The Council of City of Waterloo, Iowa met in Regular Session in Council Chambers
in the City Hall at 7:00 P.M., on May 7, 1979. Jack L. Roehr, Mayor Pro Tem in
the Chair. On roll call: Present: Bowers, Burton, Getty, Pe.naluna, Roehr,
Wilharm. Absent: Dowie. Invocation by Councilman Wilharm.
76191 - Moved by Burton, seconded by Bowers that the Agenda, as proposed, for the
Regular Session of May 7, 1979 at 7:00 P.M., be accepted and approved.
Motion carried.
76192 - Moved by Wilharm, seconded by Getty that the Minutes of the Regular Ses-
sion held April 23, 1979 at 7:00 P.M., be approved. Motion carried.
76193 - Moved by Getty, seconded by Bowers that proof of publication of Notice
of Bond Sale of $33,000 Sewer Improvement Bonds for Huntington Road Storm
Sewer District Project, Contract No. 95, (Special Assessments), be re-
ceived and placed on file. Motion carried.
76194 - The Mayor Pro Tem announced that this being the time and place for the
opening of bids for the sale of $33,000.00 Sewer Improvement Bonds, the
meeting was thrown open for the receipt of bids for said bonds.

76196 - City Atty. Hultman reported that since the granting of a cablevision
franchise to Waterloo Cablevision, Inc., a ruling has been handed down
by U.S. Court of Appeals Second Circuit that a body such as the City
Council does not have the power to set rates for special pay cablevision
programming in excess of the basic service, and that the Federal Communi-
cations Commission has sole jurisdiction over the proposed additional
cablevision charges; however, since the Company was desirous that the
City grant such approval with the understanding it lacks jurisdiction
over the same, a resolution of intent and understanding could be adopted
as to the City's position if the item was of concern to the FCC and the
ultimate determination would be by the FCC; and, further, any other
actions by the City would be totally mute as the City does not have the
authority.

76199 - Jessie Holder, Evansdale, inquired about the paving of Adrian Street from
Lafayette Street to Highway 20, which had been taken out of the program
due to objections; also, whether Hackett Road was block grant funded and
was informed it was not in the program.
Moved by Wilharm, seconded by Getty that the above oral request be re-
ceived and placed on file. Motion carried.
76200 - Clifford Boesen, 1120 Bourland Avenue, asked if in times the emergency
warnings, could the police use the bullhorn instead of sirens as the area
residents pay.little attention to sirens due to the proximity of the
hospitals.
Moved by Wilharm, seconded by Burton that the above request be received,
placed on file and referred to the Police Department. Motion carried.
76201 - Council Member Wilharm presented a petition from Klingaman Knolls resi-
dents for paving of William Drive, Winghauen Drive, Clover Lane and
Country Lane in the 1979-1980 supplemental paving program.
Moved by Wilharm, seconded by Burton that the above petition, be received,
placed on file and referred to the City Engineer. Motion carried.
76202 - Moved by Getty, seconded by Burton that communication from Edward J.
Gallagher, Jr. for Mr. and Mrs. Dennis Argo dba DNSTRA, INC. requesting
the rescinding of the building moratorium on Lot 4, Homestead Addition, be

76203 - Moved by Bowers, seconded by Wilharm that petition for oiling of 500, 600
and 700 blocks of Indiana Street, from Eugene T. Wester, 558 Indiana

Company for permission to widen two commercial curb cuts on East Donald

access road to 44', as shown on the attached plat, to serve the Logan
Avenue Plaza complex at Logan Avenue and East Donald Street, and City
Engineer's recommendation for approval subject to the provisions of his
letter, be received, placed on file, recommendations approved and per-
mission granted in accordance therewith. Motion carried.

permission to construct a temporary concrete driveway at 230 Maryland
Avenue without regard to sidewalk grade, together with $3.00 for recording
waiver, and City Engineer's recommendation for approval subject to the

76210 - The Finance Director and City Attorney, having checked the bids submitted
for $33,000 Sewer Improvement.Bonds being offered for sale in connection
with Huntington Road Storm Sewer District Project, Contract No. 95, re-
ported the bid of Shaw, McDermott & Co., of Des Moines, Iowa, being an
effective interest rate of 6.9157% was the best bid received.

76212 - Under Council Actioti #76067 of 4/9/79, action was deferred on Preliminary
Plat of Jane Second Addition.
Plan and Program Director Franke stated the Commission approved the plat
subject to inclusion of sump pumps with no connection from the footing
drain into the sanitary sewer system.

Program Commission, recommending sump pumps be required throughout Jane
Second Addition, be received, placed on file, approved and "Resolution

76213 - Under Council Action #76158 of 4/23/79, action was deferred on Lease
Agreement with Chase Auto Parts Co. Inc. for 2.06 acres in Riverview
Addition.
Moved by Burton, seconded by Getty that communication from Plan and Pro-
gram Commission, transmitting new Exhibit A attachment to above Lease
Agreement, be received, placed on file, approved and substituted for
original Exhibit A attachment, and "Resolution approving Lease Agreement
with Chase Auto Parts Co. Inc. subject to certain stipulations, hold
harmless clause and insurance coverage, and authorizing the execution of

76214 - Under Council Action #76117 of 4/16/79 action was deferred on petition
from Faro Roby for suspension of taxes on N 80' Lot 1, Block 6, Hammond
and Hopkin's addition, under Section 427.8 Code of Iowa.
Mayor Pro Tem Roehr pointed out the City would not be able to recoup and
the Council had a tremendous decision to make when looking at the City
as a whole. Questions were raised on research, income figures checked,
continuing to suspend each year, young person also could be in similar
situation, receiving help from relatives, other avenues to go through
such as churches and other associations who would pay taxes and property
assigned to them, heirs paying taxes etc.

of Iowa on above petition, be received, placed on file, petition approved
and "Resolution recommending to the Board of Supervisors of Black Hawk
County the suspension of current taxes in the amount of $248.88 for 234
