Mayor Rooff in the Chair. On roll call, Present: Bowers, Burton, Dowie, Getty, Hutchison, Roehr, Wilharm Absent: None. Invocation by Councilman Getty. 74250 - Iloved by Roehr, seconded by Wilharm that the Agenda as proposed, for the Regular Session of May 22, 1978 at 7:00 P.M., be accepted and ap- proved. Motion carried. 74251 - Moved by Wilharm, secgnded by Dowie that the Minutes of the Regular Session held May 15, 1978 at 7:00 P.M., as amended, be approved. Mo- tion carried. 74252 - Moved by Dowie, seconded by Burton that proof of publication of notice of public hearing on proposed plans, specifications, form of contract, estimate of cost, etc. for F.Y. 1978 Paving Program, Contract No. 162, be received and placed on file. Motion carried. 74253 - This being the time and place fixed for a public hearing on adoption of plans, specifications, form of contract, estimated cost, for F.Y. 1978 Paving Program, Contract No. 162, the Mayor called for any oral objections to the making of said improvements, or to the adoption of the plans, specifications, form of contract or estimate of cost. No oral objections were offered and the Clerk reported that no written objections thereto had been filed. Moved by Wilharm, seconded by Getty that "Resolution adopting plans, specifications, form of contract and estimated cost for F.Y. 1978 Paving Program, Contract No. 162", be adopted. Ayes: Seven. Reso- lution adopted and upon approval by Mayor, assigned No. 25740. 74254 - The Mayor announced a further purpose of the meeting was to receive, open, consider and tabulate bids for construction of F.Y. 1978 Paving Program, Contract No. 162, in accordance with the plans and specifi- cations now adopted. The Clerk reported two bids were received. Moved by Wilharm, seconded by Hutchison that the two bids, be receiv- ed, placed on file, the Clerk instructed to open same but not read, and referred to Engineers for inspection. Motion carried. 74255 Moved by Roehr, seconded by Hutchison that proof of publication of notice of proposal to dispose of SE 50' of Lot 2, Block 12, Original Plat East, in Park Avenue and Lafayette Street area, as published in Waterloo Courier on 5/12/78, to a developer selected by the City Coun- cil for bid plus costs, be received and placed on file. Motion car- ried. 74256 - This being the time for hearing, the Mayor called for oral and written objections and there were none. City Clerk reported one bid had been received. Moved by Bowers, seconded by Dowie that the one bid, together with 10% deposit, be received, placed on file, Clerk instructed to open same but not read, and referred to Plan and Program Commission for checking. Motion carried. 74257 - Plan and Program Commission reported the bid was in order for sale and conveyance of SE 50' of Lot 2, Block 12, OPE. Moved by Bowers, seconded by Dowie that the Clerk be instructed to read same, which was as follows: Bidder Amount of Amount of Bid Check Perpetual Savin s & Loan Assn., $12,000.00 $1,200.00 Waterloo, IoN Motion carried. 74258 - The Plan and Program Commission recommended the acceptance of the bid of Perpetual Savings & Loan Association in the amount of $12,000 for SE 50' of Lot 2, Block 12, OPE. 0 74258 - (Continued) - 2 - "1 Moved by Wilharm, seconded by Dowie that the above recommendation be received, placed on file and "Resolution accepting the bid of Per- petual Savings & Loan Association in the amount of $12,000.00, approv- ing and authorizing the sale and conveyance of SE 50' of Lot 2, Block 12, Original Plat East, as published in Waterloo Courier on 5/12/78, and directing and authorizing the Mayor and Clerk to execute and de- liver a deed for said property", adopted. Resolution adopted and upon approval by Mayor, assigned No. 25741. 74259 - Moved by Roehr, seconded by Hutchison that proof of publication of notice of public hearing on proposal to vacate a portion of Elvon Street in Section 4-88-13 in Prairie Meadow West Addition, as pub- lished in Waterloo Courier on 5/5/78, requested by Home Savings and Loan Association and Country Manor, Inc., be received and placed on file. Motion carried. 74260 - This being the time for hearing, the Mayor called for oral and writ- ten objections, and there were none. Moved by Dowie, seconded by Burton that "An Ordinance vacating a portion of Elvon Street in Section 4-88-13W in Prairie Meadow L?est Addition", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 74261 - Moved by Roehr, seconded by Dowie that the rules requiring ordinances to be considered and voted on for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. Motion carried. 