The Council of City of Waterloo, Iowa,met in Regular Session in Council Cham-
bers in the City Hall at 7:00 P.M., on November 27, 1978. Mayor Rooff in the
Chair. On roll call, Present: Dowie, Getty, Hutchison, Roehr, Wilharm. Absent:
Bowers, Burton. Invocation by Councilman Getty.
75399 - Moved by Dowie, seconded by Getty that the Agenda, as amended, for the
Regular Session of November 27, 1978 at 7:00 P.M., be accepted and
approved. Motion carried.
75400 - Moved by Roehr, seconded by Dowie that the Minutes of the Regular Session
held November 20, 1978 at 7:00 P.M., and of the Board of Health Meeting
held November 20, 1978 at 8:02 P.M., be approved. Motion carried.
75401 - Moved by Roehr, seconded by Wilharm that proof of publication of notice
of public hearing on plans, specifications, form of contract, estimate
of cost, etc. for F.Y. 1979 Maywood Water Extension, Contract No. 501,
and taking of bids for said improvement, be received and placed on file.
Motion carried.
75402 - This being the time for hearing, the Mayor called for oral and written
objections and there were none.
Moved by Wilharm, seconded by Dowie that "Resolution confirming approval
of specifications, plans, form of contract, etc. for F.Y. 1979 Maywood
Water Extension. Contract No. 501", be adopted. Ayes: Five. Absent:
Burton, Bowers. Resolution adopted and upon approval by Mayor, assigned
No. 26069.
75403 - Moved by Dowie, seconded by Hutchison that "Resolution ordering the
construction of F.Y. 1979 Maywood Water Extension, Contract No. 501",
be adopted. Ayes: Five. Absent: Burton, Bowers. Resolution adopted
and upon approval by Mayor, assigned No. 26070.
75404 - Moved by Wilharm, seconded by Roehr that three bids, be received, placed
on file, Clerk instructed to open same, but not read, and referred to
Engineers for checking and report back. Motion carried.
75405 - Mildred Campbell asked reconsideration of her Massage Technician Permit
application, which was not approved on 11/20/78, as she was not notified
in time for resubmission of a corrected application.
Moved by Dowie, seconded by Hutchison that Council Action #75396 of
11/20/78 be rescinded and the application of Mildred I. Campbell, 415
Greenbrier Road, for Massage Technician Permit, received, placed on
file and granted subject to the requirements of ordinance governing
same. Motion carried.
75406 - Moved by Roehr, seconded by Getty that request of Mary E. Narey for
Council on its own motion to rezone from "R-4" Multiple Residence Dis-
trict to "C-2" Commercial District approximately 3.44 acres,being all
of Lots 1, 2 and 3 of Auditor Barnes Plat No. 1 and all of'Allen Heights
First Addition except for the west 60' and south 100', located north of
West Donald Street and west of Logan Avenue (U.S. Hwy. #63). as shown
on attached plat, together with remonstrance petition, and City Zoning.
Commission's recommendation for approval, be received, placed on file.,,
date of hearing set as December 18, 1978 at 7:00 P.M. and Clerk
instructed to publish notice. Motion carried.
75407 - Moved by Dowie, seconded by Hutchison that Financial Report of Board of
Waterloo Water Works Trustees for quarter ending September 30, 1978, be
received and placed on file. Motion carried.

75410 - Moved by Dowie, seconded by Wilharm that Memorandum of Understanding
Agreement with the Department of Agriculture, State of Iowa, and City
of Waterloo Health Department dated 1/1/79, wherein City agrees to make
inspections of food service establishments, food and beverage vending
machines, and hotels, and collect and retain the annual license fees,
be received, placed on file, approved and the Health Authority author-
ized and directed to sign same on behalf of the City. Ayes: Five.
Absent: Burton, Bowers. Motion carried.
75411 - Moved by Dowie, seconded by Hutchison that "An Ordinance repealing
Chapter 15, Food and Food Handlers, of the Code of Ordinances of the
City of Waterloo, Iowa; and enacting in lieu thereof "Food Service
Sanitation Ordinance", be received, placed on file, considered and
passed for the first time. Ayes: Five. Absent: Burton, Bowers.
Motion carried.
75412 - Moved by Roehr, seconded by Hutchison that statement for engineering
design services for Contract No. 85, and City Engineer's recommendation
for approval, be received, placed on file and "Resolution approving and
accepting the statement dated 11/8/78 from Brice, Petrides & Associates,
Inc.for engineering design services for Castle Hill Drainage Improvements
Contract No. 85, and authorizing payment accordingly", adopted. Ayes:
Five. Absent: Burton, Bowers. Resolution adopted and upon approval
by Mayor, assigned No. 26071.
75413 - Moved by Hutchison, seconded by Getty that statement for engineering
services for Contract No. 100, and City Engineer's recommendation for
approval, be received, placed on file and "Resolution approving and
accepting the statement dated 11/8/78 from Brice, Petrides & Associates
for engineering services for Drainage Structure Replacement for Martin
Road and Cedar Terrace Drive, Contract No. 100, and authorizing payment
accordingly", adopted. Ayes: Five. Absent: Burton, Bowers. Resolution
adopted and upon approval by Mayor, assigned No. 26072.
75414 - Moved by Roehr, seconded by Getty that Recommendation of Acceptance and
Completion Report for Sidewalk Contract No. 45, and City Engineer's
recommendation for acceptance, be received, placed on file and "Resolute

Report for work and materials furnished by Denman Phillips Construction
Company, Inc. for F.Y. 1978 Idaho Sidewalk Program, Contract No. 45, and

75415 - Moved by Getty, seconded by Roehr that "Resolution, Bills", be adopted.
Ayes: Five. Absent: Burton, Bowers. Dowie voted with reservations for
reason of possible conflict of interest under Section 362.6 of Code of
Iowa. Resolution adopted and upon approval by Mayor, assigned No. 26074.
75416 - Mayor Rooff stated the Wayne Engineering Corporation was desirous of
starting a business in Waterloo which would not compete with local
enterprise, would create 13 to 18 new jobs and a local bank was in-
terested in purchasing the industrial development revenue bonds.
Moved by Wilharm, seconded by Roehr that communication from Robert Braun,
Atty. for Wayne Engineering Corporation, transmitting a Memorandum of
Agreement between the City of Waterloo, Iowa and said Corporation, and
requesting the City to issue not to exceed $500,000 industrial develop-
ment revenue bonds under Chapter 419, Code of Iowa, to defray all or a
portion of the cost of acquiring and improving land, buildings and
equipment for processing and assembling of solid waste refuse packer
bodies on truck chassis, be recieved, placed on file and "A resolution
directing the publication of a notice of intention to issue not to exceed
$500,000 aggregate principal amount of industrial development revenue
bonds (Wayne Engineering Corporation Project) Series 1979 of the City
of Waterloo., Iowa, and calling a public hearing on the proposal to issue
said bonds and authorizing execution of a Memorandum of Agreement",
adopted and date of hearing set as December 18, 1978 at 7:00 P.M. in the
Council Chambers in City Hall. Ayes: Five. Absent: Burton, Bowers.

75417 - Moved by Roehr, seconded by Hutchison that following requests for per-
mission to attend functions, with expenses allowed not to exceed amount
shown, be received, placed on file and approved:

75420 - Moved by Dowie, seconded by Getty that report of City Attorney and list
of bonds filed with Clerk through 11/27/78, be received, placed on file
and report and bonds approved. Motion carried.
75421 - City Engineer reported the bids on F.Y. 1979 Maywood Water Extension,
Contract No. 501, were in order and could be read.
