April 9, 1979
The Council of City of Waterloo, Iowa met in Regular Session in Council Chambers
in the City Hall at 7:00 P.M., on April 9, 1979. Mayor Rooff in the Chair. On
roll call: Present: Bowers, Burton, Dowie, Getty, Penaluna, Roehr, Wilharm.
Absent: None. Invocation by Councilman Getty.
76037 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for the
Regular Session of April 9, 1979 at 7:00 P.M., be accepted and approved.
Motion carried.
76038 - Moved by Dowie, seconded by Burton that the Minutes of the Regular Ses-
sion held April 2, 1979 at 7:00 P.M., be approved. Motion carried.
76039 - Under Council Action 76012 of 4/2/79, the F.Y. 1979 Paving Program No. 2,
Contract No. 170, was tabled to this time and place for public hearing
on matter of adoption of plans, specifications, form of contract, or
estimate of cost; the Mayor called for any further objections, there
were none, and he declared the hearing closed.
For clarification purposes, Mayor Rooff stated 8 to 10 more contracts
would be let this year, the large ones are being looked at for breaking
up into smaller segments to allow minority and small contractors to bid,
he couldn't guarantee anyone a bid would be accepted, and recommended
the letting of Contract No. 170.
Moved by Wilharm, seconded by Dowie that "Resolution adopting plans,
specifications, form of contract and estimated cost for F.Y. 1979 Paving
Program No. 2, Contract No. 170", be adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 26243.
76040 - Moved by Roehr, seconded by Getty that the three bids, be received,
placed on file, the Clerk instructed to open same but not read, and
referred to Engineers for inspection and checking. Motion carried.
76041 - Moved by Dowie, seconded by Bowers that proof of publication of notice
to property owners of public hearing on a proposed Resolution of Necessity
for F.Y. 1979 Paving Program No. 1, Contract No. 166, be received and
placed on file. Motion carried.
76042 - The Mayor called for objections to adoption of proposed Resolution of
Necessity for construction of certain street improvements in the cor-
poration, pursuant to notice of the time and place of hearing duly
published and mailed, and pursuant to prior action of said Council; and
announced to those present at said Council meeting that both written
and oral objections would be received and considered by the Council at
this time.
The Clerk reported written objections were filed as follows:
1. Merrild T. Fortune and Alentha M. Fortune, 3541 Hammond Avenue, to
method of payment for extension of Flammang Drive to Hammond Avenue;
2. M.L. Davenport, 3349 Hammond Avenue, et al, to proposed assessment for
Flammang Drive;
3. Frank H. and Jo Ann Collings, to Flammang Drive;-

76043 - James E. Walsh, Jr. Atty. for Robert B. and Shirley Wilson, 3561 Hammond
Avenue, presented an objection to assessments to Flammang Drive.
Moved by Roehr, seconded by Dowie that the above objection be received
and placed on file. Motion carried.
76044 - Mayor Rooff called for objections to Cedar Terrace Drive.
Carol Trout, 3638 East Shaulis Road, stated he was being assessed when
he had no direct access to Cedar Terrace Drive due to railroad tracks.
Discussed was reduction of assessment, forgiveness of entire amount,
setting precedent, property not benefited by improvement.
Mike Diers, 3726 East Shaulis Street, stated an open ditch would be left
and asked that more length be added to culvert going under driveway.

