Mayor, Rooff in the Chair. On roll call, Present: Bowers, Burton, Dowie, Getty, Roehr, Wilharm. Absent: Hutchison. Invocation by Councilman Getty. 75860 - Moved by Roehr, seconded by Dowie that the Agenda, as amended, for the Regular Session of March 5, 1979 at 7:00 P.M., be accepted and approved. Motion carried. 75861 - Moved by Burton, secon-ded by Bowers that the Minutes of the Regular Session held February 26, 1979 at 7:00 P.M., and Special Session of March 1, 1979 at 7:00 P.M. be approved. Motion carried. 75862 - Councilman Burton stated petitions have been filed for paving of Martha Street, Lobdell Road, Reber Avenue and Drexel Avenue, which were not eligible for block grant funds but the paving was wanted, and asked if a supplemental agreement was needed to include with F.Y. 1979 Paving Program #2, Contract #170, hearing and was informed this would be a supplemental paving program. Dick Meyer supported the Lobdell Road paving petition. Moved by Burton, seconded by Wilharm that Reber Avenue, Drexel Avenue, Martha Street and Lobdell Road and other streets be included in a supplemental paving program this year and the City Engineer instructed to proceed accordingly. Motion carried. 75863 - Moved by Roehr, seconded by Burton that request from Waterloo City Plan and Program Commission, for vacation of a portion of Cedar Street lying between SWly r -o -w line of West First Street and NEly r -o -w line of West Mullan Avenue in OPE, with City retention of easement, and said Commis- sion's recommendation for approval, be received, placed on file and "Resolution fixing the time and place of hearing and notice to be given on vacation of a portion of Cedar Street as March 26, 1979 at 7:00 P.M. in the Council Chambers in City Hall and Clerk to publish notice of hearing", adopted. Ayes: Six. Absent: Hutchison. Resolution adopted and upon approval by Mayor, assigned No. 26205. 75864 - Moved by Getty, seconded by Burton that request of Crown Development, Inc. together with IDOT Entrance Permit Application, Form 640004, for per- mission to construct one 30' Type "B" Entrance on Highway 218, at Station 580+00, approximately 2746.0 feet northwesterly along centerline of U.S. 218 from south line of the SE w of Sec. 188-88-12,at 5565 LaPorte Road, as shown on attached plat, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and Mayor authorized to sign said application. Motion carried. 75865 - Moved by Roehr, seconded by Dowie that City Treasurer's Statement for February, 1979, showing Balance on Hand 2/1/79 $14,682,309.14, + Receipts - Taxes $133,068.37, + Receipts - City Clerk $824,457.12, + Receipts - City Treasurer $6,077,063.13,+ Receipts - Transfers $1,344,733.55, - Dis- bursements $3,579,825.73, Balance on Hand 2/28/79 $19,481,805.58, be received, placed on file and approved. Motion carried. 75866 - Moved by Burton, seconded by Bowers that communication from City Engineer advising improvements required as a condition precedent to final approval of Cloverdale Acres Replat No. 1 have been completed in substantial con- formance with construction plans, standards and requirements of Engineer- ing Office; submitting four-year maintenance bond for street improvements and two-year maintenance bond for sewer improvements, and recommending acceptance, be received, placed on file, approved, and bonds accepted with effective date on bonds being that of final Council approval. Motion carried. 75867 - Discussed were water retention, not adding more water to present area problems, design plans, oversize pipeline, sunken tanks, City Engineer must approve, awareness of restrictions by developers, City Engineer and owners, etc. Ken Lockard stated dirt has been stockpiled, no water coming off of Perkins; as this land is developed, there probably will be less water going back than now. Moved by Getty, seconded by Bowers that Final Plat of Ken's Addition, Engineer's Certificate of Survey, Deed of Dedication, Contract and Waivers, report of City Engineer, letter from Attorney for Wendell Lock- ard Construction Company indicating storm water runoff plans, Plan and 9 75867 - (Continued) -2- 0 Program Commission's resolution of approval and recommendation for Coun- cil approval, be received, placed on file, approved and "Resolution approving the Final Plat of Ken's Addition, Waterloo, Black Hawk County, Iowa", adopted and Mayor and Clerk authorized and directed to execute said contract. Ayes: Bowers, Dowie, Getty, Wilharm. Nays: Burton, Roehr. Absent: Hutchison. Resolution adopted and upon approval by Mayor, assigned No. 26206. 75868 - Moved by Bowers, seconded by Dowie that communication from Personnel Director, transmitting Agreement between City of Waterloo, Iowa and Municipal Employees Local No. 1127 dated 3/5/79 for two year period of 7/1/79 thru 6/30/81, be received, placed on file and "Resolution approv- ing the Agreement with Municipal Employees Local Union No. 1127 and authorizing Mayor and Clerk to sign and execute same on behalf of the City of Waterloo, Iowa", adopted. Ayes: Six. Absent: Hutchison. Resolution adopted and upon approval by Mayor,assigned No. 26207. 75869 - Councilman Getty presented the oral objection of Agnes B. Robertson to increase of garbage fee to $3.00. Karen Kopplin, 1715 Commercial Street, protested the increase in amount of $1.00. Larry Lehman and Dewayne Eilers also objected. Moved by Wilharm, seconded by Dowie that the above objections be received and placed on file. Motion carried. 75870 - Moved by•Dowie, seconded by Getty that communication from Mayor Rooff, transmitting a proposed ordinance setting the garbage collection fee at $3.00 per month and recommending approval, be received, placed on file and "An ordinance amending Chapter 16, Gargage and Refuse, of the Code of Ordinances of the City of Waterloo, Iowa, by repealing Subsection (a) under Section 16-8, Fee for Service, Penalty for Late Payment; Reim- bursement, and enacting in lieu thereof a new Subsection (a) under Sec- tion 16-8, Fee for Service, Penalty for Late Payment; Reimbursement", considered and passed for the first time. Ayes: Six. Absent: Hutchison. Motion carried. 75871 - Moved by Burton, seconded by Roehr that communication from Mayor Rooff, submitting for Council approval the reappointment of William Nelson, Francis Halbmaier, J.D. Knight and Robert Van Duyn to the Board of Heating for two year terms to expire December 31, 1980, be received, placed on file and approved. Motion carried. 75872 - Councilman Burton pointed out similar street names created problems for the fire, police, postal and other people. Moved by Dowie, seconded by Bowers that communication from Plan and Pro- gram Commission, transmitting list of names for various private streets within the City of Waterloo, and recommending approval, be received, placed on file, approved and City Attorney instructed to submit an ordinance accordingly. Motion carried. 75873 - Moved by Roehr, seconded by Getty that communication from Building Of- ficial, reporting retirement of Javis Yagla,effective 3/28/79, from City Inspection Department, and entitlement fo 480 hours sick leave and 160 hours vacation pay, be received, placed on file and "Resolution approving payment of $4,019.20 sick leave and vacation pay to Jarvis Yagla, Retiree of City Inspection Department", adopted. Ayes: Six. Absent: Hutchison. Resolution adopted and upon approval by Mayor, assigned No. 26208. 75874 - Moved by Burton, seconded by Dowie that following request for permission to attend function, with expenses allowed not to exceed amount shown, be received, placed on file and approved: Signal Technician II (Electrical Department) to DP900 Solid -State Con- troller Seminar, Des Moines, Iowa, May 10 and 11, 1979, $95.00 Ayes: Six.
