The Council of the City of Waterloo, Iowa met in Regular Session in Council Chambers in the City
Hall at 7:00 P.M., on November 19, 1979. Mayor Pro Tem Roehr in the Chair. On roll call:
Present: Wilharm, Roehr, Penaluna Dowie, Bowers. Absent: Getty, Burton. Invocation by
Councilman Bowers.
77470 - Moved by Wilharm, seconded by Bowers that the Agenda, as proposed, for the Regular Ses-
sion of November 19, 1979 at 7:00 P.M., be accepted and approved. Motion carried.
77471 - Moved by Dowie, seconded by Wilharm that the Minutes of the Regular Session held November
12, 1979 it 7:00 P.M., be approved. Motion carried.
77472 - Moved by Wilharm, seconded by Dowie that proof of publication of notice of public hear-
ing on proposed plans, specifications, form of contract, estimate of cost, etc. for
Repairs -to the Slope Protection Pavement for Mullan Avenue Bridge, Contract No. 15, and
the taking of bids therefor, be received and placed on file. Motion carried.
77473 - This being the time and place for hearing, the Mayor Pro Tem called for written and
oral objections, and there were none.
Moved by Bowers, seconded by Wilharm that "Resolution confirming the approval of plans,
specifications, etc. for the Repairs to the Slope Protection Pavement for Mullan Avenue
Bridge, Contract No. 15", be adopted. Ayes: Five. Absent: Getty, Burton. Resolution
adopted and upon approval by Mayor Pro Tem, assigned No. 26646.
77474 - Moved by Penaluna, seconded by Bowers that "Resolution ordering the construction of
Repairs to the Slope Protection Pavement for. Mullan Avenue Bridge, Contract No. 15",
be adopted. Ayes: Five. Absent: Getty, Burton. Resolution adopted and upon approval
by Mayor Pro Tem, assigned No. 26647.
77475 - Moved by Wilharm,seconded by Bowers that the following bids, be received, placed on file,
Clerk instructed to open and read same and bids referred to the Engineers for checking

77476 - Moved by Dowie, seconded by Wilharm that proof of publication of notice of public hear-
ing on proposal to vacate 10' alley west of and adjacent to Lots 1-14, Block 4, Pros-
pect Heights and sell and convey that portion west of and adjacent to Lots 13-14, Block
4, Prospect Heights to Garry Donald and/or Sandra Rae Stuber, as published in Waterloo
Courier on 11/9/79, for $87.50 plus costs, be received and placed on file. Motion
carried.
77477 - This being the time and place for hearing, the Mayor Pro Tem called for written and
oral objections, and there were none.
Moved by Penaluna, seconded by Dowie that "Ordinance vacating 10 foot alley lying west
of and adjacent to Lots 1 - 14, Block 4, Prospect Heights", be received, placed on file,
considered and passed for the first time. Ayes: Five. Absent: Getty, Burton.

77478 - Moved by Wilharm, seconded by Bowers that proof of publication of notice of public
hearing on proposal to vacate, sell and convey a portion of Litchfield Avenue, as
published in Waterloo Courier on 11/9/79, to B. Schultz Company and the Lloyd Kreger
Estate, for $1,585.72 plus costs, be received and placed on file. Motion carried.
77479 - This being the time and place for hearing, the Mayor Pro Tem called for written and oral
objections, and the Clerk reported there had been no written objections filed.
Marion Hutchison objected and questioned the closing of the road, cost of snow removal,
future zoning, legality of original zoning, traffic count, construction of railroad
track and who gave permission, and legal description in notice.
Steve Schultz stated only track on Schultz property was replaced, etc.
Moved by Dowie, seconded by Penaluna that "Ordinance vacating a portion of Litchfield
Avenue", be received, placed on file, considered and passed for first time.
Ayes: Five. Absent: Getty, Burton. Motion carried.

