August 20, 1979
The Council of the City of Waterloo, Iowa met in Regular Session in Council
Chambers in the City Hall at 7:00 P.M., on August 20, 1979. Mayor Rooff in
the Chair. On roll call: Present: Wilharm, Roehr, Penaluna, Getty, Dowie,
Burton, Bowers. Absent: None. Invocation by Councilman Wilharm.
76924 - Moved by Dowie, seconded by Getty that the Agenda, as proposed for
the Regular Session of August 20, 1979 at 7:00 P.M., be accepted and
approved. Motion carried.
76925 - Moved by Wilharm, seconded by Bowers that the Minutes of the Regular
Session held August 13, 1979 at 7:OO P.M., and of the Special Session
held August 15, 1979 at 1:00 P.M. be approved. Motion carried.
76926 - Moved by Roehr, seconded by Dowie that proof of publication of Notice
of Intention to Issue Hospital Facilities Revenue Bonds (St. Francis
Hospital Project) Series 1979, in the City of Waterloo, Iowa, as pub-
lished in Waterloo Courier on 8/1/79, be received and placed on file.
Motion carried.
76927 - The Mayor announced this was the time and place for the public hearing
and called for written and oral objections, and there were none.
Moved by Wilharm, seconded by Burton that a further public hearing be
held on the issuance of Not to Exceed $10,500,000 Hospital Facilities
Revenue Bonds (St -Francis Hospital Project) Series 1979, at a time and
place to be determined by the Council at a later date. Ayes: Seven.
Motion carried.
76928 - Moved by Burton, seconded by Wilharm that proof of publication of notice
of public hearing to sell Disposal Parcel No. J -26(P), 138 Harrison
Street, in Westfield -Virden Urban Renewal Area, Project No. Iowa R-7,
to Lawrence and Roxanne Seals, as published in Waterloo Courier on
July 19, 1979, be received and placed on file. Motion carried.
76929 - This being the time for hearing, the Mayor called for oral and written
objections, and there were none.
Moved by Bowers, seconded by Wilharm that "A resolution approving the
sale of Disposal Parcel No. J -26(P) in the Westfield Virden Urban Re-
newal Area, Project No. Iowa R-7, and authorizing the execution of the
necessary contract for sale of land for private redev.�lopment and deed",
be adopted. Ayes: Seven. Resolution adopted and upon approval by
Mayor, assigned No. 26467.
76930 - Mrs. Thomas Cromwell, 516 Ash Street, reported Ash Street was tore up
when the storm sewer was constructed and asked that it be returned to
its original oil base condition.
Moved by Wilharm, seconded by Dowie that the above request be received,
placed on file and referred to the City Engineer with a report back.
Motion carried.
76931 - Norman Stahl, 722 Dearborn Avenue, asked what was to be done about
"bridge" over Blowers Creek on Dearborn Avenue, which created a dam
and caused a water problem. Discussed was lowering multiple culverts
upstream and on Dearborn Avenue, which were being cleaned at this time
for better flow; lowering the road; dike cut and grade survey; clean,
grade and reshaping channel priority; City doing what it can to alle-
viate problem immediately with Corps of Engineers to take care of in
the future.
76932 - Charles Walters, 725 Stephan Avenue, supported by Gary Schmitz, 732
Stephan Avenue, Mike Hurley, 1853 Carriage Hill Drive, Robert Myers,
1903 Carriage Hill Drive, Walter Kuenstling, 739 Stephan Avenue, and
others, reported the water draining onto their properties from Exel
Inn was causing problems. Mayor Rooff stated the developers, at time
of building, assured the City the parking lot would hold the difference
in water run off between bare ground and paved surface and would not
drain off any faster than normally on bare ground; the parking lot was
to be bowl shaped, however, he had no quarrel with basin on one end
which two engineers said had the capacity of a 100 year rain, but the
problem was with the material used, and no occupancy permit would be
issued until parking lot was properly built, which was costing Exel
Inn a loss from $700 to $900 each day. Discussed was water run off

