The Council of City of Waterloo, Iowa, met in Regular Session in Council Cham-
bers in the City Hall at 7:00 P.M., on May 8, 1978. Mayor Rooff in the Chair.
On roll call, Present: Bowers, Burton, Dowie, Getty, Hutchison, Roehr, Wil -
harm. Absent: None. Invocation by Councilman Getty.
74148 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for
the Regular Session of May 8, 1978 at 7:00 P.M., be accepted and ap-
proved. Motion carried.
74149 - Moved by Dowie, seconded by Wilharm that the Minutes of the Regular
Session held May 1, 1978 at 7:00 P.M., as corrected, be approved.
Motion carried.
74150 - The Mayor announced this was the time set for deferred action on
Resolution of Necessity for F.Y. 1978 Paving Program, Contract No.
162, and called for oral and written objections on East Arlington
Street.
Merlin Doland presented an additional sheet to the objection petition.
Moved by Wilharm, seconded by Roehr that petition of Merlin Doland,
et al, and above sheet, objecting to paving of East Arlington Street
from Logan Avenue to East Fourth Street, under the F.Y. 1978 Paving
Program, Contract No. 162, be received and placed on file, and City
Engineer instructed to report back with percentage. Motion carried.
74151 - Moved by Roehr, seconded by Dowie that proof of publication of notice
of hearing on proposed specifications, form of contract, estimate of
cost, etc. for F.Y. 1978 Street Rejuvenation Program, Contract No.
167, and taking of bids for said improvement, be received and placed
on file. Motion carried.
74152 - This being the time for hearing, the Mayor called for oral and writ-
ten objections and there were none.
Moved by Dowie, seconded by Wilharm that "Resolution confirming ap-
proval of specifications, form of contract, estimated cost, etc. for
F.Y. 1978 Street Rejuvenation Program, Contract No. 167", be adopted.
Ayes: Seven. Resolution adopted and upon approval by Mayor, assign-
ed No. 25713.
74153 - Moved by Wilharm, seconded by Dowie that "Resolution ordering the con-
struction of F.Y. 1978 Street Rejuvenation Program, Contract No. 167",
be adopted. Ayes: Seven. Resolution adopted and upon approval by
Mayor, assigned No. 25714.
74154 - City Clerk Gibbs reported one bid had been received.
Moved by Roehr, seconded by Dowie that the one bid be received, plac-
ed on file, Clerk instructed to open same, but not read, and refer-
red to Engineers for checking and report back. Motion carried.
74155 - A petition from Lois Eileen Cusher, 1820 Sager Avenue, et al, for no
truck or commercial traffic on Sager Avenue from Doreen Avenue to
South Hackett Road was presented.
Moved by Roehr, seconded by Bowers that above petition be received
and placed on file. Motion carried.
74156 - Councilman Getty inquired about a weight embargo for Burton Avenue
and Mayor Rooff included North Hackett Road. Mentioned was Adrian
Street having no truck signs on both ends but trucks still driving
on it with overload between Highway 20 and Independence Avenue.
74157 Councilman Hutchison presented a petition from Marion Hutchison,
1241 Ackermant Street objecting to B. Schultz Company junk yard
operation on either side of Litchfield Avenue between Columbia
Street and David Street and requesting revocation of permit.
Moved by Hutchison, seconded by Wilharm that the above objection
petition be received and placed on file. Motion carried.

