Mayor Rooff in the Chair. On roll call: Present: Wilharm., Roehr, Penaluna, Getty, Burton, Bowers.` Absent: Dowie. Invocation by Councilman Bowers. 76646 - Moved by Roehr, seconded by Wilharm that the Agenda, as proposed for the Regular Session of July 9, 1979 at 7:00 P.M., be accepted and approved. Motion carried. 76647 - Moved by Wilharm, seconded by Burton that the Minutes of the Regular Session held July 2, 1979 at 7:00 P.M., be approved. Motion carried. 76648 - Mayor Rooff welcomed the Provisional Class of the Junior Service League. 76649 - Veta Gardner, Bill Blair, Mary Ann Dorsey and others, spokesmen for CCI Trap, demanded enforcement of Uniform Building Code to force landlords to repair or demolish substandard buildings, and the adoption of a resolution establishing a revolving fund. A letter was read stating the Neighborhood Housing Service revolving loan fund would be used for voluntary rehabilitation of residential units within specific N.H.S. area and limited to owner occupied units with owner's consent. City Attorney Hultman stated the fact that the Council passed a docu- ment didn't necessarily make it a law as the Council could only do what the state or federal laws said it could do. He noted the Preface of the Uniform Building Code pointed out under different state and local laws many things in the Code were not enforceable, and in this case, some of the properties were in court and others tied up in bankruptcy. He asked if tenants have filed under Chapter 562A of Iowa Code whereby the repairs could be made and deducted from month's rent. He offered to do further research if CCI would provide any opinion from Attorney General, any statute, court order, or any authority, as he could not find anything. After several angry interruptions, Mayor Rooff called for order. City Attorney Hultman continued, that railroad repairs were covered in State code. Mayor Rooff pointed out that last week he asked the Council to support him in railroad repairs and assessing cost to railroad as provided in State Code. Community Enabler Jim Porter stated he had never known a group to have to proof anything, that Home Rule exists, Council should pass this and then refer to Attorney General to see if it could do it, and if not, it could be rescinded. Council Member Getty pointed out the allocation of $30,000 block grant funds for demolition of dangerous buildings. Discussed was need of court permission, census tracts, need of more complete list as last list was tied up in Robert Smith bankruptcy proceedings. Moved by Roehr, seconded by Getty that above presentations be received and placed on file. Motion carried. 76650 - Mayor Rooff recommended that blocking of all City railroad crossings be limited to ten minutes if moving and five minutes if stopped, with the exclusion of East Fourth Street and east end of East Eleventh Street in Rath area. Moved by Bowers, seconded by Burton that above recommendation, be received, placed on file, approved subject to possible exclusion of East Fourth Street and east end of East Eleventh Street in Rath area, and City Attorney instructed to submit an ordinance accordingly. Motion carried. 76651 - Council Member Getty presented a petition from Mr. and Mrs. David L. Hall, 216 Polk Street, et al, for posting of a speed limit of 10 MPH in alley parallel to and between Polk Street and French Street. Moved by Getty, eived, placed on back on July 16, July 9, 1979 seconded by Penaluna that the above petition be rec- file, referred to Police Department with a report 1979. Motion carried. -2- 76652 - Mrs. Ken Dooley, 192 Greenwood Drive, reported on July 4th a beer bust, loud blaring live music, illegal fireworks, at 160 Greenwood Avenue, Sherwood Park, attended by a big overflowing crowd with heavy traffic, blocking of streets, parking on surrounding residents lawns, etc., police were called, and presented a flyer advertising the event. Mayor Rooff stated no permit would be granted again. Moved by Wilharm, seconded by R.oehr that the above report and flyer, be received and placed on file. Motion carried. 76653 - Mrs. Roy Lauer, 320 Fox Street, reported water standing in Short and Mulberry Street area. City Engineer Anderson stated contract has been let but too wet to move equipment in. Alvin Bernett, 3001 Mulberry Street, said it was now dry enough to dig. Charles Saul, 3100 Franklin Street, said he understood that City would furnish tile and Dick Ander- son would do the work, and City Attorney Hultman confirmed this. 76654 - Ron Sawyer, reported sewer at 861 West Airline Hiway was not properly installed as culverts not set right and asked this to be corrected. Mayor Rooff stated this project was not finalized, the request was valid, and if necessary, after 10 days, the City would go to the bonding company. 76655 - Council Member Burton presented a petition from David D. DeLancey, 800 block of Denver Street, for something to be done about ridge that parallels Williston Avenue on south side of intersection with Denver Street, and repair potholes. Moved by Burton, seconded by Bowers that the above petition, be re- ceived, placed on file, referred to the Street Department with report and recommendation back on July 16, 1979. Motion carried. 76656 - Council Member Getty reported a problem in the 1000 block of Riehl Street and 900 block of Kern Street, as contractor tore up sidewalk to street to lower and regrade for entrance from street and has not replaced same. Discussed was including in specifications that con- tractor replace in same form as removed; if better desired, the property owner pay additional cost; also City Engineer should make sure the backfill is something that will stay, with top few inches suitable for planting. Council Member Roehr pointed out the City approves temporary drive- ways, and some properties change owners several times and are unaware of their responsibility. Gene Fisher, 916 Kern Street, asked if the property owners would have to pay for paving on entrance of alley and also up the hill, also lowering the sidewalk to get into the alley. Moved by Getty, seconded by Burton that the above report be received, placed on file and referred to the City Engineer with a report back. Motion carried. 76657 - Leroy Powell, 351 Bates Street, requested demolition of three houses and Mayor Rooff asked for addresses. 76658 - Moved by Burton, seconded by Wilharm that communication from City Engineer, transmitting a petition from Doug and Jennie Erpelding, 823 Forest Avenue, et al, for oiling of 800 block of Forest Avenue, representing 71% of property frontages, be received and placed on file and approved. Motion carried. 76659 - Mayor Rooff recommended withholding action for one week as Building Official Parsons had asked Board of Supervisors to have structures demolished, and houses addresses were needed. Moved by Bowers, seconded by Getty that communication from Black Hawk County Board of Supervisors, advising offers have been made on 6/11/79 for following properties in amounts shown, on which Black Hawk County holds title, and requesting cancellation of special assessments, be received, placed on file, and action deferred until July 16, 1979 subject to Board of Supervisors furnishing house number and street addresses: July 9, 1979 -3- 76659 - (Continued) Motion carried. 76660 - Moved by Wilharm, seconded by Getty that request from John Deere Waterloo Tractor Works for permission to construct one 36' commercial curb cut on Westfield Avenue, and four 22' commercial curb cuts on Vaughn Street to serve the "Headford's Parking Lot", as shown on attached plat, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 76661 - Moved by Roehr, seconded by Getty that request of Michael P -.Murphy for permission to construct a temporary concrete driveway at 501 Edison Street without regard to sidewalk grade, together with $3.00 for re- cording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Michael P. Mayor Rooff noted that Council Member Dowie was absent and Les Timm- erman wanted to delay another week. Motion carried. 76667 - Bruce Radue and Rose Welter objected to rezone; Les Timmerman supported rezone; and a discussion followed. Moved by Getty, seconded by Penaluna that the above request of Capitol Savings and Loan Association to rezone from "R-3, R -P" Planned Residence District to "M-1" Light Industrial District 80 acres in Section 11 -89N - 13W east of Burton Avenue and 520' south of Airline Hiway, be denied.
