Mayor Rooffin the Chair. On roll call, Present: Bowers, Burton, Dowie, Getty, Hutchison, Roehr, Wilharm. Absent: None. Invocation by: Pastor Mark Jackson, Walnut Street Baptist Church. 74322 - Moved by Roehr, seconded by Hutchison that the Agenda, as proposed, for the Regular Session of June 5, 1978 at 7:00 P.M., be accepted and approved. Motion carried. 74323 - Moved by Dowie, seconded by Bowers that the Minutes of the Regular Session held May 22, 1978 at 7:00 P.M., be approved. Motion carried. 74324 - Moved by Roehr, seconded by Dowie that proof of publication of notice of public hearing on conditional zone in a "R-1" One and Two Family Residence District, approximately 5.25 acres in part of Section 34 -89N -13W located north of West Ridgeway Avenue and west of Bellaire Road, as published in Waterloo Courier on 5/18/78, upon the request of W. Louis Beecher and T. J. McLaughlin, upon the recommendation of City Zoning Commission and Council's own motion, be received and plac- ed on file. Motion carried. 74325 - This being the time for hearing, the Mayor called for oral and writ- ten objections, and there were none. Moved by Dowie, seconded by Bowers that "An Ordinance amending Ordin- ance No. 2479, as amended, by adding Sub -Section No. 145 to Section 2-A, conditional zoning certain property", be received, placed on file, considered and passed for the first time. Ayes: Seven. motion carried. 74326 - Moved by Roehr, seconded by Hutchison that proof of publication of notice of public hearing on conditional zone in "R-3, p -P" Planned Residence District an 80 acre tract in Section 11 -89N -13W located south of West Airline Hiway and east of Burton Avenue, as published in Waterloo Courier on 5/19/78, upon the request of Larry Lehman, up- on the recommendation of City Zoning Commission and Council's own motion, be received and placed on file. Motion carried. 74327 - This being the time for hearing, the Mayor called for oral and writ- ten objections, and there were none. However, as yet, approval from Department of Environmental Quality has not been received. Moved by Bowers, seconded by Burton that the hearing, be, and the same is; hereby adjourned to such time as Department of Environmental Quality is heard from, at the Council Chambers in City Hall in said City, at which time and place an ordinance amending Ordinance No. 2479, as amended, will be presented for consideration. Motion carried. 74328 - Moved by Dowie, seconded by Roehr that communication from Superinten- dent of Streets, transmitting the following bids for a three wheel sweeper for street maintenance purposes, and recommending the accept- ance of the low bid of Herman M. Brown Co., Cedar Rapids, Iowa, be received, placed on file, bid of Herman M. Brown Co. in the amount of $29,735.00 accepted, and Finance Director authorized and directed to issue purchase order and warrant in payment for same: F.O.B. Waterloo Elliott Equipment Co., Davenport, Ia. $31,145.00 Herman M. Brown Co., Cedar Rapids, Ia. 29,735.00 Ayes: Seven. Y2otion carried. 74330 - Councilman Burton presented a petition objecting to proposed rezoning of property at 1913 Hawthorne Avenue. Moved by Bowers, seconded by Wilharm that the above petition be re- ceived and placed on file. Motion carried. - 2 _ 74331 - Norman Bare, 3853 Wagner Road, asked about improvement for Wagner Road from Highway 57 to north City limits. Mayor Rooff stated he would meet with Street Superintendent and this road was in the three year paving program. 74332 - An area resident supported the need for a 15 m.p.h. speed limit on Adrian Street. 74333 - Mayor Rooff stated a petition objecting to paving Robin Road was re- ceived today; on Thursday, he and the Engineer would look at the street; one piece toward Black Hawk was asphalt and if good, the City would not want to tear it up; this was in abeyance as a court order had been filed. 74334 - Moved by Roehr, seconded by Dowie that request of Frank and Sue Rink- leff, Co-chairmen of Cresthaven Advisory Board, for following safety improvements at crosswalk at Kimball Avenue and Park Lane, be receiv- ed, placed on file and referred to Quintin Parker with a report back on June 12th: 1. Four-way stop walk lights; 2. Large clear markings painted on approach to intersection; 3. Establish "No turn on red" intersection; 4. Establish safety zone for access to pushbuttons and kept clear during winter months; 5. Erect pedestrian and school crossing zone signs on both sides of Park Lane. Motion carried. 74335 - Moved by Dowie, seconded by Bowers that communication from City Zon- ing Commission, reporting an error in legal description in the re- zone from "A-1" Agricultural District to "R-1" One and Two Family Residence District of 22 acres of land in Section 1 -89N -13W, north of East Airline Hiway and east of Logan Avenue, as shown on attached plat, resubmitting the request from Forrest Bentley and Carol Jean Bentley, and recommending approval, be received, placed on file, recommendation approved, date of hearing set as June 26, 1978 at 7:00 P.M. and Clerk instructed to publish notice. Motion carried. 74336 - Moved by Burton,wseconded by Hutchison that communication from City Engineer, transmitting request from Northwestern Bell Telephone Com- pany, together with IDOT "Application for use of Highway Right Of Way for Utilities Accomodation" Form #810025, for permission to place underground telephone cables in highway right-of-way north and south of Highway #412 along Hammond Avenue, as shown on attached sketch, and recommending approval, be received, placed on file, recommendation approved, permission granted in accordance therewith and Mayor author- ized to sign said application. Motion carried. 