Ylayor Rooff in the Chair. On roll call, Present: Bowers, Burton, Dowie, Getty, Roehr, Wilharm. Absent: Hutchison. Invocation by Councilman Getty. 74391 - Moved by Roehr, seconded by Dowie that the Agenda, as proposed, for the Regular Session of June 12, 1978 at 7:00 P.M., be accepted and approved. Motion carried. 74392 - Moved by Dowie, seconded by Bowers that the 1�inutes of the Regular Session held June 5, 1978 at 7:00 P.M., be approved. Motion carried. 74393 - Moved by Roehr, seconded by Wilharm that proof of publication of the Notice of Proposed Resolution of Necessity for Oiling Program - Year 1978, being a Proposed Resolution of Necessity (25758) for the im- provements of streets, avenues, drives, roads, boulevards, alleys, etc. or portions thereof, by oiling the same, as published in Water- loo Courier on 5/26 and 6/2/78, be received and placed on file. Motion carried. 74394 - This being the time for hearing, the Mayor called for written and oral objections. The Clerk reported the following written objections had been filed: 1. Orrin A. Wilcox, 1123 West Sixth Street, objecting to assessment. 2. Robert D. Fulton, Atty. for Starlite Drive -In Theatre Co., 4000 University Avenue, objecting to assessment. 3. F. J. Lentsch, 1181 Cornwall Avenue, objecting to "premature" oiling of alley and protesting assessment. Moved by Burton, seconded by Bowers that the above objections be re- ceived and placed on file. Motion carried. 74395 - Floyd Harms objected as only440iosigned a petition for oiling Z of South Hackett Road and was informed the petition covered the 400, 500 and 600 blocks; some street maintenance repairs of grading and dust shot with waste oil had been done on other blocks; paving was sched- uled for 1979. Moved by Roehr, seconded by Burton that the above objection_ be receiv- ed, placed on file and South Hackett 'Road from University Avenue to N. Property Line 427 deleted from the F.Y. 1978 Oiling Program I. Ayes: Six. Absent: Hutchison. Motion carried. 74396 - Orrin A. Wilcox, 1123 West Sixth Street, stated four properties on Pleasant Street altogether were not assessed as much as his; original petition was 75% for oiling and his petition was 21% against. Moved by Getty, seconded by Bowers that the objections of Orrin A. Wilcox to assessment for Pleasant Street in F.Y. 1978 Oiling Program I, be received, placed on file and overruled. Motion carried. 74397 - The objection of Starlite Drive -In Theatre Company was discussed; 40% was against and 50% was for oiling. Moved by Wilharm, seconded by Roehr that the objection of Starlite Drive -In Theatre Company be overruled. Motion carried. 74398 - Robert Kennedy, 100 Hollywood Avenue, asked that Hollywood Avenue be dead -ended at the alley. Moved by Roehr, seconded by Getty that the above request, be received, placed on file and referred to City Engineer with report back on June 19, 1978. Motion carried. 74399 - Craig Fanton, 1170 Bourland Avenue, supported the petition of F. J. Lentsch, etal, objecting to "premature" oiling and assessment therefor. Moved by Roehr, seconded by Dowie that the above objection, be receiv- ed, placed on file and the portion of alley adjacent to properties in the 1100 block of Bourland Avenue and Cornwall Avenue deleted from the F.Y. 1978 Oiling Program I. PZotion carried. .. 2 - 74400 - City Engineer Radue presented a petition from Bob L. Miller, 802 Colorado Street, etal objecting to 400 block Butler Avenue, and stated petition was 50% against and the original petition was 100% for. Moved by Bowers, seconded by Burton that the above petition be re- ceived and placed on file. Motion carried. 74401 - r•loved by Wilharm, seconded by None that the 400 block of Butler Ave- nue be deleted from the F.Y. 1978 Oiling Program I. Motion died for lack of a second. 74402 - Moved by Bowers, seconded by Getty that the objection of Bob L. Miller, etal, to 400 block of Butler Avenue, be overruled. Motion carried. 