The Council of the City of Waterloo, Iowa met in Regular Session in Council Chambers in the
City Hall at 7:00 P.M., on December 10, 1979. Mayor Rooff in the Chair. On roll call:
Present: Wilharm, Roehr, Penaluna, Getty, Dowie, Burton, Bowers. Absent: None. Invocation
by Councilman Bowers.
77547 - Mayor Rooff welcomed Council Member Getty back to the Council meeting.
77548 - Moved by Roehr, seconded by Dowie that the Agenda, as amended for the Regular Session of
December 10, 1979 at 7,00 P.M., be accepted and approved. Motion carried.
77549 - Moved by Penaluna, seconded by Burton that the Minutes of the Regular Session held
December 3, 1979 at 7:00 P.M., be approved. Motion carried.
77550 - Council Member Bowers asked what has been done on the sewer problem in 600 block of
North Barclay Street as the ground was freezing, and City Engineer Anderson stated there
should be a solution by next week with work to start the first week in January, 1980.
77551 - Council Member Burton asked for a report within two weeks on massage technicians who
have not renewed their licenses after the ordinance was adopted requiring 756 hours of
schooling. Mayor Rooff asked the Clerk for the list and the Police Chief to check the
same.
77552 - Moved by Dowie, seconded by Bowers that communication from Plan and Program Commission,
requesting new public hearing to correct typographical error in the legal description in
the sale and conveyance of Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, Block 9, Auditor Rainbow's
Plat of Maywood Second Filing to Dwayne R. R. Eilers for the sum of $1800 by Resolution
No. 24944 adopted 1/24/77, be received, placed on file and "Resolution fixing the time
and place of hearing as December 26, 1979 on proposal to convey certain real property
to Dwayne R. R. Eilers", adopted and Clerk instructed to publish notice of hearing.
Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26674.
77553 - Moved by Roehr, seconded by Burton that request of Capitol Savings and Loan Association
for Council on its own motion to rezone from "R -3,R -P" Planned Residence District to
"M -2,P" Planned Industrial District approximately 10 acres in part of Section 11 -89N -13W
located east of Burton Avenue and 1/4 mile south of West Airline Hiway, as shown on
attached plat, together with objection petition from Bruce Smith Realty Company, and City
Zoning Commission's recommendation for approval, be received, placed on file, recom-
mendation approved, date of hearing set as January 7, 1980 at 7:00 P.M. and Clerk
instructed to publish notice. Motion carried.
77554 - Moved by Bowers, seconded by Burton that request of Lewis W. McCallum for Council on
its own motion to rezone from "M-1" Light Industrial District to "R-2" One and Two
Family Residence District All of Blocks 21 and 22, Auditor Rainbow's Plat of Maywood
Second Filing, bounded by Osage Road, Fulton Street, Gilbert Street and Bishop Avenue,
as shown on attached plat, for one and two family residence purposes, and City Zoning
-Commission's recommendation for approval, be received, placed on file, recommendation
approved, date of hearing set as January7, 1980 at 7:00 P.M. and Clerk instructed to
publish notice. Motion carried.

77556 - Plan and Program Director Franke stated Iowa Public Service Co. had donated this land
to the City but did not oppose the disposal provided a small portion would be retained.
Moved by Bowers, seconded by Burton that communication from Plan and Program Commission,
transmitting request of Russ Folkers to purchase approximately 1 z acres in parts of
Lots 1 and 2, and Lots 3, 4, 5, 6 and 7, and NWly-SEly vacated alley, all in Block 2,
Riverside Addition, subject to easements, as shown on attached plat and legally
described in attached Exhibit "A", and recommending approval subject to City's retention
of easement and that an appraisal be obtained, be received, placed on file and "Resolu-
tion fixing the time and place of hearing and receiving of bids as December 26, 1979
at 7:00 P.M. in Council Chambers in City Hall on the proposal to sell and convey
approximately 1 �j acres in parts of Lots 1 and 2, and Lots 3, 4, 5, 6 and 7, and NWly-
SEly vacated alley, all in Block 2, Riverside Addition, subject to City's retention of
easement, to the highest bidder", adopted and Clerk instructed to publish notice of
hearing. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No.
26675.

77557 - Moved by Roehr, seconded by Penaluna that the communication from the City Engineer,
advising improvements required as a condition precedent to final approval of plat of
the addition to be known as Pro's Addition have been completed in substantial confor-
mance with construction plans, standards and requirements of his office, submitting
four-year maintenance bond for street improvements and two-year maintenance bond for
the sewer improvements, and recommending acceptance of said addition and bonds, be
received, placed on file, approved and accepted with effective dates of bonds being.

