February 20, 1978 The Council of City of Waterloo, Iowa, met in Regular Session in Council Chambers in City Hall at 7:00 P.M. on February 20, 1978. Mayor Rooff in the Chair. On roll call, Present: Bowers, Burton, Dowie, Getty, Hutchison, Roehr, Wilharm. Absent: None. Invocation by Councilman Wilharm. 73650 - Moved by Roehr, seconded by Dowie that the Agenda, as proposed, for the Regular Session of February 20, 1978 at 7:00 P.M., be accepted and approved. Motion carried. 73651 - Moved by Wilharm, seconded by Bowers that the Minutes of the Regular Session held February 13, 1978 at 7:00 P.M., be approved. Motion carried. 73652 - Moved by Bowers, seconded by Wilharm that thefollowingsealed informal bids for purchase of fast dry traffic paint and thinner for use by the Traffic and Street Sign Department, be received, placed on file, Clerk instructed to open same but not read, and said bids referred to the Finance Committee and Traffic and Street Sign Department with a report back. Motion carried. 73653 - Harry Hill asked if the recommendations for paving of Garden Avenue submitted at the public hearing held at the Recreation Center had been presented to the Council. Community Development Administrator Mercer stated this was present- ed at the last Board meeting. 73654 - Moved by Roehr, seconded by Burton that communication from Quintin Parker, Sign & Traffic Maintenance Department, reporting on the speed limits on the following streets, referred to him under Council Action #73643 of 2/13/78, together with recommendations, be received, placed on file, recommendations approved and City Attorney instructed to submit an ordinance accordingly: Street Recommended MPH West Donald Street from Longfellow Avenue to Moline Road From 25 to 30 MPH East Donald Street from Moline Road to Sage Road From 35 to 45 MPH East Donald Street from Sage Road to North Elk Run Road to 55 MPH Conger Street - West and East From 30 to 35 MPH from Burton Avenue East Ridgeway Avenue from Hammond Avenue to Rainbow Drive to San Marnan Drive From 25 to 35 MPH Motion carried. 73655 - Moved by Dowie, seconded by Wilharm that communication from City Engineer, advising improvements required as a condition precedent to final approval of Hammond Hills Fourth Addition have been com- pleted in substantial conformance with construction plans, stand- ards and requirements of his office, submitting four-year main- tenance bond for street improvements and two-year for sewer im- provements, and recommending acceptance of said addition and bonds, be received, placed on file, approved and accepted with effective dates of bonds being February 20, 1978. Motion carried. 73656 - Moved by Roehr, seconded by Hutchison that communication from City Engineer, transmitting legal description and plat of Sears Street between Iowa Highway 412 and Crossroads Boulevard, and Grimm Street between U.S. Highway 218 and Crossroads Boulevard, advising the improvements have been completed and meet City requirements, and recommending acceptance, be received, placed on file and "Resolu- tion approving and accepting Sears Street between Iowa Highway 412 and Crossroads Boulevard, and Grimm Street between U.S. Highway 218 and Crossroads Boulevard as public streets", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25596. - 2 - 73657 - Moved by Bowers, seconded by Dowie that the proposed Fiscal Year 1979 Budget for the twelve months of July 1, 1978 through June 30, 1979, be received, placed on file, and the Council having duly considered said Budget and being fully advised, finds that hear- ing date should be fixed and does hereby set March 2, 1978 at 7:00 P.M. in the Waterloo Recreation Center, in said City, as the date, time and place for said hearing, and the City Clerk is here- by instructed to publish the Budget Estimate Summary and Notice of Hearing, which is worded and figures as follows: (See follow- ing page 3) Ayes: Seven. Motion carried. 73658 - Mayor Rooff stated the proposed Cable T.V. Regulatory Ordinance, Section 2, TERM OF FRANCHISE, on page 3, is to be amended by striking lines four through eight and inserting the following in lieu thereof: "proceeding affording due process, Grantee, its successors and assigns, be and is hereby granted the right, franchise and au- thority for a period not to exceed twenty-five (25) years, with the city having an option pursuant to a full public proceeding to renew for an additional not to exceed twenty-five (25) years, to acquire, construct, and operate a cable television." Moved by Roehr, seconded by Burton that the above amendment to the proposed "Ordinance regulating Cable Television", be received, placed on file, considered and passed for the first time, and the rules requiring ordinances to be considered and voted on for passage at two prior meetings, be suspended, the above amend- ment recorded as having been considered and passed for the second time, and now made a part of the proposed "Ordinance regulating Cable Television". Ayes: Seven. Motion carried. 73659 - Moved by Getty, seconded by Roehr that "Ordinance regulating Cable Television", be received, placed on file, considered and passed for the second time. Ayes: Seven. Motion carried. 73660 - Moved by Wilharm, seconded by Hutchison that "An Ordinance amend- ing Ordinance No. 2479, as amended, by adding Sub -Section No. 138 to Section 2A-5, rezoning certain property", be received, placed on file, considered and the rules requiring ordinances to be considered and voted on for passage at two prior meetings, be suspended, the above ordinance recorded as having been con- sidered and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. Motion carried. 73661 - Moved by Getty, seconded by Hutchison that "An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 138 to Section 2A-5, rezoning certain property", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2947. 73662 - Moved by Hutchison, seconded by Bowers that "A resolution rescind- ing Resolution No. 28803 (passed September 10, 1974), Resolution No. 23750 (passed February 24, 1975), Resolution No. 24530 (passed April 26, 1976) and Resolution No. 25592 (passed February 13, 1978), all defining certain terms and prohibiting Truck Traffic on certain streets in the City of Waterloo, Iowa, and providing penalty for the violation of the terms thereof", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25597. 73663 - Moved by Hutchison, seconded by Getty that "An Ordinance amending Ordinance No. 2644, known as the Traffic Ordinance, by adding Section 569, Truck Traffic prohibited on certain streets", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 73664 - Moved by Roehr, seconded by Hutchison that the rules requiring ordinances to be considered and voted on for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Roethler must be reconsidered to facilitate the proper transfer of deed to Patricia Ann Christianson, for $600 plus costs, be received, placed on file and action deferred until February 27, 1978.