77480 - The City Engineer recommended acceptance of low bid of Taylor-Isenhower, Inc., in the
amount of $12,575.00 for Alternate lA for Contract No. 15.
Moved by Bowers, seconded by Penaluna that the above recommendation be received, placed
on file and "Resolution accepting the bid of Taylor-Isenhower, Inc. for Alternate lA
for Repairs to the Slope Protection Pavement for Mullan Avenue Bridge, Contract No. 15",
adopted. Ayes: Five. Absent: Getty, Burton. Resolution adopted and upon approval
by Mayor Pro Tem, assigned No. 26648.
77481 - Paul Chambers, 1221 Julian Avenue, presented a petition with 208 signatures for Black
Hawk Road from the dike west to city limits to be repaired and shoulders added, and
pointed out the number of accidents and deaths which have occurred.
Moved by Wilharm, seconded by Dowie that the above petition be received, placed on
file and referred to the proper department. Motion carried.
77482 - Norman Stahl, 722 Dearborn Avenue, reported culvert crossing at Dearborn Avenue has
been cleaned out and bank resculptured but dirt left in piles. Council Member Bowers
stated he would follow thru on this.
77483 - Wilda Bowman, 628 Hope Street, inquired if block grant funds had been approved for paving
of 400, 500, 600, and 700 blocks of Hope Avenue (see Council Action #76935 of 8/20/79)
and was informed this was not in a neighborhood strategy area, and was on City Engineer's
list to be brought to Council when next paving program was put together.
77484 - Council Member Penaluna presented a petition from Elmer H. Moeller, 755 Dawson Street
for paving of 800-900-1000-1100 blocks of Ashland Avenue in the 1980 paving program or
by block grant funds.
Moved by Penaluna, seconded by Dowie that the above petition be received, placed on file
and referred to the City Engineer. Motion carried.
77485 - Asst. City Engineer Thorson presented the Five Year Street Construction Program.
Moved by Penaluna, seconded by Bowers that the above Five Year Street Construction Pro-
gram for July 1, 1979 to June 30, 1984 as prepared by the Engineering Department to be
submitted to the Iowa Department of Transportation with street systems map, be received,
placed on file and "Resolution approving the Five Year Street Construction Program and
Street Systems Map", adopted. Ayes: Five. Absent: Getty, Burton. Resolution adopted
and upon approval by Mayor Pro Tem, assigned No. 26649.
77486 - Moved by Bowers, seconded by Dowie that request of C.W. Shirey Company for permission to
construct one median cut on River Road, as shown on attached plat, and City Engineer's
recommendation for approval subject to the provisions of his letter, be received, placed
on file and referred to Iowa Department of Transportation and City Attorney for further
information. Motion carried.
77487 - Reed Craft, Waterworks General Manager, reported water main is at normal depth and ser-
vice line is problem of home owners. Discussed was getting too much cold because of
storm sewer being close to water main, putting in more space, going under the water
main, etc.
Moved by Dowie, seconded by Penaluna that petition of Bernice Hansen, et al, homeowners
in 200 block of Fairfield Street, requesting that something be done about water lines
freezing in the street before freezing weather, be received, placed on file and referred
to City Engineer to contact Bernice Hansen and neighbors about this problem. Motion
carried.
77488 - Building Committee Chairman Bowers reported a study would be on all locks.
Moved by Bowers, seconded by Penaluna that communication from Police Chief, recommending
the two doors at the rear of the Police Department be restricted to police personnel
only, be received, placed on file and approved. Motion carried.
77489 - Moved by Penaluna, seconded by Bowers that request of Albert L. .icnsen for permission
to construct one temporary asphalt driveway at 3930 Cedar Terrace Drive, without regard
to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recom-
mendation for approval subject to the provision of his letter, be received, placed on
file, approved and "Resolution granting permission to Albert L. Jensen and authorizing
construction of a temporary asphalt driveway at 3930 Cedar Terrace Drive, irrespective
of a later official grade", adopted. Ayes: Five. Absent: Getty, Burton. Resolution
adopted and upon approval by Mayor Pro Tem, assigned No. 26650.
77490 - Under Council Action #774U of 11/13/79 the proposal to change business pro-
cedure of Waterloo Yellow Cab Company was referred to City Attorney. City Attorney
Hultman requested addition time to make the report.