74403 - Moved by Burton, seconded by Dowie that "Resolution overruling the objections to Pleasant Street, Acorn Lane, and 400 block of Butler Avenue, and sustaining the objections to South Hackett Road, and the portion of alley adjacent to properties in the 1100 block of Bourland Avenue and Cornwall Avenue, in the 1978 Oiling Program", be adopted. Ayes: Six. Absent: Hutchison. Resolution adopted and upon approv- al by Mayor, assigned No. 25782. 74404 - Moved by Dowie, seconded by Bowers that "Resolution amending the Pro- posed Resolution of Necessity (No. 25758) by deleting South Hackett Road and the portion of alley adjacent to properties in the 1100 block of Bourland Avenue and Cornwall Avenue from the 1978 Oiling Pro- gram", be adopted. Ayes: Six. Absent: Hutchison. Resolution adopted and upon approval by Mayor, assigned No. 25783. 74405 - Moved by Dowie, seconded by Bowers that "Resolution of Necessity, as amended, for oiling various streets, avenues, drives, roads, boule- vards, alleys, etc. or portions thereof, in the City of Waterloo under the Oiling Program for Year 1978", be adopted. Ayes: Six. Absent: Hutchison. Resolution adopted and upon approval by Mayor, assigned No. 25784. 74406 - Moved by Wilharm, seconded by Roehr that Resolution directing the oiling of various streets, avenues, drives, roads, boulevards and alleys, etc. or portions thereof, in the City of Waterloo, as design- ed in Resolution No. 25784, being the Resolution of Necessity, as amended, adopted June 12, 1978", be adopted. Ayes: Six. Absent: Hutchison. Resolution adopted and upon approval by Mayor, assigned No. 25785. 74407 - Moved by Roehr, seconded by Dowie that communication from Finance Director/Treasurer, transmitting the recommendations of the Finance Committee on bids submitted by various suppliers for tires, tubes, oils, transmission fluids, batteries, fuel oil, etc., be received, placed on file, recommendations approved, bids accepted as recommend- ed, for period of 7/1/78 thru 6/30/79, and Finance Director directed and authorized to issue purchase orders and warrants in payment in accordance therewith. Motion carried. 74408 - Harriet Hutchins for George Waddell requested cancellation of 1976 weed assessment in the amount of $40.00 plus penalty and interest against East 60' of Lot 29, Maywood Third Addition which was purchas- ed from Black: Hawk County in 1977. Mayor Rooff stated that a policy on special assessment cancellations would be established and given to the Board of Supervisors for dis- tribution to prospective buyers at future county property sales. Moved by Getty, seconded by Bowers that above request be received, placed on file and said weed assessment cancelled. Ayes: Bowers, Dowie, Getty, Roehr, Wilharm. Nay: Burton. Absent: Hutchison. Motion carried. 74409 - Discussed briefly was the tree replacement planting program. Mayor Rooff stated the program was under the Park Department and also the Community Development Board which furnished block grant funds to buy the trees and the citizens did the planting. June 12, 1978 3 - 74410 - Councilman Burton presented a letter from Ruth M. Pollock, 1310 South Street, (1) protesting price of oiling of streets and method of assess- ment of alley on South Street between Eleventh Street and Linwood Ave- nue south to the deadend, and (2.) requesting two signs, one on each end of the yellow line on South Street where Linwood Avenue begins on South Street, reading "No Parking Between Signs". Moved by Burton, seconded by Getty that the above letter be received, placed on file and referred to the Street Department and to Sign and Traffic Maintenance Department. Motion carried. 74411 - A petition from Mr. and Mrs. Thomas 14cKernan, et al, was presented requesting paving of Robin Road from Blackhawk Road to Wren Road and stating willingness to pay their fair share of assessment. Mayor Rooff reported the first half of the street was in good shape, he did not want to take out good paving, but it was in the paving program and unless the Council wanted to do otherwise, it would re- main in the program. An objector stated Mclntee did pave the street and was against tearing up good paving. Moved by Roehr, seconded by Burton that the above petition be receiv- ed and placed on file. Motion carried. 