HomeMy WebLinkAbout04/17/78April 17, 1978 The Council of City of Waterloo, Iowa, met in Regular Session in Council Cham- bers in the City Hall at 7:00 P.M., on April 17, 1978. Mayor Rooff in the Chair. On roll call, Present: Bowers, Burton, Dowie, Getty, Hutchison, Roehr, Wilharm. Absent: None. Invocation by Councilman Burton. 73982 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for the Regular Session of April 17, 1978 at 7:00 P.M., be accepted and approved. Motion carried. 73983 - Moved by Wilharm, seconded by Dowie that the Minutes of the Regular Session held April 10, 1978 at 7:00 P.M. and Special Session on April 13, 1978 at 4:30 P.M,, be approved. Motion carried. 73984 - Moved by Bowers, seconded by Hutchison that the proof of publication of Notice of Assessment (Weed Cutting or Destroying for the Year 1977) in the City of Waterloo, Iowa, be received and placed on file. Motion carried. 73985 - This being the time for hearing, the Mayor called for oral and writ- ten objections. The Clerk reported written objections were filed by: 1. Dwayne R.R. Eilers to 2167 Independence Avenue. There were no oral objections. Councilman Getty asked and was told landowners were not notified before cutting of weeds and a discussion followed. Moved by Wilharm, seconded by Roehr that above objection be received, placed on file and "A resolution overruling the objections to assess- ment to 1977 Weed Program", be adopted. Ayes: Bowers, Burton, Dowie, Hutchison, Roehr, Wilharm. Nay: Getty. Resolution adopted and upon approval by Mayor, assigned No. 25677. 73986 - Moved by Bowers, seconded by Burton that "Resolution making assess- ments for cutting and destruction of weeds in the City of Waterloo, Iowa, for 1977", be adopted. Ayes: Bowers, Burton, Dowie, Hutchison, Roehr, Wilharm. Nay: Getty. Resolution adopted and upon approval by Mayor, assigned No. 25673. 73987'- Moved by Dowie, seconded by Bowers that proof of publication of notice of proposal to convey an easement along the Wly property line of City's Turnkey Elderly Housing Project at 225 West Ridgeway Avenue to Iowa Public Service Company, as published in Waterloo Courier on 3/31/78, be received and placed on file. Motion carried. 73988 - This being the time for hearing, the Mayor called for written and oral objections, and there were none. Moved by Wilharm, seconded by Roehr that Resolution approving and authorizing the conveyance of an Easement to Iowa Public Service Company for utility purposes along Westerly property line at 225 West Ridgeway Avenue, as published in Waterloo Courier on 3/31/78, and directing and authorizing Mayor and Clerk to execute and deliver said Easement", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25679. 73989 - Moved by Roehr, seconded by Hutchison that proof of publication of notice of public hearing on rezoning from "A-1" Agricultural District to "R-1" One and Two Family Residence District, 22 acres of land in Section 1 -89N -12W, North of East Airline Hiway and East of Logan Ave- nue, as published in Waterloo Courier on 3/31/78, upon the request of Forrest Bentley and Carol Jean Bentley, upon the recommendation of City Zoning Commission and Council's own motion, be received and placed on file. Motion carried. 73990 - This being the time for hearing, the Mayor called for oral and writ- ten objections, and there were none. Moved by Roehr, seconded by Dowie that "An Ordinance amending Ordin- ance No. 2479, as amended, by adding Sub -Section No. 141 to Section 2A-5, rezoning certain property", be received, placed on file, con- sidered and passed for the first time. Ayes: Seven. Motion carried. ''*_-I -IN - 2 - 73991 - Moved by Wilharm, seconded by Bowers that the rules requiring ordin- ances to be considered and voted on for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Motion carried. 73992 - Moved by Bowers, seconded by Hutchison that "An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 141 to Section 2A-5, rezoning certain property", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2960. 73993 - Moved by Roehr, seconded by Hutchison that proof of publication of notice of public hearing on rezoning from "R-4" Multiple Residence District to "C-2" Commercial District All of Lots 2 and 3 in Hallocks Plat of Outlots, located SE of West Ninth Street and SW of Washington Street, as published in Waterloo Courier on 3/31/78, upon the request of Mack Gable, upon the recommendation of City Zoning Commission and Council's own motion, be received and placed on file. Motion carried. 