74337 - Moved by Hutchison, seconded by Getty that request of Cedar Valley Corporation, Contractors, for thirty day time extension on Virden Creek Cunette Repair, Contract No. 96, and City Engineer's recom- mendation for approval, be received, placed on file and granted. Mo- tion carried. 74338 - Moved by Roehr, seconded by Getty that request of BCP Enterprises for permission to construct two 35' commercial curb cuts for Wendy's at temporary address 1411 LaPorte Road, as shown on attached plat, and City Engineer's recommendation for approval subject to the pro- visions of his letter and approval of Iowa Department of Transporta- tion, be received, placed on file, recommendations approved and per- mission granted in accordance therewith. Motion carried. 74339 - Moved by Getty, seconded by Burton that request of Daisy Dairy, Inc. for permission to blacktop parking area on Williston Avenue and West Ninth Street for Daisy Maid Store #5, for beautification purposes only, and to blacktop the alley abutting their property to south, together with City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file and approv- ed with no cost to the City. Motion car- ried. 74345 - In a discussion on ground water problems, it was pointed out that footing drainage tile water went into the sanitary sewers. The client's representative stated they would put in perforated tile but would not be receptive to storm sewer installation. Resolution adop- ted and upon approval by Mayor, assigned No. 25773. 74354 - Moved by Bowers, seconded by Getty that communication from City En- gineer, transmitting a proposal from the Illinois Central Gulf Rail- road Company requesting the City enter into a three-part agreement with said Railroad Company and the State of Iowa to upgrade the East Fourth Street crossing, with City's share of total cost estimated June 5, 1978 - 5 - 74354 - (Continued) at $24,400 plus some asphalt overlay work on approach grades to cross- ing, and recommending authorization to proceed with preparation of said agreement, be received, placed on file, approved and City Engi- neer authorized and instructed to proceed accordingly. Moved by Getty, seconded by Burton that communication from Building Official, transmitting a proposed "Ordinance to repeal in its entire- ty Section 9-2 of Chapter 9 of the City of Waterloo Code of Ordinances, Ordinance No. 2441, Amendments to Building Code, Subsection 1, and adopting in lieu thereof the following new Subsection 1, and adopt- ing a new Section 9-6(c) as described herein", be received, placed on file, new Section 9-6(c) deleted from said Ordinance and "Ordin- ance to repeal in its entirety Section 9-2 of Chapter 9 of the City of Waterloo Code of Ordinances, Ordinance No. 2441, Amendments to Building Code, Subsection 1, and adopting in lieu thereof the follow- ing new Subsection 1", considered and passed for the first time. Motion carried. 74368 - Moved by Hutchison, seconded by Bowers that the rules requiring or- dinances to be considered and voted on for passage at two prior meet- ings, be suspended, the above ordinance recorded as having been con- sidered and passed for the second and third times, and now placed on its final adoption. Ayes: Bowers, Burton, Dowie, Getty, Hutchison, Wilharm. Roehr: Declined to vote by reason of possible conflict of interest under Section 362.6 of Code of Iowa. Motion carried. 74369 - Moved by Hutchison, seconded by Bowers that "An Ordinance amending the City Electrical Code, Ordinance No. 2071, by repealing Section 407, Schedule of Permit Fees and enacting in lieu thereof new Section 407, which new Section becomes effective July 1, 1978", be adopted. Ayes: Bowers, Burton, Dowie, Getty, Hutchison, Wilharm. Roehr: Declined to vote by reason of possible conflict of interest under Section 362.6 of Code of Iowa. Ordinance adopted and upon approval by Mayor, assigned No. 2971. 74370 - Val Martin of Waterloo -Cedar Falls Realtors Board stated the Board supported the proposed Sign Ordinance as it pertained to the Realtors. Tom Selles, Chairman of the Democratic Party, asked for action to be deferred on grounds of unconstitutional and jeopardizing first amend- ment rights. Mayor Rooff suggested waiving the fee for putting up political signs or issues to be determined at an election. Moved by Bowers, seconded by Hutchison that communication from Build- ing Official, transmitting a proposed "Ordinance repealing in its entirety Ordinance No. 2447, Waterloo, Iowa, Sign Code, and all Amend- ments thereto, and enacting in lieu thereof a new Waterloo Code of Ordinances, Chapter 3, Advertising and Signs", be received, placed on file, and said Ordinance considered and passed for the first time. Motion not carried. 74371 - Mayor Rooff asked the Councilmen who voted "no" on Sign ordinance to let him know why as he would set up a meeting with the political party chairmen and the Building Official. 74372 - Under Council Action #74243 of 5/15/78, action was deferred on a pro- posed Ordinance amending the City Electrical Code, Ordinance No. 2071, etc. Moved by Hutchison, seconded by Getty that "An Ordinance amending the City Electrical Code, Ordinance No. 2071, by repealing Sections 103-5; 104(a) ; 104(b) ; 104(c) ; 204; 306(a); 405-B(1)• 405-B(2); 405-B(3);408 (b) • 408 (c) •, 408 (e) 405-B(4); 405-B(5); 405-B(6); 405-B(9); 407; 408(f); and 410; also by repealing Articles V, VI, VII, VIII, IX, and X; and enacting in lieu thereof new Sections 104(a); 104(b); 204; 306(a) 405-B(1); 405-B(2); 405-B(3); 405-B(4); 405-B(5); 405-B(6); 407; 408 (a) (2); 408(b); 408(e); and 410, and adding new Article V thereto", be tabled indefinitely.
