Mayor Rooff in the Chair. On roll call. Present: Bowers, Burton, Dowie, Getty, Hutchison, Roehr, Wilharm. Absent: None. Invocation by Councilman Burton. 74846 - Moved by Dowie, seconded by Wilharm that the Agenda, as amended for the Regular Session of August 21, 1978 at 7:00 P.M., be accepted and approved. Motion carried. 74847 - Moved by Roehr, seconded by Hutchison that the Minutes of the Regular Session held August 14, 1978 at 7:00 P.M., be approver'. Moti<,n carried. 74848 - Mayor Rooff introduced the new City Engineer, Ralph Anderson and welcomed him to Waterloo. 74849 - Mayor Rooff reported that he had talked with the .7aterloo Police Chief about having enough police to cover all of Waterloo and Police Chief stated there was a sufficient amount of police protection for the City. 74850 - Mayor Rooff commended Councilman Delman Bowers on being; inducted into the State Horseman Hall of Fame. 74851 - Mayor Rooff reported approximately $35,000 could be used in Westbourne Terrace area for Storm Sewer purposes and recommended that he he authorized to proceed accordingly. Moved by Roehr, seconded by Burton that ?''payor Rooff be authorized to proceed on the above recommendation, and ren_ort be received and placed on file. `potion carried. 74852 - Councilman Wilharm asked for a decision on the conditional rezone for Larry Lehman. Moved by Wilharm, seconded by Roehr that request of Tarry Lehman for conditional rezone, be denied. ',yes: ')even. Moti,:or, carried. 74853 - Concerned citizen presented a petit .)n requesting council to investigate the procedure that was followed for paving of the eastern half of Robin Road. ?'coved by Roehr, seconded by Bowers that petition of property owners from Robin Road and Black Hawk Road be received, placed on file and referred to Acting City Engineer. Motion carried. 74854 - Moved by Bowers, seconded by Getty that petition from residents of Foulk Road for asphalt paving in lieu of concrete waving of Foulk Road from Cedar Terrace Drive to North Avenue, together with Acting City Engineer's recommendation for receiving and filing, be received and placed on file. Motion carried. 74855 - Moved by Burton, seconded by Getty that request from Young Development Company, for permission to construct one 24' commercial curb cut at 126Q- 1931 Pinehurst Lane to serve a proposed total of thirty-two townhouse units, as shown on attached plat, and Acting City Engineer's recommencl�.,�io,.. for approval subject to provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. motion carried. 74856 - Moved by Dowie, seconded by Bowers that petition from Stephen R. Langlas, 6249 Eldora Road, regarding truck traffic at corner of West 4th Street and East Shaulis Road, be received, placed on file and referred to Quintin Parker of Sign and Traffic Department with a report back in August 28, 1978 Motion carried. 74857 - Moved by Hutchison, seconded by Roehr that request of Black Hawk Develop- ment Corp, for permission to construct a temporary concrete driveway at 209-211 East San Marnan Drive without regard to sidewalk: grade, together with $3.00 for recording waiver, and Acting City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Black Hawk Devel- opment Corp, and authorizing construction of a temporary concrete driveway at 209-211 East San Marnan Drive irrespective of a later official grade", adopted. Ayes: Seven. Motion carried. 74859 - Moved by Getty, seconded by Roehr that communication from Acting City Engineer, advising improvements required as a condition precedent to final approval of Kowal Addition and has been completed in substantial conforma- nce with construction plans, standards and requirements of his office, submitting a two-year maintenance bond for sewer improvements, and recom- mending acceptance, be received, placed on file, approved and accepted with effective dates on bond being that of final Council approval. Motion carried. 74860 - Moved by Roehr, seconded by Dowie that report of Building Official on inspection of city owned property at 225 West Ridgeway Avenue, be received and placed on file. Wells, 3939 Logan Avenue, et al, for sanitary sewer," city water and fire hydrants in the 3800 and 3900 blocks of Logan Avenue. Moved by Getty, seconded by Hutchison that communication of Acting City Engineer reporting above sanitary sewer service area could be served by proposed Lowder Road Sanitary sewer project, on assessed program, and recommending approval, be received, placed on file, approved, said 3800 and 3900 blocks of Logan Avenue ordered included in said proposed assessed Lowder Road s nit ry sewer ro ect rid Engineering department instructed to proceed accorc�ing�y. Motio c rridcf. 74862 - Donna Balk, 3931 Logan Avenue asked when the Logan Avenue residents could expect sanitary sewer. Acting City Engineer Radue stated letting would be in December and completion next summer. Mayor Rooff recommended that residents continue pumping out their septic tanks. 74863 - Water Works General Manager Craft stated he would recommend to the water works board that a water main survey of Logan Avenue be made. 74864 - Moved by Dowie, seconded by Hutchison that communication from Community Development Administrator, transmitting following Offer of Sale to the City of Waterloo certain real property adjacent to Liberty Park for Waterloo Flood Control Project, and recommending approval, be received, placed on file and "Resolution accepting and approving certain offer to sell real property to the City and accepting and approving certain deed", adopted: Parcel No. 50 - Lot 50 except the West 200 feet thereof in Hollandale Addition - from Helen J. Stohr - $2,350.00 Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25918. 74865 - Moved by Bowers, seconded by Dowie that communication from Acting City Engineer, transmitting proposed "Intergovernmental Agreement" with the City of Cedar Falls for reconstruction of West Ridgeway Avenue lying within Cedar Falls, with expenses to be shared, be received, placed on file and Resolution approving I pp ng nterpovernmental Agreement with City of Cedar Falls for West Ridgeway Avenue Improvements, Contract No. 165", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25921. ---------- 11 74870 - Moved by Roehr, seconded by Wilharm that communication from Mayor Rooff submitting for Council approval, appointment of Gene Yagla, 1804 Rainbow Drive, to Zoning Commission to fill unexpired term of Thomas Beener, expir- ing on July 7, 1982, be received, placed on file and approved. :`lotion Carried. 74871 - Moved by Bowers, seconded by Burton that communication from Assistant City Attorney, reporting notice has been served on Maxwell Wood, for the removal of diseased Dutch Elm tree from the property at 226 West 11th Street, and requesting Council to set a date of hearing and publish notice for the owners to show cause why the City of Waterloo should not remove the diseased Dutch Elm tree and assess the cost thereof against the real estate, be received, placed on file and "Resolution fixing the time and place of hearing on a proposal to remove diseased Dutch Elm tree and levy assessment therefor, and instructing the City Clerk to publish the necessary notice", adopted, and date of hearing set as September 11, 1978, at 7:00 P.M.