Moved by Roehr, seconded by Wilharm that the above objection and request
be received and placed on file. Motion carried.
76045 - Mayor Rooff called for Foulk Road objections.
Bessie Turner, 5640 Foulk Road, questioned dividing her land into lots
and was told this was only analyzing the land for assessment purposes
and not for sub -division; also, if this was x -amount of lots, shouldn't
she have x -amount of ballots, as she had received no notice of meeting
or ballots. A discussion followed.
Jeryl Stewart, 5073 Foulk Road, objected to cost of concrete.
John Bessor, 5037 Foulk Road, objected to storm sewer plan, his corner
10' deep and needed modification.
Eugene Geary, 5050 Foulk Road, supported Bessie Turner for seven ballots
and Silver Lake Estates right to vote.
Ed Pauley, 5471 Foulk Road, objected to concrete, curb and gutter and
storm sewer.
Question was raised if block grant funding and Mayor Rooff reported
assessments will be no higher than what they are now; and Silver Lake
Estates to be assessed.
Gary Foulk objected to storm sewer and curb and gutter as have good
drainage ditch.
Don Bauler, 5461 Foulk Road, protested raise in assessment, over first
program.
Question raised on water service assessment and pointed out if water was
in the $700 charge would be nullified by calling City Engineer.
Judith Fraser, 5137 Foulk Road, objected to concrete, curb and gutter
and storm sewer as lead-in street Shaulis Road was asphalt and satis-
factory.
Speaking in support (was, were):
Eugene Geary, 5050 Foulk Road, supported Foulk Road design.
Nick Greco, 5433 Foulk Road, supported present proposal.
Roger Cash, 5365 Foulk Road, commented 42 residents and 5 objections,
and Mayor Rooff stated he didn't think they were really objections,
and Don Bauler pointed out Bessie Turner didn't -get any votes and this
would make it 23 to 23.
Moved by Roehr, seconded by Dowie that four objections be received and
placed on file. Motion carried.
76046 - Mayor Rooff called for objections to Bethel Street, there were none.
76047 - Mayor Rooff called for Flammang Drive objections.
James E. Walsh, Jr., Atty. for Robert B. and Shirley Wilson, 3561 Hammond
Avenue, stated this did not improve lots but general improvement leading
to Highway 412 and should not be assessed; excessive costs; this should
have been done by developer at time of platting;
Dr. M.L. Davenport felt City should be responsible.
Merrild Fortune, objected to assessment as retired and no way to pay and
was informed sewer could be deleted and option of hook on payment at
time of building on land.
Mr. Stansberry for his sister Grace Elliott supported the improvements.
Moved by Reohr, seconded by Bowers that.the above objections be received
and placed on file. Motion carried.
76048 - Roger Weselmann, 4054 Suburban Drive, questioned receivin; two notices,
which upon checking were one for concrete on Suburban Drive and the other
for asphalt on Tucson Drive.

76049 - Mayor Rooff called -for objections on North Avenue and there were none.
76050 - Mayor Rooff called for objections on Tucson Drive.
David Heminover, 5377 Tucson Drive, stated the vote was for asphalt with
storm sewer and curb and gutter and proposed plans are open ditch and 4"
slab.
76051 - Mayor Rooff called for Chico Drive objections and there were none.
After receiving or hearing written and oral objections, the Mayor declared
the time for receiving of objections to be closed.
Jim Walsh stated Merrild Fortune did not want the Flammang Drive paving,
his objections should stand, and he didn't want to compromise, and was
told he was only given information. Mayor Rooff stated 4 out of 6 ob-
jected to paving Flammang Drive.
Moved by Bowers, seconded by Burton that above objections be received
and placed on file. Motion carried.
76052 - Moved by Burton, seconded by Getty that Council action on said Resolution
of Necessity, all objections made or filed thereto and all other matters
related or incidental thereto be and are hereby deferred and continued
to a meeting of this Council, to be held on the 16th day of April, 1979,
at 7:00 P.M., at this place; that this Council retains jurisdiction of
said Resolution of Necessity, objections thereto, and other related
matters for consideration and action thereon at said adjourned meeting.
Ayes: Seven. Whereupon the Mayor declared the motion to defer action
adopted.
76053 - The Engineers reported the bids were in order for F.Y. 1979 Paving Pro-
gram No. 2, Contract No. 170.
Moved by Wilharm, seconded by Roehr that the Clerk be instructed to read

