Mayor Rooff in the Chair. On roll call: Present: Bowers, Burton, Dowie, Getty, Penaluna, Roehr, Wilharm. Absent: None. Invocation by Councilman Getty. 76496 - Moved by Roehr, seconded by Bowers that the Agenda, as proposed, for the Regular Session of June 18, 1979 at 7:00 P.M., be accepted and approved. Motion carried. 76497 - Moved by Dowie, seconded by Burton that the Minutes of the Regular Session held June 11, 1979 at 7:00 P.M., be approved. Motion carried. 76498 - Moved by Roehr, seconded by Dowie that communication from City Engineer, recommending rejection of all bids for Dry Run Creek Flood Control Works, Contract No. 99A and Contract No. 99B, and bid of Acton Construction Co., Inc. for Contract No. 99C, and acceptance of bid of Peterson Contractors, Inc., Reinbeck, Iowa, in amount of $677,982.32 for Contract No. 99C, be received, placed on file, re- commendations approved, said bids rejected in accordance therewith and "Resolution making award of contract for Dry Run Creek Flood Control Works, Contract No. 99C, to Peterson Contractors, Inc. in the amount of $677,982.32", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26356. 76499 - Mayor Rooff welcomed Ray and Dottie Leitz. 76500 - Robert Utsler, 306 French Street, asked what the findings were on insulation of street sewer pipes and if insulation could be extended 3 to 4 feet to keep inlet from freezing. City Engineer Anderson stated the easiest way out at this time would be insulation but he could not guarantee results . A discussion followed and it was suggested to get Fred Debe, City Engineer Anderson and Sewer Supt. Huntley together to get a written report and solution to the problem. As only two weeks were left before laying of pavement, Fred Debe's report was expected on June 25, 1979. 76501 •- C.L. Hoffman complained of thistles and noxious weeds on corner of Hanna Blvd. and Stratford Avenue, and plum thicket on corner of Idaho and Donald Streets, which caused a dangerous vision hazard; and was pleased with street paving. Mayor Rooff said he would have this taken care of. Moved by Bowers, seconded by Burton that the above complaints and approval, be received and placed on file. Motion carried. 76502 - Robert Nagle, 2272 Independence Avenue, reported water in his back yard. Mayor Rooff stated City staff had talked to Carl Kessel and were going to try to get a machine in there gouge it out, and that funding was being pursued; also, there may be court action. Moved by Bowers, seconded by Getty that the above report be received and placed on file. Motion carried. 76503 - Mayor Rooff reported a lawsuit had been filed by Shadow Wood Co., DNSTRA, Inc. and L.T. Enterprises against the City concerning the Castle Hill area building moratorium and platting of Homestead First Addition, and suggested the Council not discuss this matter with any- one and do their talking about it in Court, and then the Court will find its own way. 76504 - Moved by Roehr, seconded by Bowers that offer of Dubuque Blacktop Company, Box 386, Dubuque, Iowa, to purchase Disposal Parcel No. 42, 915 E. 4th Street, in Logan Avenue Urban Renewal Area, Project No. Iowa R-2, for the sum of $16,800.00, for construction of building for Job Service of Iowa, and approval report of Community Development Board, be received, placed on file and "A resolution authorizing the sale of Disposal Parcel No. 42, 915 E. 4th Street in Logan Avenue Urban Renewal Area, Project No. Iowa R-2", adopted, and hearing set for July 23, 1979 at 7:00 P.M. in Council Chambers in City Hall. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26357. June 18, 1979 -2- 76505 - Moved by Dowie, seconded by Burton that request from Beemac, Inc. for permission to construct one 34' commercial curb cut on Bellaire Road to serve parking lot at National Plaza, as shown on attached plat, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 76506 - Moved by Burton, seconded by Bowers that request from John G. Miller Construction Co. for permission to construct two 30' commercial drives, one each on Commercial Street and Jefferson Street to serve "Happy Chef" Restaurant at 218 West Mullan Avenue, as shown on attached plat, and City Engineer's recommendation for approval subject to the pro- visions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 76507 - Moved by Penaluna, seconded by Getty that request from Francis Camarata for permission to widen existing driveway, at 501 Park Lane from 16' to 32', as shown on attached plat, and City Engineer's recommendation for approval subject to provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 76508 - Moved by Dowie, seconded by Burton that request of Valeria Martin for permission to construct a temporary concrete driveway at 1931 Locke Avenue without regard to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Valeria Martin and authorizing construction of a temporary concrete driveway at 1931 Locke Avenue, irrespective of a later official grade", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26358. 76509 - Moved by Burton, seconded by Bowers that minutes of the regular meeting of the Community Development Board held May 8, 1979 at 7:00 P.M., be received, placed on file and approved. Motion carried. 