74262 - Moved by Wilharm, seconded by Hutchison that "An Ordinance vacating a portion of Elvon Street in Section 4-88-13W in Prairie Meadow West Addition", be adopted. Ayes: Seven. Ordinance adopted and upon ap- proval by Mayor, assigned No. 2965. 74263 - gloved by Hutchison, seconded by Roehr that proof of publication of notice of public hearing on proposal to vacate an easement in Section 4-88-13 in Prairie Meadow West Addition, as published in Waterloo Courier on 5/5/78, requested by Fred Debe for Home Savings and Loan Association and Country Manor, Inc., be received and placed on file. Motion carried. 74264 - This being the time for hearing, the Mayor called for oral and writ- ten objections and there were none. Moved by Dowie, seconded by Bowers that "An Ordinance vacating an easement in Section 4-88-13 in Prairie Meadow West Addition", be re- ceived, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 74265 - Moved by Roehr, seconded by Dowie that the rules requiring ordinances to be considered and voted on for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. Motion carried. 74266 - Moved by Dowie, seconded by Wilharm that "An Ordinance vacating an easement in Section 4-88-13 in Prairie Meadow ?lest Addition", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2966. 74267 - Moved by Roehr, seconded by Hutchison that proof of publication of notice of public hearing on site plan for commercial development within Prairie Meadow West Addition, including administrative office building for Home Savings and Loan Association, NE of intersection of Ansborough Avenue and Highway #412, upon Plan and Program Com- mision's recommendation and Council's own motion, as published in Waterloo Courier on 5/5/78, be received and placed on file. Motion carried. May 22, 1978 .O*N - 3 - 74268 - This being the time for hearing, the Mayor called for oral and writ- ten objections, and there were none. Moved by Roehr, seconded by Bowers that "Resolution approving site plan for commercial development within Prairie Meadow West Addition", be adopted, subject to Country Manor, Inc. conveying unto the City a 17 foot right-of-way. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25742. 74269 - City Engineer Radue presented a written report that Lehman Trucking and Excavating, contractors, for F.Y. 1978 Sanitary Sewer Program #1, Contract No. 190, have not complied with contract completion dates and requested written notice be issued to the contractor and his sureties that work begin within ten calendar days with continuous progress until project is completed; stating the City has authority to take over the work and complete it at contractor's expense, the unfinished balance being $12,451 plus change orders. Larry Lehman stated dewatering would have to be done and,it has been too muddy. T'layor Rooff said he has had sufficient time. Moved by Roehr, seconded by Wilharm that the above City Engineer's report, be received, placed on file, and the Mayor authorized and instructed to do whatever he deemed necessary. Motion carried. 74270 - Moved by Bowers, seconded by Burton that the application of Skyvue Drive -In Theatre for permission to stage a fireworks display at 3066 Independence Avenue on July 4, 1978 with alternate dates of July 7 or 8, 1978 in case of inclement weather, be received, placed on file and permission granted. Motion carried. 74271 - Roger Kash, 5365 Foulk Road, presented a petition from residents of Suburban Heights, Triangle Terrace and East Shaulis road requesting storm sewers, concrete paving, and curb and gutter, with said im- provements to be financed through Fourth Year Block Grant Funding and said area designated "Target Area" in the block grant program for funding. In the discussion, Mayor Rooff stated if the petition was not approved for block grant funding, it would be null and void. Moved by Dowie, seconded by Wilharm that the above petition be re- ceived, placed on file, and referred to the City Engineer for check- ing and study. Motion carried. 74272 - Larry Lehman inquired about weed cutting on flood control bank and when his driveway would be put in and was told the driveway would be a minor contract. 74273 - Councilman Getty proposed that in M-1 Light Manufacturing zoning there be a requirement that a fence be erected between the light manufacturer and the residential housing. Moved by Getty, seconded by Wilharm that the above proposal, be re- ceived, placed on file and the Zoning Commission instructed to sub- mit a recommendation. Motion carried. 