73994 - This being the time for hearing, the Mayor called for oral and writ- ten objections, and there were none. Moved by Hutchison, seconded by Dowie that "An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 142 to Section 2A-5, rezoning certain property", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 73995 - Moved by Roehr, seconded by Hutchison that proof of publication of notice of public hearing on rezoning from "U-1" Unclassified District to "R-2" One and Two Family Residence District approximately 58 acres, being All of Hollywood Addition and part of Lewis Miller's Small Farms lying South of centerline of Campbell Avenue and its Westerly exten- sion, located West of Ansborough Avenue and Northwesterly of U.S. Hwy. 63, as published in Waterloo Courier on 3/31/78, upon the request of City Zoning Commission, and their recommendation, and Council's own motion, be received and placed on file. Motion carried. 73996 - This being the time for hearing, the Mayor called for oral and writ- ten objections, and there were none. Moved by Bowers, seconded by Dowie that "An Ordinance amending Ordin- ance No. 2479, as amended, by adding Sub -Section No. 143 to Section 2A-5, rezoning certain property", be received, placed on file, con- sidered and passed for the first time. Ayes: Seven. Motion carried. 73997 - Moved by Roehr, seconded by Wilharm that the rules requiring ordin- ances to be considered and voted on for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. Motion carried. 73998 - Moved by Wilharm, seconded by Dowie that "An Ordinance amending Ordin- ance No. 2479, as amended, by adding Sub -Section No. 143 to Section 2A-5, rezoning certain property", be adopted. Ayes: Seven. Ordin- ance adopted and upon approval by Mayor, assigned No. 2961. 73999 - City Engineer Radue briefly explained the Garden Avenue assessment notice to Dorothy Gardner and Mayor Rooff asked that the notice be revised to also show City's share. 74000 - Moved by Bowers, seconded by none that the Council proceed with an agreement for neighborhood housing. Died for lack of a second. 74001 - Moved by Roehr, seconded by Burton that a special meeting be called for May 2, 1978 at 7:00 P.M. in the Council Chambers in City Hall for the purpose of considering neighborhood housing. Ayes: Burton, Dowie, Hutchison, Roehr, Wilharm. Nays: Bowers and Getty. Motion carried. April 17, 1978 - 3 - 74002 - Moved by Bowers, seconded by Burton that request from Northwestern Bell Telephone Company, together with IDOT Application for use,of Highway Right of Way for Utilities Accommodation, Form #810025, for permission to install underground conduit and manholes along Highway #281 from Idaho Street to Skyview Road, as shown on attached sketch, and City Engineer's recommendation for approval, be received, placed on file, approved and Mayor authorized to sign said application. Motion carried. 74003 - City Engineer Radue recommended a standard condition for approval of paving parking area be the requirement that underground street wire be installed in conduit. Moved by Roehr, seconded by Dowie that request of Immanual Lutheran Church for permission to asphalt the parking area at 215 Franklin Street, for beautification purposes only, as shown on attached plat, and City Engineer's recommendation for approval, be received, placed on file and approved at no cost to the City subject to installation of conduit for underground street wire by property owner. Motion carried. 74004 - Under Council Action #73818 of 3/20/78 the hearing on the Site plan for Elliott Planned Unit Development, Phase I, on U.S. Highway 218 and South of East Shaulis Road was adjourned to this time and place. Moved by Dowie, seconded by Hutchison that the communication from Plan and Program Director requesting further adjournment of hearing on the above Site Plan, be received, placed on file, approved and the hearing on the Site plan for Elliott Planned Unit Development, Phase I, on U.S. Highway 218 and South of East Shaulis Road be and the same is hereby further adjourned to April 24, 1978 at 7:00 P.M. at the Council Chambers in the City Hall in said City at which time and place this Council will take up and consider a resolution approving said site plan. Motion carried. 74005 - Under Council Action #73822 of 3/20/78 the hearing on Site plan for ASCS Office within Elliott Planned Unit Development, Phase I, on U.S. Highway 218 and South of East Shaulis Road was adjourned to this time and place. Moved by Wilharm, seconded by Burton that the communication from Plan and Program Director requesting further adjournment of hearing on the above Site Plan, be received, placed on file, approved and the hearing on the Site Plan for ASCS Office within Elliott Planned Unit Development, Phase I, on U.S. Highway 218 and South of East Shaulis Road be and the same is hereby further adjourned to April 24, 1978 at 7:00 P.M. at the Council Chambers in the City Hall in said City at which time and place this Council will take up and consider a resolution approving said site plan. Motion carried. 