76054 - The Engineers, having checked the bids for F.Y. 1979 Paving Program No. 2,
Contract No. 170, reported the bid of Cedar Valley Corporation of Water-
loo, Iowa in the sum of $1,469,538.86, was the lowest bid received.
Moved by Getty, seconded by Wilharm that "Resolution making award of
contract for F.Y. 1979 Paving Program No. 2, Contract No. 170, or accept-
ing the low bid of Cedar Valley Corporation of Waterloo, Iowa, in the
amount of $1,469,538.86", be adopted. Ayes: Seven. Resolution adopted
and upon approval by Mayor, assigned No. 26244.
76055 - Mayor Rooff reminded the Council that last August he asked for one hour
restriction on Commercial Street and now requested "no parking" remain
on north side and two hour limitation on south side between 8:00 A.M.
and 4:00 P.M.; there still were problems with parking on Eleventh Street,
the Citv was studving two wav traffic. including on Commercial Street.
He, also, asked permission for Quintin T. Parker, City Attorney and him-
self to come to some sort of order on parking on the parkings, with re-
commendations to be brought back to the Council and City Attorney to draw
an ordinance.
Discussed was limitation on length of time allowed to park on parking,
city wide, provisions for customer and employee Parking, etc.
Moved by Roehr, seconded by Dowie that the above two requests of Mayor
Rooff, be received, placed on file, approved and City Attorney instructed
to submit a two hour parking ordinance in accordance therewith. Ayes:
Bowers, Burton, Dowie, Penaluna, Roehr, Wilharm. Nay: Getty. Motion car-
ried.
April 9, 1979
76056 - Don Pierce of Pierce's Used Cars and Trucks, 1500 Commercial Street,
protested the parking restrictions. Buzz Rooff of Black Hawk Plumbing,
1509 Commercial Street, stated he had no complaints as he had his own
parking lot.
76057 - Charles Saul reported a drainage problem in Short and Mulberry Street
area caused by broken tile and stated it should be fixed.
Moved by Bowers, seconded by Dowie that the above report be received
and placed on file. Motion carried.
76058 - Alvin Bernett, 3001 Mulberry Street, said he wanted to fix the street
and Bill Anderson said he couldn't fix the street and threatened him,
and he wanted the street opened up. Sanitation/Health Director Hoffman,
Building Official Parsons and City Engineer Anderson to check on this.
76059 - Bonnie Kubik, 1213 Lafayette Street, presented a petition with 26 signers,
protesting the actions and damage being done by two families, the
Klingsmiths at 1218 Lafayette Street and Swaggertys at 1220 Lafayette
Street, the children breaking out windows, cutting holes in siding,
shooting slingshots at cars, running people off sidewalks with bicycles,
throwing broken glass at pedestrians, and asked for something to be done.
Moved by Bowers, seconded by Burton that the above petition be received
placed on file and referred to the Chief of Police and Sanitation De-
partment. Motion carried.
76060 - Margaret Morris stated she gave an easement on a private road and would
this reduce her assessment for Cedar Terrace. City Engineer to check.
76061 - Dennis Reuter, 2703 Randolph Street, inquired about mover's permit to
allow Herbert Nelson to continue moving buildings and was referred to
City Engineer.
76062 - Moved by Dowie, seconded by Bowers that request from Exel Inn for per-
mission to construct one 35' commercial curb cut on frontage road at
3350 University Avenue, as shown on attached plat, and City Engineer's
recommendation for approval subject to the provisions of his letter,
be received, placed on file, recommendations approved and permission
granted in accordance therewith. Motion carried.
76063 - Moved by Roehr, seconded by Burton that report of Quinton T. Parker,
Sign & Traffic Maintenance Department, on request of Ken Dooley, 192
Greenwood Drive, for truck embargo on Greenwood Drive (see C.R.#75974
of 3/26/79), advising the trucking company could not be refused access
to their place of business as there was an embargo on Rainbow Drive,
be received, placed on file and request denied. Motion carried.
76064 - Moved by Burton, seconded by Dowie that City Treasurer's Statement of
March, 1979, showing Balance on Hand 3/1/79 $19,481,805.58, + Receipts
- Taxes $93,121.05, + Receipts - City Clerk 686 773.37, + Receipts -
City Treasurer $1,141,800.80, + Receipts - Transfers $758,932.26, -
Disbursements $3,142,653.41, Balance on Hand 3/31/79 $19,019,779.65, be
received, placed on file and approved. Motion carried.
76065 - Moved by Dowie, seconded by Bowers that 1978 Annual Report of Waterloo
Fire Department, be received and placed on file. Motion carried.
76066 - The Mayor advised the City Council that, due to the fact no bids were
received at the April 2, 1979 Council Meeting, on the $33,000 of Special
Assessment Sewer Improvement Bonds of said City (Contract #95), that
the bond attorneys have advised the City to proceed with steps to fix a
new sale date and to reorder publication of a new Notice of Bond Sale.
This matter was discussed in detail and it was decided that this action
was in the best interests of the City in lieu of delivering said Special
Assessment Bonds to the Contractor, which is permitted under Division IV,
Chapter 384, City Code of Iowa.
Moved by Roehr, seconded by Wilharm that "Resolution directing the
advertisement for sale of $33,000.00 Sewer Improvement Bonds (Huntington
Road Storm Sewer District Improvement Project, 1977, Contract No. 95),
be adopted and sale date set as May 7, 1979. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 26245.