from Perkins, Cooks, Happy Joe's, water drainage study, danger to child-
ren, etc.
Lucille Hartema, 814 Hanna Blvd., reported even though she had two sump
pumps, she had water with raw sewage in her basement five times this
year and her deep freeze has been set on end to drain the water three
times.
Moved by Roehr, seconded by Penaluna that the above reports, be received
and placed on file. Motion carried.
76933 - Carol Barneson, 5072 Foulk Road, reported a swale, which ended at Shau-
lis Road, was put in behind her home last week and now she was getting'
the drainage from the trailer court. Mayor Rooff stated the swale was
at back of property line and the outlet at Shaulis Road should be clean-
ed out so the water could go to the creek. Discussed was completion
date for sewer which was still within the contract time, after which
the paving contractor had an additional 50 days.
76934 - Moved by Roehr, seconded by Wilharm that offer of Edward J. Polk, 425
Logan Avenue, to purchase Disposal Parcel No. J -28(P), in Westfield -
Virden Urban Renewal Area, Project No. Iowa R-7, for the sum of $75.00
for side yard purposes, and approval report of Community Development
Board, be received, placed on file and "A resolution authorizing the
sale of Disposal Parcel No. J -28(P) in the Westfield -Virden Urban Re-
newal Area, Project No. Iowa R-7", adopted and hearing set for September
24, 1979 at 7:00 P.M. in Council Chambers in City Hall. Ayes: Seven.
Resolution adopted and upon approval by Mayor, assigned No. 26468.
76935 - Moved by Bowers, seconded by Burton.that communication from City Engin-
eer, transmitting a petition from Aaron L. Abernathy, 725 Hope Avenue,
et al, representing 60% of the property owners, for paving of 400, 500;
600 and 700 blocks of Hope Avenue under the Block Grant program, and
recommending approval when said funds are available, be received,
placed on file and referred to the Community Development Board. Motion
carried.
76936 - Moved by Burton, seconded by Bowers that request of Schenk Engineering
Company for permission to construct two commercial curb cuts in South -
town Addition, Lot No. 7 and N6_8;toserve 4039 and 4103 Alexandra Drive,
as shown on attached plat, and City Engineer's recommendation for app-
roval subject to the provisions of his letter, be received, placed on
file, recommendations approved and permission granted in accordance
therewith. Motion carried.
76937 - Moved by Dowie, seconded by Roehr that request of Joe Minard Construc-
tion, Inc. for permission to construct one 22' commercial curb cut to
serve 3863 Paige Drive, as shown on attached plat, and City Engineer's
recommendation for approval subject to the provisions of his letter,
be received, placed on file, recommendations approved and permission
granted in accordance therewith. Motion carried.
76938 - Moved by Getty, seconded by Dowie that request of Joe Minard Construc-
tion, Inc. for permission to construct one 22' commercial curb cut to
serve Lot 124, 3837 Paige Drive, as shown on attached plat, and City
Engineer's recommendation for approval subject to the provisions of his
letter, be received, placed on file, recommendations approved and per
mission granted in accordance therewith. Motion carried.
76939 - Moved by Getty, seconded by Dowie that request of Joe Minard Construc-
tion, Inc. for permission to construct one 22' commercial curb cut to
serve 3853 Paige Drive, as shown on attached plat, and City Engineer's
recommendation for approval subject to the provisions of his letter,
be received, placed on file, recommendations approved and permission
granted in accordance therewith. Motion carried.
76940 - Moved by Penaluna, seconded by Bowers that request of Lawrence J. Bates
for permission to construct a temporary asphalt driveway at 2100 Mul-
berry Street without regard to sidewalk grade, together with $3.00 for
recording waiver, and City Engineer's recommendation for approval sub-
ject to the provisions of his letter, be received, placed on file,

authorizing construction of a temporary asphalt driveway at 2100 Mul-

76941 - Moved by Burton, seconded by Penaluna that Annual Report of Waterloo
Public Library for period of 7/1/78 - 6/30/79, be received and placed
on file. Motion carried.
76942 - Moved by Roehr, seconded by Getty that minutes of the regular meeting
of the Community Development Board held July 10, 1979 at 7:00 P.M.,
be received, placed on file and approved. Motion carried.
76943 - Moved by Penaluna, seconded by Getty that Change Order No. 4 for F.Y.
1979 Paving Program No. 2, Contract No. 170, for additional work at an
additional cost of $8,940.00, by Cedar Valley Corporation, and City
Engineer's recommendation for approval, be received, placed on file,
approved and Mayor and City Clerk authorized to execute same. Ayes:
Seven. Motion carried.
76944 - Moved by Roehr, seconded by Dowie that " esolut' pr 'ng for the
issuance of $1,735,000 Corporate Purpose Bon and providi for the
levy of taxes to buy the same", be adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigne No. 26470.
76945 - Moved by Getty, seconded by Bowers that folloo ' g re u for permission'
to attend function, with expenses allowed not to exceed amount shown,
be received, placed on file and approved:
City Clerk, Finance Director/Treasurer and Personnel Director to League
of Iowa Municipalities 81st Annual Convention, Cedar Rapids, Iowa,
September 12, 13 and 14, 1979, $178.50 each.
