Motion carried. -2- 71:'5 - This being the time and place for hearing, the Mayor called for written and oral objectioi and there were none. James Yagla, Atty. for M & K Enterprises, spoke in support of vacation of easement, over 3' of which the building is constructed, offering to move the whole easement 3' as they own the surrounding land, and, if denied, would be forced' into litigation. Plan and Program Director Franke recommended, if approved, the City receive a hold harmless agree- ment for any damage to this building. Mayorl,Rooff reported the owners agreed to move the building before construction, and recommended denial. Building Official Parsons stated an occupancy permit would not be issued, if denied, and citation given for violation. Moved by Penaluna, seconded by Dowie that the request for vacation of a drainage easement in NE Fractional !z of Section 2 -88N -13W near'corner of Highway 412 and LaPorte Road area from M & K Enterprises, be denied. Poore, 1414 Meadow Lane, for area residents, presented a map with sketch shown flooding problem on Meadow Lane in vicinity of Westridge Avenue and Mt. Vernon Drive caused by inadequate storm drainage from Meadow Lane and across Ridgeway Avenue, together with written report explaining research done, and request for consideration of immediate action and long term solution as recommended in the Delane Avenue Drainage Study of April, 1977. Payor Rooff reported in the five-year plan, the second step was the culverts, there were some funds left, and scheduled for second construction season. Motion carried. 77134 - Nancy Schlachter, 1222 Leavitt Street, reported she was paying double garbage fees as the other living quarters at this address have not been occupied since 1976 and she has been billed for two addresses. Mayor Rooff said this would be worked out and brought back to the Council. 77135 - Moved by Dowie, seconded by Burton that request of Virgil Loui Eilers, Samella Chambers and Elaine Mary Morrison for vacation, sale and conveyance of east -west alley in Block 1, Ricker and Bratnober's Addition for $0.10 per square foot plus costs, and Plan and Pro- gram Commission's recommendation for approval, be received, placed on file, and "Resolu- tion fixing the time and place of hearing as October 15, 1979 on proposal to vacate, sell and convey certain real property to Virgil Loui Eilers, Samella Chambers and Elaine Mary Morrison", adopted and Clerk instructed to publish notice of hearing. T7a47 - Under Council Action #77086 of 9/17/79 action was adjourned on request of Janet Kalsem, 427 Belle Street, for conditional zone in "U-1" Unclassified District, All of Lot 5, Cedar Terrace Addition, north of Belle Street and west of Southcrest Drive. Mayor Rooff stated there was one correction, the existing zoning was not "U-1" but was "R-2", and last week the action was deferred to determine if under conditional zoning only one step up could be taken. He pointed out that if the school moved away, the zoning would automatically revert back to original zoning. Council Member Burton presented a support letter from Virginia F. Ritter, Associate Pro- fessor, U.N.I., and protest letters from Betty Myers, 503 Belle Street, and from Donald E. and Betty Myers, Ora J. and Velva M. Butts, and George A. and Collene M. Peirce. Moved by Burton, seconded by Wilharm that the above -letters, be received and placed on file. Motion carried. 7149 - Under Council Action #77097 of 9/17/79, action was deferred on City Engineer's report on improvements required as a condition precedent to final approval of Plat of Westbourne Terrace Fourth Addition. Mayor Rooff reported the City Engineer has requested further delay as this Addition was in the same watershed as the subdivision over which the City was involved in litigation presently. Moved by Roehr, seconded by Dowie that action on the above be further deferred until the litigation is resolved.