76067 - Plan and Program Director Franke stated the final plat for Jane Second
Addition would have the provision that sump pumps be utilized in this
area as there was concern that water would come into the houses through
the sanitary sewer system. Discussed was footing tile not being con-
nected to sanitary sewer. Gary Heinick for Wayne Claassen Engineering
felt when this was started it be done citywide on all lots when built
upon, that this was the third time this plat was brought to this point,
in January the City Engineer said no sump pumps, and if there was to be
a policy, then it should be enforced for all. John Mclntee protested
that he was not getting a fair shake on this and wanted it systemwide.
Discussed was the difference, can't have same policy throughout city,
require sump pumps in wet areas only, etc.
Moved by Dowie, seconded by Burton that Preliminary Plat of Jane Second
Addition with Deed of Dedication, report of City Engineer, Plan and Pro-
gram Commission's resolution of approval and its recommendation for
Council approval, be received, placed on file and action deferred for
two weeks to allow Plan and Program Commission to submit a recommendation.
Ayes: Burton, Dowie, Getty, Roehr. Nays: Bowers, Penaluna, Wilharm.
Motion carried.
76068 - Mayor Rooff stated Pro's Addition would not further aggravate the Pleasant
Valley or Castle Hill area. He stated next week the City Attorney,
Attorney for Residents, Attorney for Developers, Plan and Program and
himself would meet; the sewer study was in scope of services stage. A
resident reported Letsch Road was breaking up and collapsing due to
developer's trucks hauling rock and the Mayor instructed the Engineer
to check on it.
Moved by Bowers, seconded by Wilharm that Preliminary Plaof Pro's
Addition with Deed of Dedication, report of City Engineers Plan and
Program Commission's resolution of approval and its recommendation for
Council approval, be received, placed on file and "Resolution approving
the Preliminary Plat of Pro's Addition, Waterloo, Black Hawk County,
Iowa", adopted. Ayes: Seven. Resolution adopted and upon approval
by Mayor, assigned No. 26246.
76069 - Moved by Dowie, seconded by Burton that Preliminary Plat of Granger's
Second Addition with Deed of Dedication, Engineer's Certificate of
Survey, report of City Engineer, Plan and Program Commission's resolu-
tion of approval and its recommendation for Council approval, be received
placed on file and "Resolution approving the Preliminary Plat of
Granger's Second Addition, Waterloo, Black Hawk County, Iowa", adopted.
Ayes:. Seven. Resolution adopted and upon approval by Mayor, assigned

76070 - Moved by Roehr,seconded by Penaluna that construction plans for paving
and storm sewer facilities serving Southtown, and City Engineer's re-
commendations for approval, be received, placed on file and approved.

76071 - Moved by Burton, seconded by Dowie that construction plans for sanitary
Sewerage facilities serving Woodland Knolls Addition, together with
Treatment Agreement Form WQ-59 3/78 for Department of Environmental
Quality, and City Engineer's recommendation for approval subject to
final acceptance of plans being reviewed and accepted by DEQ, be re-
ceived, placed on file, recommendations approved, and Mayor and Clerk
authorized to execute said Agreement Form. Motion carried.
76072 - Moved by Burton, seconded by Bowers that "An Ordinance amending the
City Advertising and Sign Ordinance, Chapter 3 of the Code of Ordinances
of the City of Waterloo, Iowa, by repealing Article II, Billposters, Sec.
3-13; also by repealing Article III, Signs, Sec. 3-32 (a) and (b), Sec.
3-36, Sec. 3-39, Sec. 3-45, Sec. 3-47(a), and Sec. 3-75; and enacting in
lieu thereof new sections, Sec. 3-32 (a) and (b), Sec. 3-33, Sec. 3-36,
Sec. 3-39. Sec. 3-45, Sec. 3-47(a), and Sec. 3-73(d) and Sec. 3-74d),
and adding new Article IV thereto", be recieved, placed on file, con-
sidered and the rules requiring ordinances to be considered and voted

and entitlement of 116.25 hours sick leave and 18.75 days vacation pay,

sick leave and vacation pay to Debora G. Lane's estate", adopted. Ayes:

76077 - Moved by Roehr, seconded by Dowie that communication from Conway Civic
Center reporting resignation of Jerome W. Eisele, effective 3/23/79,
and entitlement of 29 days 3 hours sick leave and five weeks vacation
pay, be received placed on file and "Resolution approving payment of
$4,005.68 sick leave and vacation pay to Jerome W. Eisele, resignee of

76078 - There was a discussion on procedure used in arranging order of names on

requesting approval of a.one time fee of $750 for Waterloo Railroad

maintain a sanitary sewer across railroad right-of-way for an annual $50
license fee, be received, placed on file, approved and City Engineer
instructed to proceed accordingly. Ayes: Seven. Motion carried.
76082 - Moved by Burton, seconded by Roehr that communication from City Engineer,
transmitting various petitions for oiling with assessment plats of
certain street, avenues, alleys, etc. or portions thereof, for the 1979
Oiling Program, together with list of streets and alleys with percentages
of assessed costs, and recommending those with 35% or less not be included
be received, placed on file and said streets, avenues, alleys, etc. or
portions thereof 51% or over ordered included in the 1979 Oiling Program
and the City Engineer instructed to proceed accordingly. (Under 51% to

76083 - Moved by Roehr, seconded by Getty that communication from Mayor Rooff,
submitting for Council approval the appointment of Frederik M. Pedersen,
1707 West Seventh Street, to the Community Development Board, for a five
year term to expire March 1, 1984, be received, placed on file and
approved. Motion carried.
