Mayor Pro Tem Roehr in the Chair. On Roll Call: Present: Getty, Penaluna, Roehr, Wilharm, Bowers, Burton, Dowie. Invocation by Councilman Getty. 81808 - Moved by Burton, seconded by Dowie that the Agenda, as amended, for the Regular Session of January 18, 1982, at 7:00 P.M., be accepted and approved. Motion carried. 81809 - Moved by Wilharm, seconded by Bowers that the minutes of the Regular Session held January 11, 1982 at 7:00 P.M. be approved. Motion carried. HEARINGS 81810 - Moved by Bowers, seconded by Wilharm that proof of publication of notice of public hearing on proposed submission of application for UDAG Grant as published in the Waterloo Courier on January 12, 1982 be received and placed on file. Motion carried. 81811 - HOLD HEARING - This being the time and place to hold hearing the Mayor Pro Tem called for written and oral objections and there were none. Moved by Wilharm, seconded by Bowers that "resolution authorizing submission of application for UDAG Grant for the Conway Retail Development Project", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1982-26. 81812 - Moved by Getty, seconded by Wilharm that proof of publication of notice of public hearing on proposal to issue not to exceed $2,000,000 principal amount Industrial Development Revenue Bonds (Conway Plaza Development Co. Project) for the purpose of financing all or a portion of the cost of acquiring land and renovating a building as published in the Waterloo Courier on December 31, 1981 be received and placed on file. Motion carried. 81813 - HOLD HEARING - This being the time and place to hold hearing the Mayor Pro Tem called for written and oral objections and there were none. Moved by Bowers, seconded by Penaluna that "resolution proceeding with the issuance and sale of not to exceed $2,000,000 in aggregate principal amount of Industrial Development Revenue Bonds (Conway Plaza Development Co. Project) Series 1982", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1982-27. 81814 - Moved by Bowers, seconded by Burton that proof of publication of notice of public hearing on proposal vacate, sell and convey an alley generally located north of John Street as published in the Waterloo Courier on December 31, 1981 be received and placed on file. Motion carried. 81815 - HOLD HEARING - This being the time and place to hold hearing the Mayor Pro Tem called for written and oral objections and there were none. Moved by Wilharm, seconded by Bowers to receive and place on file Plan and Program Commission's recommendation of approval. Motion carried. January 18, 1982 Page 2 81816 - Moved by Bowers, seconded by Getty that "an ordinance vacating a portion of an alley located north of John Street", be received, placed on file and passed for the first time. Ayes: Seven. Motion carried. 81817 - Moved by Getty, seconded by Penaluna that the rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Motion carried. 81818 - Moved by Bowers, seconded by Getty that "an ordinance vacating a portion of an alley located north of John Street", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor Pro Tem assigned No. 3188. 81819 - Moved by Bowers, seconded by Burton that "Resolution authorizing sale and conveyance of a portion of an alley north of John Street to Katherine Cross Mosley", be adopted and City Attorney instructed to prepare deed accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1982-28. 81820 - Moved by Getty, seconded by Burton that proof of publication of notice of public hearing on application of Black Hawk Development Company to rezone 1.2 acres generally located at the intersection of Kimball Avenue and Brookeridge Drive from "R-4" Multiple Family Residence District to "C -Z" Conditional Zoning as published in the Waterloo Courier on December 31, 1981 be received and placed on file. Motion carried. 81821 - HOLD HEARING - This being the time and place of hearing the Mayor Pro Tem called for written and oral objections and there were none. Moved by Penaluna, seconded by Bowers to receive and place on file Zoning Commission's recommendation for approval. Motion carried. 81822 - Moved by Getty, seconded by Dowie to receive, file and approve the site plan for the proposed McDonald's Restaurant located at Kimball Avenue and Brookeridge Drive. Motion carried. 81823 - Moved by Getty, seconded by Bowers that "an ordinance amending Ordinance No. 2479, as amended, by adding Subsection No. 1, Conditionally Zoning Certain Property to Section 2A -7-M", be received, placed on file and passed for the first time. Ayes: Seven. Motion carried. ORAL PRESENTATIONS 81824 - Councilman Bowers asked that a complete report be prepared by the City Attorney's Office on the status 901-909 Lafayette Street, a building which has been declared a public nuisance. No court action has yet been taken. Curt Parsons, Building Official, also stated that some nineteen (19) other buildings are in the hands of the City Attorney awaiting action. After discussion it was Moved by Bowers, seconded by Wilharm to instruct the City Attorney's Office to proceed with the demolition of all buildings presently awaiting court action and provide the Mayor and Council with a report. Page 3 Mayor Pro Tem Roehr thanked Don Thorson, Street Department Superintendent, and his staff for the fine work in removing snow from the City's streets. UNFINISHED BUSINESS 81825 - Moved by Bowers, seconded by Wilharm that "resolution awarding renovation contract for the East Side Library", be delayed for one week. Motion carried. REPORTS 81826 - City Engineer, Ralph Anderson, reported that these petitions were ones previously received by the City and included in an earlier oral report to the Council. This action is merely the culmination of all petitions and needs to be part of the City's official record. Moved by Burton, seconded by Getty that communication from City Engineer reporting on petitions received on Ashland Avenue on the F.Y. 1982 Paving Program No. 1, Contract No. 223 be received and placed on file. Motion carried. 81827 - Moved by Bowers, seconded by Burton that minutes of the Community Development Board Meeting held on December 7, 1981 and Special Meeting held December 15, 1981 be received and placed on file. Motion carried. DOCUMENTS 81828 - Moved by Penaluna, seconded by Wilharm that communication from Assistant City Engineer transmitting Iowa Department of Transportation Annual Right -of -Way Assurance Statement be received, placed on file and "resolution authorizing execution of Iowa Department of Transportation's Annual Right -of -Way Assurance Statement", be adopted and Mayor Pro Tem authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1982-29. 81829 - Moved by Getty, seconded by Bowers that communication from Plan and Program Director transmitting proposed lease agreement with Hawkeye Valley Area Agency on Aging for occupancy of the East Side Library be received, placed on file and "resolution authorizing execution of lease agreement with Hawkeye Valley Area Agency on Aging for occupancy of the East Side Library", be delayed one (1) week. Motion carried. X81830 - Moved by Burton, seconded by Bowers that communication from Waterloo Pollution Control Plant Director transmitting Treatment Agreement from the John Deere Tractor Works be received, placed on file and "resolution authorizing execution of Treatment Agreement by and between the City of Waterloo and John Deere Tractor Works", be adopted. RESOLUTIONS TO BE ADOPTED 81832 - Moved by Wilharm, seconded by Bowers that "a resolution transferring from the Federal Revenue Sharing Fund the sum of two hundred forty-four thousand one hundred seventy-three dollars ($244,173.00) to the General Fund", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1982-32. ORDINANCES TO BE ADOPTED 81833 - This ordinance allows the City to ticket private parking lots. Moved by Bowers, seconded by Wilharm that "an ordinance amending Ordinance No. 2644, known as the Traffic Code, by repealing Section 308, Handicapped Parking Spaces, and enacting in lieu thereof a new Section 308, Handicapped Parking", be received, placed on file and passed for the first time. Ayes: Seven. Ordinance adopted and upon approval by Mayor Pro Tem assigned No. 3190. 81838 - Moved by Wilharm, seconded by Bowers that "resolution authorizing sale and conveyance of portion of West Park Avenue right-of-way between the Cedar River and Cedar Street to Verner D. & Donna L. Nelson", be adopted and City Attorney instructed to prepare deed accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1982-33.