74412 - Discussed was access to other properties. I -loved by Getty, seconded by Roehr that request of Oran R. Wingler and Marcia J. Wingler for vacation, sale and conveyance of a portion of unopened Willow Street located between Sally R -O -W line of Waterloo RR and E R -O -W line of Idaho Street, with City to retain drainage ease- ment, for $542.90 plus costs, and Plan and Program Commission's re- commendation for approval, be received, placed on file and "Resolu- tion fixing the time and place of hearing as July 3, 1978 on proposal to vacate, sell and convey a portion of unopened Willow Street to Oran R. Wingler and Marcia J. Wingler", adopted and Clerk instructed to publish notice of hearing. Ayes: Six. Absent: Hutchison. Reso- lution adopted and upon approval by Mayor, assigned No. 25786. 74413 - Moved by Getty, seconded by Burton that request of Sunrise Lodge #670 for permission to paint house numbers on the curbing in front of houses in Waterloo, be received, placed on file and permission grant- ed subject to the ordinances governing same. Motion carried. 74414 - 1,"owed by Dowie, seconded by Burton that request from Globe Holding Co., Inc. for permission to construct one 26' commercial curb cut at 3253 University Avenue access road, as shown on attached plat, and Acting City Engineer's recommendation for approval subject to the provisions letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. ?lotion carried. 74415 - Moved by Bowers, seconded by Getty that communication from Zoning Ad- ministrator Robert D. Gunderson submitting his notice of request to apply for retirement to be effective after July 14, 1978, after thirty years of service, be received, placed on file, approved and Mr. Gun- derson thanked for his long and faithful efforts and service to the City. Motion carried. 7441E - Moved by Getty, seconded by Wilharm that the application of Sunnyside Country Club for permission to stage a fireworks display at 1600 Olympic Drive on July 4, 1978 with alternate date of July 9, 1978 in case of inclement weather, be received, placed on file and permission granted. Beener Motion carried. 74419 - Discussed was whether a relay or two could be added and not a new box; also, if "No Right Turn" sign would solve the problem. Council- man Roehr stated the Mayor's Safety Committee would recommend side- walk; he was asked to check out the situation. Moved by Burton, seconded by Roehr that communication from Quintin T. Parker, Sign &. Traffic Department, reporting on request of Frank and Sue Rinkleff for certain safety improvements at crosswalk at Kimball Avenue and Park Lane, referred to him under Council Action #74334 of 6/5/78, and recommending a new control box be installed and sidewalks be considered from Fairlane Avenue to Kimball Avenue, be received, placed on file and action deferred until June 19, 1978 for report from Councilman Roehr. Motion carried. 74420 - James L. Dixon presented a written objection to Weekley Auto Salvage site between Power Street and John Rooff Park. Proved by Burton, seconded by Wilharm that the above objection be re- ceived and placed on file. Motion carried. 74421 - Under Council Action W74344 :)f 6/5/78 action was deferred on site re- placement selection for Vveel;ley Auto Salvage Yard. Three alternate sites were reviewed. A discussion followed on relo- cation costs being allowed only for vehicles on land purchased by City, etc. Moved by Roehr, seconded by Bowers that the Kenyon Street site be pre- liminarily approved as site replacement land for Weekley Auto Salvage and Plan and Program Commission authorized and instructed to proceed with lease arrangements subject to obtaining a current auto salvage yard license. Motion carried. 74422 - moved by Dowie, seconded by Burton that communication from Acting City Engineer, transmitting a letter of concurrence from Iowa Depart- ment of Transportation showing that on May 31, 1978, the Federal Highway Administration concurred in award of contract for [Jest Ridge- way Avenue Bridge, Contract No. 12, Project No. M-6500(504)--81-07, be received and placed on file.