76510 - Moved by Dowie, seconded by Penaluna that communication from City Engineer recommending acceptance of National Drive as a city street and approval of Final Plat of National Plaza (see Council Action #76470 of 6/11/79), be received, placed on file, said street accepted and "Resolution approving the Final Plat of National Plaza, Waterloo, Black Hawk County, Iowa", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26359. 76511 - Moved by Roehr, seconded by Bowers that Final Plat of Lark Addition, Engineer's Certificate of Survey, Deed of Dedication, Contract and Waivers, report of City Engineer, Plan and Program Commission's resolution of approval and recommendation for Council approval, be received, placed on file and "Resolution approving the Final Plat of Lark Addition, Waterloo, Black Hawk County, Iowa", adopted and Mayor and Clerk directed and authorized to execute said Contract. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26360. 76512 - Moved by Penaluna, seconded by Burton that "An Ordinance amending Chapter 34, Article III, Sewers, of the Code of Ordinances of the City of Waterloo, by repealing Section 34-54, Basic charge and rates established; basis of determination; increase of rates and charges for delinquent payments, paragraph (f) and enacting in lieu thereof new Section 34-54, paragraph (f)", be received, placed on file, con- sidered and passed for the first time. Ayes: Seven. Motion carried. 76513 - Moved by Burton, seconded by Bowers that "Resolution approving and providing for the execution of Housing and Community Development Block Grant Contract No. B-794IC-19-0003by and between the City of Waterloo and the U.S. Department of Housing and Urban Development", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26361. 76514 - Moved by Bowers, seconded by Roehr that "A Resolution amending the Community Development Block Grant Program Budget transferring funds in the amount of $12,414.25 from "Completion of Urban Renewal" to Public Works, Facilities and Site Improvements", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26362. 18, 1979 -3- 76515 - Council Member Getty, Chairman , reported the Finance Committee re- commendation for salary increase for non-union employees was 7%. Council Member Roehr asked if some could be amended at a later date and Mayor Rooff said yes but to make amendment effective that date. Council Member Burton felt as Council had no control over Boards and Commissions, it was unfair to other department heads. Council Member Wilharm stated the Council could control through budget appropriations. Moved by Getty, seconded by Wilharm that "Resolution fixing the com- pensation of the City of Waterloo Officials and Employees", be adopted. Ayes: Seven. Resolution adopted and upon approval of Mayor, assigned No. 26363. 76516 - Moved by Burton, seconded by Getty that communication from City Engineer, transmitting three proposals from following firms for a study of thirty (30) most dangerous street intersections, and re- commending acceptance of Booker & Associates, Inc., St. Louis, Missouri, be received, placed on file and "Resolution approving and accepting the proposal of Booker & Associates, Inc., of St. Louis, Missouri for a study of thirty most dangerous street intersections in Waterloo, Iowa", adopted, subject to list of intersections being furnished Council Members: Booker & Associates, Inc., St. Louis, Missouri Brice,Petrides & Associates, Inc., Waterloo, Iowa Alan M. Voorhees & Associates,Inc.,St. Louis,Missouri Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26364. 76517 - Discussed were the three proposals for radio communication repair service. Moved by Bowers, seconded by None that the Rosenkrans Electronic Company, Waterloo, Iowa, proposal for radio communication repair ser- vice be approved and accepted. Motion died for lack of a second. 76518 - Moved by Dowie, seconded by Roehr that communication from Plan and - Program Commission, transmitting tabulation of three proposals from following firms for radio communication repair service, and re- commending contract period of 7/1/79 thru 6/30/80, be received, placed on file and referred to Finance Committee for a substantiated recommendation: Bob's Two Way - Original, Evansdale Bob's Two Way - New, Evansdale Rosenkrans Electronic Company, Waterloo Motion carried. 76519 — Moved by Bowers, seconded by Wilharm that communication from Finance Director requesting Budget for Fiscal Year 1979 be amended as follows,`` be received, placed on file and Clerk instructed to publish notice of hearing on proposed amendment of current city budget, as required by law, with date of hearing being set as June 25, 1979 at 7:00 P.M.: (next page) Motion carried. 76520 - Moved by Roehr, seconded by Getty that communication from Waterloo Water Works Board, transmitting their resolution adopted 6/6/79, re stop the flow of water and prevent further damage at 514 Ankeny Street, together with statement of cost in the amount of $327.54 and waivers from Donna Zilk, 514 Ankeny Street, Contract Purchaser, and Kathleen H. Keefer, 641 Wyoming Street, Owner, in compliance with City Ordin- ance No. 1118, be received, placed on file and "Resolution making assessment for stoppage of flow of water and prevention of further damage at 514 Ankeny Street", adopted. Ayes: Seven. Motion carried. 76525 - Moved by Dowie, seconded by Roehr that report of City Attorney and list of bonds filed with Clerk through 6/18/79 be received, placed on file and report and bonds approved.