74158 - August Hopka, 1350 Black Hawk Road, questioned why Huntington Road
paving was paid by government and Robin Road assessed to property
owners. Mayor Rooff reported EDA funds were asked for Huntington
Road as truck traffic had ruined it in the building of flood control
dike.
74159 - Councilman Burton asked for streets to be swept in day time and
Mayor Rooff reported complaints were received due to dust. In a dis-
cussion it was decided to order day time sweeping in Fifth Ward only.
74160 - Councilman Dowie asked about feasibility of State or Federal Funds
for Shaulis Road and favored proceeding with applying for same. City
Engineer Radue reported City had FAUS funds and should look at Wagner
Road.
74161 - Councilman Bowers reported complaints that Arlie Stufflebeam was not
leveling off the streets after construction. Agnes B. Robertson re-
ported a low wet area at 1220 Cottage Grove Avenue.
74162 - Councilman Getty presented a request from Herbert V. Nelson that his
Building Mover's Permit be renewed as he had a new driver with a good
record.
City Engineer Radue recommended denial, and later agreed to condition-
al basis for 6 months to determine if performance o.k.
Moved by Getty, seconded by Wilharm that above request be received
and placed on file with City Engineer to bring application to Council
next week. Motion carried.
74163 - Agnes B. Robertson withdrew her support for neighborhood housing ser-
vices and favored housing rehab or water and sewer improvements. She
objected to every house being inspected. Councilman Hutchison read
from the agreement that building inspectors can make systematic door
to door inspections. Mayor Rooff stated the purpose was to upgrade
the neighborhood and inspections were to assure safe and sanitary
conditions. Mayor Rooff referred to "Change 1 Amendment - time limit
of 1 year", adverse conditions could arise and Council could over-
turn previous action; also; "Change 2 Amendment", only $35,000 sup-
port money would go to Washington, D.C. and the rest stayed here
under local committee; project would not be completed in 3 years;
no additional inspectors involved.
Moved by Bowers, seconded by Burton that the Mayor and City Clerk be
authorized and directed to proceed with executing this neighborhood
housing services agreement. Ayes: Bowers, Burton, Dowie, Getty.
Nay: Hutchison, Roehr, Wilharm. Motion carried.
74164 - Mayor Rooff reported on East Arlington Street from Logan Avenue to
Hope Avenue objections were 64% by property owners and 69% by cost;
from Hope Avenue to Sherman Avenue 50% and 26%; from Sherman Avenue
to Boston Avenue 50% and 50%; from Boston Avenue to East Fourth
Street 33% and 31%.
Moved by Hutchison, seconded by Getty that all of East Arlington
Street from Logan Avenue to East Fourth Street be deleted from the
FY 1978 Paving Program, Contract No. 162. Ayes: Seven. Motion
carried.
74165 - Mayor Rooff reported that on Adrian Street from Lafayette Street to
Dearborn objections were 5170 property owners and 56% cost; from
Dearborn to Highway #20 56% and 68%. He stated if a street was taken
out it probably would be 4 to 5 years before it could be put back in-
to a program.
Moved by Getty, seconded by Hutchison that Adrian Street from Lafay-
ette Street to Dubuque Road be deleted from the F.Y. 1978 Paving Pro-
gram, Contract No. 162. Ayes: Seven. Motion carried.
74166 - After discussion, it was moved by Dowie, seconded by Roehr that
"Resolution amending Resolution of Necessity for FY 1978 Paving Pro-
gram, Contract No. 162", be adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 25715.

74167 - Moved by Roehr, seconded by Dowie that "Resolution adopting Resolu-
tion of Necessity, (as amended) for FY 1978 Paving Program, Contract
No. 162", be adopted. Ayes: Seven. Resolution adopted and upon

74168 - Moved by Bowers, seconded by Burton that "Resolution directing en-
gineer to prepare detailed plans and specifications and directing
attorney to prepare form of contract and notice to bidders on the
FY 1978 Paving Program, Contract No. 162", be adopted. Ayes: Seven.
Resolution adopted and upon approval by Mayor, assigned No. 25717.
74169 - Moved by Roehr, seconded by Dowie that City Engineer's detailed
plans, specifications, form of contract, form of proposal, prelimin-
ary estimate of cost, etc. and notice to bidders for the FY 1978
Paving Program, Contract No. 162, be received, placed on file and
"Resolution ordering bids, approving plans, specifications and form
of contract and notice to bidders, fixing amount of bid security,
and ordering Clerk to publish notice and fixing a date for receiv-
ing same, and for a public hearing on plans, specifications, form
of contract and estimate of costs for the FY 1978 Paving Program,
Contract No. 162", adopted and date set as May 22, 1978. Ayes:
Seven. Resolution adopted and upon approval by Mayor, assigned No.
25718.
74170 - City Engineer reported the bids on F.Y. 1978 Street Rejuvenation
Program, Contract No. 167, were in order and could be read.
Moved by Dowie, seconded by Wilharm that the City Clerk be instruct-
ed to read the following bids referred to City Engineer for check-

74171 - The City Engineer recommended acceptance of low bid of A.spro, Inc.
of Waterloo, Iowa in the amount of $84,138.34 for Contract No. 167.

be received, placed on file and "Resolution accepting the bid of
Aspro, Inc. for F.Y. 1978 Street Rejuvenation Program, Contract No.
167", adopted. Ayes: Seven. Resolution adopted and upon approval
by Mayor, assigned No. 25719.
74172 - Moved by Roehr, seconded by Dowie that Petition and Waiver from
Harold K. and Catherine E. Dawson, 3445 East Shaulis Road, for one
additional sewer stub at an estimated cost of $338.91, together
with City Engineer's recommendation for approval, be received,
placed on file, approved and accepted, and City Engineer instructed
to proceed accordingly with said stub ordered included in the Tri-
angle Terrace Sanitary Sewer System Project, Contract No. 189.

74173 - Moved by Hutchison, seconded by Getty that request of W. Louis
Beecher and T. J. McLaughlin for Council on its own motion to Con-
ditional Zone in a "R-1" One and Two Family Residence District for
multi -use purposes, approximately 5.25 acres in part of Section
34 -89N -13W located north of West Ridgeway Avenue and west of Bell-
aire Road, as shown on attached plat, and City Zoning Commission's
recommendation for approval subject to certain conditions, be re-
ceived, placed on file, recommendations approved, date of hearing
set as June 5, 1978 at 7:00 P.M. and Clerk instructed to publish
notice. Motion carried.
74174 - Moved by Bowers, seconded by Burton that request of Perpetual Sav-
ings & Loan Association for sale and conveyance of SE 50' of Lot 2,
Block 12, OPE, adjacent to their property at corner of Park Avenue
and Lafayette Street, as shown on attached plat, and Plan and Pro-
gram Commission's recommendation for sale to a developer of Coun-
cil's choice, be received, placed on file and "Resolution fixing

