On roll call, Present: Bowers, Burton, Dowie, Getty, Roehr, Wilharm. Absent: Hutchison. Invocation by Councilman Bowers. 74752 - Moved by Dowie, seconded by Burton that the Agenda, as proposed for the Regular Session of August 7, 1978 at 7:00 P.M., be accepted and approved. Motion carried. 74753 - Moved by Roehr, seconded by Getty that the Minutes of the Regular Session held July 24, 1978 at 7:00 P.M., be approved. Motion carried. 74754 - Scott Wienands, 1020 West Third Street, asked about the status of the Water Works bill he received for a broken valve. 74755 - Councilman Getty asked who was responsible for cutting high weeds on Cedar Bend Dike and this was referred to City Engineer. 74756 - Councilman Getty asked that the Council be given copies of Cedar Falls noise ordinance, Mayor Rooff stated an ordinance was being drawn for Waterloo. 74757- Moved by Roehr, seconded by Dowie that communication from Plan and Pro- gram Commission, requesting the sale and conveyance of a portion of vacated Elvon Street in Prairie Meadow West, as legally described in attached Exhibit "A", to Country Manor, Inc, in exchange for 17 feet of property along Ansborough Avenue right-of-way, be received, placed on file and "Resolution fixing the time and place of hearing as August 28, 1978 at 7:00 P.M. in Council Chambers in City Hall on proposal to sell and convey a portion of vacated Elvon Street to Country Manor, Inc.", adopted and Clerk instructed to publish notice of public hearing. Resolution adopted and upon approval by Mayor, assigned No. 25885. 74758 - Moved by Burton, seconded by Wilharm that communication from Plan and Program Commission, transmitting application of Waterloo Savings Bank to construct an addition to building at 3130 Kimball Avenue, a "S-1" Shop- ping Center Commercial District, and replacement of an existing sign, and recommending approval, be received, placed on file, approved and permission granted subject to ordinance governing same. Motion carried. 74759 - Moved by Dowie, seconded by Bowers that communication from Acting City Engineer, transmitting request from Northern Contracting Company, Hopkins, Minnesota, for permission to use explosives for Triangle Terrace Sanitary Sewer Contract No. 189, and recommending approval for issuance of blast- ing permit for period of 8/15 thru 9/15/78 with license fees waived and subject to submittal of a Certificate of Insurance for said work, be received, placed on file, recommendations approved and permission granted in accordance therewith and subject to the provisions of City Code Section 13-18. Hansen for permission to construct a temporary asphalt driveway at 1811 Hunting- ton Road without regard to sidewalk grade, together to sidewalk grade, together with $3.00 for recording waiver, and Acting City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Stanley A. Hansen and authorizing construction of a temporary driveway at 1811 Huntington Road, irrespective of a later official grade", adopted. Ayes: Six. Absent: Hutchison. Resolution adopted and upon approval by Mayor, assigned No. 25888. 74764 - Mayor Rooff stated due to parked vehicles, traffic was blocked in the West 13th Street area between Jefferson and Black Hawk Streets and num- erous complaints have been received. Don Pierce said there were eleven businesses in the two blocks and they would be shut out of business of no parking for customers. Jim Woods supported the need for parking. Quintin Parker stated it was not the responsibility of the City to furnish parking places on the street but he was agreeable to two hour restriction on southerly side of Commercial Street between West 12th and West 14th Streets between 7:00 A.M. to 6:00 P.M. Discussed was parking on the parking area being in violation of ordinance; parallel parking on one side; granting additional time for study of no parking effect on businesses. Moved by Dowie, seconded by Getty that report of Quintin T. Parker, Sign & Traffic Maintenance Department, on parking on West 13th Street between Jefferson Street and Black Hawk Street, and recommendation for parking to be taken off both sides of West 13th Street from Black Hawk Street to Jefferson Street, and that parking be restricted to one (1) hour on the southerly side of Commercial Street between West 12th Street and West 14th Street between the hours of 7:00 A.M. to 6:00 P.M. except Sundays, be received, placed on file, action deferred for thirty days and Quintin T. Parker instructed to make a further study as to the effect on area businesses as a result of no parking on both sides of the street and as to parallel or angle parking on one side of the street. Ayes: Dowie, Getty. Nays: Bowers, Burton, Roehr, Wilharm. Absent: Hutchison. Motion not carried. 