74274 - The Engineers reported the bids were in order for F.Y. 1978 Paving Program, Contract No. 162. Moved by Wilharm, seconded by Dowie that the Clerk be instructed to read same, which were as follows, and referred to the Engineers for checking and report back: Amount of Bidder Amount of Bid Bid Bond Cedar Falls Construction Co., Inc. $518,492.15 5% Cedar Falls, Iowa Cedar Valley Corp., Waterloo, Iowa $516,552.90 5% Motion carried. 74275 - The Engineers, having checked the bids for F.Y. 1978 Paving Program, Contract No. 162, reported the bid of Cedar Valley Corporation of Waterloo, Iowa in the sum of $516,552.90, was the lowest bid receiv- ed. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25743. 74276 - Moved by Wilharm, seconded by Bowers that amended request of A. and M. Realty Company for Council on its own motion to rezone from "p-1" Agricultural District to "R-3, R -P" Planned Residence District ap- proximately 10 acres in Section 23 -88N -13W, south of East Orange Road and east of Hammond Avenue, and City Zoning Commission's recom- mendation for denial, be received, placed on file and request denied. Ayes: Bowers, Burton, Dowie, Roehr, Wilharm. Nay: Getty, Hutchison. Motion carried. 74277 - Moved by Wilharm, seconded by Bowers that request of Jon Fister for Kenneth Cortfight for Council on its own motion to rezone from "R-2" One and Two Family Residence District to "C-2" Commercial District approximately 1.66 acres of Lots 3 and 4, Assessor Leland's Plat No. 2, located NE of Vinton Street and W of Rhey Street, together with petition of remonstrance within 250', and City Zoning Commission's recommendation for denial, be received, placed on file and request denied. Ayes: Seven. Motion carried. 74278 - Moved by Dowie, seconded by Burton that request of Ron 11. Knudsvig for vacation of utility easement on S 3' of 8' utility and drainage easement along N lot line of Lot 34, Greenbrier Fourth Addition, and Plan and Program Commission's recommendation for denial due to IPS need, be received, placed on file and request denied. Motion carried. 74281 - Moved by Roehr, seconded by Burton that request of Shirley Ackerman for permission to construct a temporary asphalt driveway at 515 Ard- more Street without regard to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Shirley Ackerman and authorizing construction of a temporary asphalt driveway at 515 Ard- more Street irrespective of a later official grade", adopted. Neebel Construction, Inc. for permission to construct a temporary concrete driveway at 147 Niagara Drive without regard to sidewalk grade, to- gether with $3.00 for recording waiver, and City Engineer's recom- mendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permis- sion to Roger C. Neebel Construction, Inc. and authorizing construc- tion of a temporary concrete driveway at 147 Niagara Drive irrespec- tive of a later official grade", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25745. 74283 - Mayor Rooff reported trucks were denied access to 600 to 700 blocks of city streets, which was more than 10%, trucks should not be al- lowed to use dangerous streets, but consideration should be given for use of other streets. Resolution adopted and upon approval by Mayor, assigned No. 25754. 74297 - A citizen requested the elimination of the provision doubling the fee for unaltered animals in the amendatory animal and fowl ordinance. In a discussion, Mayor Rooff pointed out the ordinance could be chang- ed at a later time. Resolution adopted and upon approval by Mayor, assigned No. 25755. 74307 - Moved by Bowers, seconded by Getty that communication from Community Development Administrator, transmitting a Letter of Agreement with Sarah Dennett and Hans Muessig, photographers, Iowa City, Iowa, for preparation of necessary documentation and submission to the Division of Historic Preservation of an old Water Works Well House, which has been used as a restroom for past 16 years, in connection with Stage V -B of Local Flood Control Project, for inclusion in the National Register of Historical Buildings, for the total fee of $3,000, and recommending approval, be received, placed on file, and "Resolution authorizing execution of an Agreement with Sarah Dennett and Hans Muessig, for documentation and submission to Division of Historic Preservation of old Water Works Well House", adopted.