placed on file and report deferred until December 3, 1979. Motion carried.
77491 - Under Council Action #774!9 of 11/5/79, action was deferred on the termination of Andrid
Olson from the Sign and Traffic Department and entitlement to sick leave and vacation
pay in the amount of $1,877.86.
City Attorney Hultman stated there was no problem as Andrid Olson could resign from the
Sign and Traffic Department, draw his sick leave and vacation pay, and then join the
Fire Department as they were separate entities, where he would have to start from
scratch.
Moved by.Dowie, seconded by Bowers that "Resolution approving payment of $1,877.86
sick leave and vacation pay to Andrid Olson of Sign & Traffic Department", adopted.
Ayes: Five. Absent: Getty, Burton. Resolution adopted and upon approval by Mayor
Pro Tem, assigned No. 26651.
77492 - Moved by Bowers, seconded by Penaluna that minutes of the regular meeting of the
Community Development Board held October 9, 1979 at 7:00 P.M. and Special Board Meeting
held October 17, 1979 at 3:30 P.M., be received, placed on file and approved. Motion
carried.
77493 - Moved by Bowers, seconded by Dowie that Abstract of Election Report of Official Count
by Black Hawk County Board of Supervisors as Board of Canvassers of ballots cast at
Regular Municipal Election held on November 6, 1979, and declaration of whom convassers
determine to be elected, as submitted by Black Hawk County Commissioner of Elections,
be received and placed on file. MRtion carried.
77494 - Moved by Penaluna, seconded by Wilharm that "An Ordinance establishing names for certain
private streets within the City of Waterloo, Iowa", be received, placed on file, consid-
ered and passed for the first.time. Ayes: Five. Absent: Getty, Burton. Motion
carried.

Avenue, be received, placed on file and granted. Motion carried.
77498 - Moved by Dowie, seconded by Bowers that Rubble Disposal Bond of Young Plumbing & Heating
Co., in the amount of $1,000.00 for operation of a private land fill (dump) in Kings-
wood Second Addition in accordance with bond, be received, placed on file, approved and
permission granted. Motion carried.
77499 - Moved by Bowers, seconded by Dowie that report of City Attorney and list of bonds
filed with Clerk through 11/19/79 be received, placed on file and report and bonds
approved. Motion carried.

77500 - Moved by Wilharm, seconded by Penaluna that the Council adjourn to meet as a Board of
Health. Motion carried.

The Council of the City of Waterloo, Iowa, met as the Board of Health in Council
Chambers in the City Hall at 8:00 P.M., on November 19, 1979. Mayor Pro Tem in the
Chair. On roll call: Present: Wilharm, Roehr, Penaluna, Dowie, Bowers. Absent:
Getty, Burton.
Sanitation/Health Director Hoffman reported on present sanitation and health conditions;
asked for imput on the pigeon problem; reported on FDA food seminar; food services
establishments inspected twice annually without notice, etc.
Moved by Dowie, seconded by Wilharm that the above report, be received and placed on
file. Motion carried.
Marshall Harms reported a severe mosquito problem during the summer which was aggravated
by water backing up west of Hackett Road in the construction rubble deposit area.
Samitation/Health Director Hoffman stated the City could not document there was a drain-
age way in this area so could not deny the use of this fill pit; beavers dam up water;
road elevation causes back up; culvert recommended or open ditch through debris area.
Moved by Dowie, seconded by Wilharm that the above presentation be received, placed on
file and Sanitation/Health Director and the City Engineer instructed to contact Marshall
Harms to find a solution. Motion carried.
There being no further business, it was moved by Bowers, seconded by Penaluna that the
Board of Health adjourn back to Council meeting. Motion carried.