74765 - Moved by Roehr, seconded by Bowers that report of Quintin T. Parker, Sign & Traffic Maintenance Department, on petition of Kenneth Dooley, et al, requesting parking be limited to one side of Greenwood Avenue in Sherwood Park (see C.A.#74697 of 7/24/78) , and recommendation for approval, be received, placed on file, approved, parking taken off the northerly side of Greenwood Avenue .from_Dellwood Court to -North Hackett Road, and City Attorney instructed to submit an ordinance accordingly. Motion carried. 74768 - Moved by Dowie, seconded by Bowers that three communications from Acting City Engineer, advising improvements required as a condition precedent to final approval of the following Park and Additions have been completed in substantial conformance with construction plans, standards and -req uirements of his office, submitting four-year maintenance bonds street improvements and two-year maintenance bonds for sewer prove and recommending acceptance, be received, placed on file, app and accepted with effective dates on bonds being that of final Council approval: 1. Schukei Commercial Park; 2. Bronson Addition; 3. Hillside Addition, with Westgate Villa, Inc., owner and developer, to retain ownership of said sanitary sewer until such time as hook -on charges have been paid to owner for that portion of Niagara Street which is adjacent to Perry Grier's property. Resolution adopted and upon approval by Mayor, assigned No. 25890. 74775 - Councilman Getty expressed concern that City would pay 50% of paving access road. Harold Michels stated Young Plumbing & Heating Co. had an access to Ridgeway Avenue which was not restricted by IDOT but by the City; they have cleaned out the ditch and widen the bottom to the rear lot line to 30' at considerable cost. Discussed was City guideline to keep access to property a certain distance away. Moved by Dowie, seconded by Wilharm that Preliminary Plat of Kingswood Second Addition with Deed of Dedication, report of Acting City Engineer. Plan and Program Commission's resolution of approval and its recommenda- tion for Council approval, be received, placed on file, and "Resolution aproving the Preliminary Plat of Kingswood Second Addition, Waterloo, Black Hawk County, Iowa", adopted. Resolution adopted and upon approval by Mayor, assigned No. 25894. 74779 - Moved by Bowers, seconded by Getty that "An Ordinance amending the City Electrical Code, Ordinance No. 2071, by repealing Sections 103-5; 104(a); 104(b); 104(c); 204; 306(a); 405-B(1); 405-B(2); 405-B(3); 405-B(4); 405-B(5); 405-B(6); 405-B(9); 408(b); 408(c); 408(e); 408(f); and 410; also by repealing Articles V, VI, VII, VIII, IX, and X; and enacting in lieu thereof new sections 104(a); 104(b); 204; 306(a); 405-B(1); 405-B(2); 405-B(3); 405-B(4); 405-B(5); 405-B(6); 408 (a) (1); 408 (a) (2); 408(b); 408(e); and 410; and adding new Articles V thereto", be received, placed on file, considered and the rules requiring ordinances to be considered and voted on for passage at two prior meet- ings, suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Motion carried. 74781 - Mayor Rooff read Brice, Petrides & Associates, Inc. review of a letter from Iowa department of Environmental Quality on Larry M. Lehman Landfill. There was a discussion on performance and maintenance bond; setting up systems to determine when leaching; DEQ to make cosntruction review; who's liability if faulty construction, etc. Charles Mattson, Attorney for Larry Lehman, stated bottom clay would be used to line the sides, there would be periodic tests prior to any dumping, there were no bond requirements but can be required if deemed necessary, the sand contains phenol, an alcohol compound, which is not harmful but is bad tasting, etc.; DEQ has issued permit. Wendell Lockard complained of water drainage onto his property, City water wells at bottom of hill could have serious problems, etc. Further discussed was Landfill Commission and Water Works having right to make inspections. Larry Lehman asked for action as his land option and contract was in jeopardy. Moved by Roehr, seconded by Burton that action be deferred until Sept- ember 11, 1978 to allow Landfill Commission and Waterloo Water Works to meet with Iowa Department of Environmental Quality on bonding and other pertinent questions. Motion carried. 74782 - Moved by Roehr, seconded by Dowie that "An Ordinance amending Chapter 23, Licenses and Business Regulations, of the Code of Ordinances of the City of Waterloo, Iowa, be repealing Section 23-43, Solicitors and Agents, in its entirety aid enacting in lieu thereof new Secti_on.s 23-43, 23-44, 23-45, 23-45.1, 23-45.2, 23-45.3, 23-46, 23-47, 23-47.1, 23-47.2, 23-47.3, 23-47.4, 23-48, and 23-48.1 known as solicitors of Funds to become a part of Chapter 23 of the Code of Ordinances of the City of Waterloo, Iowa", be received, placed on file, considered and passed for the first time.