gineer, transmitting a request from Martin Marietta Aggregates for
an access road to Wagner Road just north of existing bridge, as shown
on attached plat, and recommending approval, be received, placed on
file and approved. Motion carried.
74176 - Moved by Dowie, seconded by Bowers that request of John G. Miller
Construction Company for Schultz Manufacturing Company at West Parker
Street and Broadway, for permission to widen to 35' the existing
south approach on West Parker Street, as shown on attached plat, and
City Engineer's recommendation for approval subject to the provisions
of his letter, be received, placed on file, recommendations approved
and permission granted in accordance therewith. Motion carried.
74177 - Moved by Roehr, seconded by Bowers that request from Frank Curran
Construction for Tom Held, 438 Woodbridge Street, for permission to
widen to 45' the existing driveway on Upton Avenue to serve two gara-
ges, as shown on attached plat, and City Engineer's recommendation
for approval subject to the provisions of his letter, be received,
placed on file, recommendations approved and permission granted in
accordance therewith. Motion carried.
74178 - Moved by Burton, seconded by Roehr that request of George W. Fecht
for permission to construct a temporary asphalt driveway at 1738
Wakonda Drive without regard to sidewalk grade, together with $3.00
for recording waiver, and City Engineer's recommendation for approv-
al subject to the provisions of his letter, be received, placed on
file, approved and "Resolution granting permission to George W. Fecht
and authorizing construction of a temporary asphalt driveway at 1738
Wakonda Drive irrespective of a later official grade", adopted. Ayes:
Seven. Resolution adopted and upon approval by Mayor, assigned No.

74179 - Mayor Rooff reported in researching Adrian Street it was found the
majority of property owners and cost was against paving and should
be reconsidered.
Councilman Getty, who voted on prevailing side last week moved,
seconded by Bowers that Adrian Street from Lafayette Street to Dubu-
que Road be reconsidered. Motion carried.
74180 - Moved by Dowie, seconded by Bowers that the objections to Adrian
Street from Lafayette Street to Dubuque Road, and to East Arlington
Street from Logan Avenue to East Fourth Street, be sustained. Motion
carried.
74181 - Steve Schultz stated last year the Council agreed to issue a Junk
Dealer License for 1406 David Street conditional on trees being plant-
ed as a screen and this has been complied with; they would comply
with Council's request and citizens in the area.
Plan and Program Director Franke stated this Commission's recommenda-
tion was for denial. A discussion followed on screening, storage,
zoning, complaints prior to renewal, possible lawsuit, concerned
parties getting together,.etc.
Evan Hultman, Attorney for taxpayers in immediate vicinity, present-
ed his facts and observations and requested revocation of permit.
Mr. Van EE supported revocation. Court test case was discussed.
Moved by Hutchison, seconded by Bowers that the communication from
Plan and Program Commission, reporting on the application of B.
Schultz Company for a Junk Dealer License at 1.406 David Street, be
received, placed on file and said application for License denied.
Ayes: Bowers, Burton, Getty, Hutchison, Roehr. Nay: Dowie, Wil -
harm. Motion carried.

74182 - Moved by Hutchison, seconded by Getty that permit for B. Schultz
Company to operate at 1406 David Street be revoked; said company be
notified they will be expected to have all junk and salvage type
materials removed from the site by June 1, 1979; the City Attorney
be instructed to take the proper legal steps to see to it that the
Council's intent is not frustrated; the Building Official be instruc-
ted to make an inspection of the Schultz buildings at the site to
determine if operations can be allowed to continue for any part of
the next year; and the Plan and Program Department be instructed to
cooperate in any way reasonable with Schultz personnel in locating
a more suitable site for their junk operation, be approved. Motion
carried.

Report for April, 1978, showing Balance on Hand 4/1/78 $13,423,180.17,

of 5/1/78 thru 4/30/79, subject to certain stipulations, for a sum

Rooff, submitting for Council approval the reappointment of William

74196 - Mayor Rooff reported that C. W. Shirey has resigned from the Civil
Service Commission after more than 30 years service and he publicly
thanked him for his faithful efforts and tireless service.

Rooff, submitting for Council approval the appointment of Donald
Eibey, 1104 Dundee Avenue, to the Civil Service Commission, to fill
vacancy with term to expire April 1, 1980, be received, placed on

74197 - Moved by Dowie, seconded by Roehr that communication from Waterloo
Water Works quoting an excerpt from their Board meeting held April
13, 1978, re stop flow of water and prevent further damage at 610
West Eighth Street, Robert D. Gunderson, Jr. and Eileen C. Gunderson,
owners, and Lyle E. Hendren and Judith S. Hendren, contract buyers,
together with statement of cost in the amount of $83.24, in compli-
ance with City Ordinance No. 1118, be received, placed on file and
"Resolution making assessment for stoppage of flow of water and pre-
vention of further damage at 610 West Eighth Street", adopted. Ayes:

Water Works quoting an excerpt from their Board meeting held April
