded by Wilharm to override the veto of the Mayor taken under C.R.#81877 and "Resolution authorizing the following rate increases for Waterloo Cablevision, Inc.: Present Rates Increased Rates Basic Service $7.50 $8.50 Expanded Service 2.50 3.50 Additional Outlets 1.50 2.50", be adopted. Ayes: Dowie, Bowers, Getty, Penaluna, Roehr, Wilharm. Nays: Burton. Resolution adopted and upon approval by Mayor assigned No. 1982-50. February 1, 1982 HEARING & BIDS 81879 - Moved by Roehr, seconded by Dowie Page 2 that proof of publication of notice of public hearing on proposed plans, specifications, form of contract, estimate of costs, etc., for the construction of the F.Y. 1982 Paving Program, Contract No. 223 and taking of construction bids, therefore, as published in the Waterloo Courier on January 15, 1982, be received and placed on file. Motion carried. 81880 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Burton that "resolution adopting plans, specifications, form of contract and estimated costs for the F.Y. 1982 Paving Program, Contract No. 223", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-51. 81881 - Moved by Getty, seconded by Wilharm that proof of publication of notice to contractors of invitation for bids of construction of F.Y. 1982 Paving Program, Contract No. 223 as published in the Waterloo Courier on January 15, 1982, be received and placed on file. ORAL PRESENTATIONS 81883 - Police Chief Junior Grimm, on behalf of the American Legion, asked that they be allowed to fly flags in the downtown area during Waterloo Week (June 6 - 13, 1982). Moved by Bowers, seconded to Burton to approve this request. Motion carried. Councilman Burton asked that citations be issued to the owner Wendell McHenry of 614 Washington due to the nonconformity to the City's Housing Code. Curt Parsons, Building Official, stated that a remodeling permit was taken out for 614 Washington with a value of $65,000, on Friday, January 29, 1982. February 1, 1982 PETITIONS FROM PUBLIC 81884 - Moved by Dowie, seconded by Burton Page 3 that communication from Planning Director recommending approval of industrial tax exemption for Pioneer Hybrid International, Inc. for new machinery and reconstruction be received, placed on file and "Resolution recommending approval of application of Pioneer Hybrid International, Inc. for industrial tax exemption as permitted by the 1979 Code of Iowa, Section 427A.1, Paragraph a", be adopted and Clerk instructed to forward said application to the City Assessor for final determination of tax exemption. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-52. 81885 - Moved by Penaluna, seconded by Getty that communication from Planning Director recommending approval of tax exemption for Deere and Company for new machinery assessed as real estate be received, placed on file and "Resolution recommending approval of application of Deere and Company for industrial tax exemption as permitted by the 1979 Code of Iowa, Section 427A.1, Paragraph a", be adopted and Clerk instructed to forward said application to the City Assessor for final determination of tax exemption. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-53. UNFINISHED BUSINESS 81886 - Moved by Getty, seconded by Bowers that communication from Plan and Program Director transmitting City Assessor's report on the Crystal Ice and Cold Storage tax exemption request for commercial property within the Franklin Urban Revitalization Area be received, placed on file and "resolution approving the commerical tax exemption for 105 E. 10th Street (Crystal Ice and Cold Storage", be adopted and Clerk instructed to forward said application to the City Assessor for final determination. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-54. REPORTS 81887 - Moved by Roehr, seconded by Wilharm that F.Y. 1981 Annual Report for the Waterloo Public Library be received and placed on file. Motion carried. DOCUMENTS 81888 - Moved by Roehr, seconded by Bowers that preliminary plat of Sperry Addition together with Deed of Dedication, report of City Engineer and Plan and Program Commission's recommendation for approval and its recommendation for Council approval, be received, placed on file and "resolution approving the preliminary plat of Sperry Addition, Black Hawk County, Iowa", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-55. 81889 - Moved by Bowers, seconded by Dowie that communication from Community Development Administrator transmitting Amendment to the Rath UDAG Grant Agreement No. B -79 -AA -19-0004 be received, placed on file and "resolution authorizing execution of Amendment to the Rath UDAG Grant Agreement by and between the City of Waterloo and Department of Housing & Urban Development (HUD)", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-56. 81890 - Moved by Burton, seconded by Bowers that communication from City Engineer transmitting "Concept Statement" and drawings for the F.Y. 1982 East San Marnan at Sears Street and Penneys Street Improvements, Contract No. 230 be received, placed on file and approved. February 1, 1982 Page 4 RESOLUTIONS TO BE ADOPTED 81891 - Moved by Burton, seconded by Dowie that "resolution authorizing and directing the City Clerk to destroy certain records and papers as provided in Section 372.13, Paragraph 5, of the 1981 Code of Iowa", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1982-57. NEW BUSINESS 81892 - Moved by Bowers, seconded by Penaluna that communication from Plan and Program Director transmitting proposed boundaries for the Washington Urban Revitalization Area be received, placed on file and "resolution authorizing the Plan and Program Commission to proceed with preparation of the Washington Urban Revitalization Area", be adopted. Ayes: Six. Nays: Wilharm. Resolution adopted and upon approval by Mayor assigned No. 1982-58. 81893 - Moved by Roehr, seconded by Bowers that communication from Conway Civic Center Manager reporting retirement of LaVern Fratzke effective December 31, 1981 and entitlement of 60 hours vacation pay and 429 hours sick pay be received, placed on file and "resolution approving payment of $4,312.98 vacation and sick pay to LaVern Fratzke, Conway Civic Center", be adopted. Attend Functions: 81894 - Moved by Getty, seconded by Wilharm that the following requests for permission to attend functions, with expenses allowed not to exceed amounts shown, be received, placed on file and approved: Planning Director, Assistant Personnel Director, Assistant City Attorney to attend meeting with Regional Office of the Department of Labor concerning CETA reimbursements, Kansas City, Missouri, February 3, 1982 -- $735.00 total. Moved by Getty, seconded by Bowers that denial of a taxicab license by the City Clerk for Richard A. Dixon, 405 Sunnyside, be overruled and a license be granted, with close supervision for six (6) months. Ayes: Six. Nays: Wilharm. Motion carried. 81897 - Moved by Getty, seconded by Burton that denial of a taxicab license by the City Clerk for Dean Paul Tobar, 612 W. 1st St., overruled and a license be granted, with close supervision for six (6) months. Ayes: Seven.