74006 - Under Council Action #73944 of 4/10/78 action was deferred on request of Helen Riley for no truck traffic on Burton Avenue pending City En- gineer's report on thickness of street. Moved by Dowie, seconded by Roehr that the report of the City Engin- eer on the thickness of concrete on Burton Avenue be received, placed on file and request denied. Motion carried. 74007 - Moved by Roehr, seconded by Bowers that minutes of Community Develop- ment Board for regular meeting held on March 14, 1978, be received and placed on file. Motion carried. 74008 - Moved by Bowers, seconded by Roehr that communication from Plan and Program Director, transmitting a Quit Claim Deed dated 3/30/78 from Homer S. Cortright, conveying unto the City of Waterloo, Iowa, cer- tain right-of-way in Section 20 -89N -12W for the sum of $2,754.93 for storm drainage facility on Independence Avenue, and recommend- ing acceptance, be received, placed on file, approved and "Resolution approving and accepting Quit Claim Deed from Homer S. Cortright and directing recording of same", adopted and Finance Officer instruct- ed to issue a warrant accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25680. April 17, 1978 4 - 74009 - Moved by Roehr, seconded by Wilharm that Change Order No. 2 for EDA City Hall Annex, Contract B-38, for additional work done by Jens Olesen & Sons Construction Co. at an additional cost of $190.00, and Community Development Administrator's recommendation for approval, be received, placed on file, approved and Mayor and Clerk authorized to execute same. Ayes: Seven. Motion carried. 74010 - Moved by Dowie, seconded by Hutchison that Change Orders No. 1 and No. 2 for Triangle Terrace Sanitary Sewer System, Contract No. 189, for additional work by Northern Contracting Company at an additional cost of $2,243.25 and $5,052.00 respectively, and City Engineer's recommendation for approval, be received, placed on file, approved and Mayor and Clerk authorized to execute same. Ayes: Seven. Mo- tion carried. 74011 - Moved by Burton, seconded by Bowers that Contract dated 4/17/78 with Schenk Engineering Company for Contract No. 166 and City Engineer's recommendation for approval, be received, placed on file and "Resolu- tion approving the Contract with Schenk Engineering Company for engineering services for FY 1979 Paving Program, Contract No. 166, and directing execution of same by Mayor and Clerk", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25681. 74012 - Moved by Bowers, seconded by Getty that construction plans for sani- tary sewerage facilities serving Homestead Addition, together with Treatment Agreement Form C 9/75 for Department of Environmental Qual- ity, and City Engineer's recommendation for approval subject to final acceptance of plans being reviewed and accepted by DEQ, be received, placed on file, recommendations approved and Mayor and Clerk authorized to execute said Agreement Form. Motion carried. 74013 - Moved by Roehr, seconded by Dowie that construction plans for sani- tary sewerage facilities serving Audubon Park First Addition, together with Treatment Agreement Form C 9/75 for Department of Environmental Quality, and City Engineer's recommendation for approval subject to final acceptance of plans being reviewed and accepted by DEQ, be received, placed on file, recommendations approved and Mayor and Clerk authorized to execute said Agreement Form. Motion carried. 74014 - Moved by Dowie, seconded by Bowers that the following Construction Permits from Iowa Department of Environmental Quality, subject to certain conditions and requirements, be received and placed on file: No. 78-287-S for Sanitary Sewer Extension to Pine Hill Addition; No. 78-277-S for Sanitary Sewer Extension to Sturdy Addition; No. 78-289-W for Water Main Extension to Westbourne Terrace Fourth Addition; No. 78-285-S for Sanitary Sewer Extension to Quail Valley; No. 78-299-W for Water Main Extension to Quail Valley. Motion carried. 74015 - Moved by Wilharm, seconded by Bowers that "A resolution transferring from the Federal Revenue Sharing Fund the sum of One million dollars ($1,000,000.00) to the General Fund", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25682. 74016 - Moved by Wilharm, seconded by Bowers that following requests for permission to attend functions, with expenses allowed not to exceed the amounts shown, be received, placed on file and approved: Superintendent of Sewers to 6th Tri-State American Public Works Con- ference, Rockford, Illinois, May 10 through 12, 1978, $175.00 plus use of City car. Building Official and 3 Building Inspectors to Iowa State University 2 Day Intensive Workshop for Home Builders and Building Inspectors at Conway Center, Waterloo, Iowa, April 17 and 18, 1978, $90.00. Finance Director/City Treasurer to 72nd Annual Municipal Finance Officers Association International Conference on Public Finance, Houston, Texas, May 14 thru 18, 1978, $617.00. Ayes: Seven.