1979, showing Fund Balance 11/1/79 $18,563,078.50, + Receipts $4,912,708.72, - Bill
Payments $2,159,058.70, - Payrolls $1, 216,420.14, - Transfers $214,292.46, - Commis-
sions $3,023,193.36, Fund Balance 11/30/79 $16,862,822.56, be received, placed on file
and approved. Motion carried.
77560 - Moved by Dowie, seconded by Roehr that communication from Plan and Program Commission,
transmitting request of F. R. Debe for James W. and Marjorie M. Youngblut to dedicate
to City a drainage easement in Cedar Crest as described in attached Exhibit "A", to-
gether with said easemP-nt, and recommending approval, be received, placed on file,
same approved and accepted and Clerk instructed to record same. Motion carried.

sewer facilities serving Bronson First Addition, as submittied by Wayne Claassen

mission, transmitting a site plan for Walgreen Drug Store and proposed rental area to
be located inthe Crossroads Shopping Center, and recommending approval, and on Council's
own motion, be rec&ived, placed on file, approved and date of hearing set as January
7, 1980 at 7:00 P.M. in City Hall and Clerk instructed to publish notice. Motion

transmitting site plan for First Church of the Nazarene located west of Hammond Avenue
and approximately 700' north of Wildwood Road, and recommending approval subject to
certain conditions on parking, etc., and on Council's own motion, be received, placed
on file, approved and date of hearing set as January 7, 1980 at 7:00 P.M. in City
Hall and Clerk instructed to publish notice. Motion carried.

with Deed of Dedication, report of City Engineer, report of Brice, Petrides & Associates
re impact on Sanitary Wastewater Collection System, Plan and Program Commission's
resolution of approval and its recommendation for Council approval, be received
placed on file and "Resolution approving the Preliminary Plat of Sixth Addition to
Southridge, Waterloo, Black Hawk County, Iowa", adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 26676.

and "Resolution approving the Preliminary Plat of Chambers' Addition, Waterloo, Black

77566 - Moved by Wilharm, seconded by Bowers that "An Ordinance of the City of Waterloo, Iowa,
designated as the Uniform Building Code, 1979 Edition, as published in 1979 by The
International Conference of Building Officials, which regulates the erection, construc-
tion, enlargement, alteration, repair, moving, removal, demolition, conversion, occu-
pancy, equipment, use, height, area, and maintenance of all buildings and/or structures
in the City of Waterloo, Iowa; providing for the issuance of permits and collection of
fees therefor; repealing in its entirety Table No. 3-A, Building Permit Fees, of
Chapter 3, and adopting in lieu thereof new Table No. 3-A, Building Permit Fees;
Repealing Ordinance No. 2696 and Section 9-5 of Chapter 9 of the City of Waterloo,
Iowa, and all other Ordinances and parts of Ordinances in conflict therewith", be

now placed on its final adoption. Ayes: Seven. Motion carried.
77569 - Moved by Burton, seconded by Bowers that "An Ordinance changing the name of a portion
of Elvon Street to Home Plaza", be adopted. Ayes: Seven. Ordinance adopted and
upon approval by Mayor, assigned No. 3063.

ting resignation from the Heating Board, be received, placed on file and Mr. Halbmaier
thanked for his efforts. Motion carried.
77573 - Moved by Burton, seconded by Bowers that communication from Mayor Rooff, submitting
for Council approval the appointment of Gail Mickle, 227 Cutler Street, to the Heating
Board to fill above vacancy for the unexpired term ending December 31, 1980, be re-
ceived, placed on file and approved. Motion carried.
77574 - Moved by Burton, seconded by Dowie that communication from Plan and Program Commission,
transmitting City Engineer's request for naming the following three private street names
within the City of Waterloo, and recommending approval, be received, placed on file,
approved and City Attorney instructed to submit an ordinance accordingly:
Cobblestone Circle - the first street east of Ansborough Avenue running from Meadow
Lane to the north; thence east, thence south to Meadow Lane;
Porter Drive - the first street north of Meadow Lane running from Cobblestone
Circle to Cobblestone Circle.
Peoples Square - the first street west of Kimball Avenue running south from Olympic
Drive.

Board, transmitting a Final Audit Report from Department of Transportation Urban Mass
Transportation Administration for Project No. IA -03-0009 (new bus garage, tools,
equipment, etc.) and request for reimbursement to Federal Government be authorized in
the amount of $3,291.80, being overpayment due to Sales Tax Refund, be received,
placed on file, and approved. Ayes: Seven. Motion carried.
77576 - Moved by Roehr, seconded by Wilharm that Brice, Petrides & Associates, Inc., Consulting
Engineers, be instructed to prepare specifications, plans, form of contract, estimate
cost, etc. for Dry Run Creek Flood Control Works, Contract No. 99A. Motion carried.
